| AN ACT |
| |
1 | Amending the act of September 30, 1983 (P.L.160, No.39), |
2 | entitled "An act establishing salaries and compensation of |
3 | certain public officials including justices and judges of |
4 | Statewide courts, judges of courts of common pleas, judges of |
5 | the Philadelphia Municipal Court, judges of the Philadelphia |
6 | Traffic Court, district justices and the Governor, the |
7 | Lieutenant Governor, the State Treasurer, the Auditor |
8 | General, the Attorney General and certain other State |
9 | officers and the salary and certain expenses of the members |
10 | of the General Assembly; and repealing certain inconsistent |
11 | acts," further providing for judicial salaries, for executive |
12 | salaries and for legislative salaries. |
13 | The General Assembly of the Commonwealth of Pennsylvania |
14 | hereby enacts as follows: |
15 | Section 1. Section 2.1 of the act of September 30, 1983 |
16 | (P.L.160, No.39), known as the Public Official Compensation Law, |
17 | reenacted and amended November 16, 2005 (P.L.385, No.72), is |
18 | amended to read: |
19 | Section 2.1. Judicial salaries. |
20 | (a) Supreme Court.--The annual salary of the Chief Justice |
21 | of the Supreme Court shall be $123,000, and the annual salary of |
22 | each of the other justices of the Supreme Court shall be |
23 | $119,750. |

1 | (b) Superior Court.--The annual salary of the President |
2 | Judge of the Superior Court shall be $117,750, and the annual |
3 | salary of the other judges of the Superior Court shall be |
4 | $116,000. |
5 | (c) Commonwealth Court.--The annual salary of the President |
6 | Judge of the Commonwealth Court shall be $117,750. The annual |
7 | salary of each of the other judges of the Commonwealth Court |
8 | shall be $116,000. |
9 | (d) Courts of common pleas.-- |
10 | (1) The annual salary of a president judge of a court of |
11 | common pleas shall be fixed in accordance with the following |
12 | schedule: |
13 | (i) Allegheny County, $106,000. |
14 | (ii) Philadelphia County, $106,500. |
15 | (iii) Judicial districts having six or more judges, |
16 | $105,000. |
17 | (iv) Judicial districts having three to five judges, |
18 | $104,500. |
19 | (v) Judicial districts having one or two judges, |
20 | $104,000. |
21 | (vi) Administrative judges of the divisions of the |
22 | Court of Common Pleas of Philadelphia County with |
23 | divisions of six or more judges, $105,000. |
24 | (vii) Administrative judges of the divisions of the |
25 | Court of Common Pleas of Philadelphia County with |
26 | divisions of five or less judges, $104,500. |
27 | (viii) Administrative judges of the divisions of the |
28 | Court of Common Pleas of Allegheny County with divisions |
29 | of six or more judges, $105,000. |
30 | (ix) Administrative judges of the divisions of the |

1 | Court of Common Pleas of Allegheny County with divisions |
2 | of five or less judges, $104,500. |
3 | (2) The other judges of the courts of common pleas shall |
4 | be paid an annual salary of $104,000. |
5 | (e) Philadelphia Municipal Court.--The President Judge of |
6 | the Philadelphia Municipal Court shall receive an annual salary |
7 | of $103,000. The annual salary for the other judges of the |
8 | Philadelphia Municipal Court shall be $101,250. |
9 | (f) Philadelphia Traffic Court.--The President Judge of the |
10 | Philadelphia Traffic Court shall receive an annual salary of |
11 | $55,000. The annual salary for the other judges of the |
12 | Philadelphia Traffic Court shall be $54,500. |
13 | (g) Magisterial district judges.--A magisterial district |
14 | judge shall receive an annual salary payable by the Commonwealth |
15 | of $51,500. |
16 | (h) Senior judges.--The compensation of the senior judges |
17 | pursuant to 42 Pa.C.S. § 4121 (relating to assignment of judges) |
18 | shall be $315 per day. In any calendar year the amount of |
19 | compensation which a senior judge shall be permitted to earn as |
20 | a senior judge shall not when added to retirement income paid by |
21 | the Commonwealth for such senior judge exceed the compensation |
22 | payable by the Commonwealth to a judge then in regular active |
23 | service on the court from which said senior judge retired. A |
24 | senior judge who so elects may serve without being paid all or |
25 | any portion of the compensation provided by this section. |
26 | [(i) Annual cost-of-living adjustment.--Beginning January 1, |
27 | 1997, and each January 1 thereafter, the annual salaries under |
28 | subsections (a) through (h) shall be increased by the percentage |
29 | change in the Consumer Price Index for All Urban Consumers (CPI- |
30 | U) for the Pennsylvania, New Jersey, Delaware and Maryland area |

1 | for the most recent 12-month period for which figures have been |
2 | officially reported by the United States Department of Labor, |
3 | Bureau of Labor Statistics immediately prior to the date the |
4 | adjustment is due to take effect. The percentage increase and |
5 | salary amounts shall be determined prior to the annual effective |
6 | date of the adjustment by the Supreme Court and shall be |
7 | published in the Pennsylvania Bulletin by the Court |
8 | Administrator of Pennsylvania within 20 days of the date the |
9 | determination is made.] |
10 | Section 2. Section 3 of the act, amended October 19, 1995 |
11 | (P.L.324, No.51) and reenacted and amended November 16, 2005 |
12 | (P.L.385, No.72), is amended to read: |
13 | Section 3. Compensation of Governor and Lieutenant Governor; |
14 | State Treasurer; Auditor General; Attorney General; |
15 | Commissioners of the Pennsylvania Public Utility |
16 | Commission; and heads of departments. |
17 | (a) The Governor, the Lieutenant Governor and Cabinet.--The |
18 | annual salaries of the Governor, the Lieutenant Governor and the |
19 | heads of the departments shall be as follows: Governor, |
20 | $125,000; Lieutenant Governor, $105,000; Adjutant General, |
21 | $90,000; Secretary of Aging, $95,000; Secretary of Agriculture, |
22 | $90,000; Secretary of Banking, $90,000; Secretary of Community |
23 | and Economic Development, $95,000; Secretary of the |
24 | Commonwealth, $90,000; Secretary of Education, $100,000; |
25 | Secretary of Environmental Protection, $100,000; Secretary of |
26 | General Services, $95,000; Secretary of Health, $100,000; |
27 | Insurance Commissioner, $90,000; Secretary of Labor and |
28 | Industry, $100,000; Secretary of Public Welfare, $100,000; |
29 | Secretary of Revenue, $95,000; State Police Commissioner, |
30 | $95,000; Secretary of Transportation, $100,000; Secretary of |

1 | Corrections, $100,000; Secretary of Conservation and Natural |
2 | Resources $95,000. |
3 | (b) Compensation of State Treasurer, Auditor General and |
4 | Attorney General.--The annual salaries of the State Treasurer, |
5 | Auditor General and Attorney General shall be as follows: State |
6 | Treasurer, $104,000; Auditor General, $104,000; Attorney |
7 | General, $104,000. |
8 | (b.1) Compensation of members of boards and commission.--The |
9 | annual salaries of the members of boards and commission shall be |
10 | as follows: member of the Liquor Control Board, $48,800; |
11 | Chairman of the Liquor Control Board, $50,800; member of the |
12 | Civil Service Commission, $40,625; Chairman of the Civil Service |
13 | Commission, $40,625; member of the State Tax Equalization Board, |
14 | $16,250; Chairman of the State Tax Equalization Board, $17,500; |
15 | member of Milk Marketing Board, $15,625; Chairman of Milk |
16 | Marketing Board, $16,250; member of the Securities Commission, |
17 | $15,000; Chairman of the Securities Commission, $16,250; member |
18 | of the Athletic Commission, $12,500; Chairman of the Athletic |
19 | Commission, $13,125; member of the Board of Pardons, $11,500; |
20 | Chairman of the Board of Claims, $84,800; member of the Board of |
21 | Claims, $80,800. |
22 | (c) Additional compensation prohibited.--Neither the |
23 | Governor, Lieutenant Governor, State Treasurer, Auditor General |
24 | or Attorney General nor the head of any administrative |
25 | department nor member of any board or commission referenced |
26 | herein, shall receive any additional compensation for any |
27 | services rendered to the Commonwealth in any capacity. |
28 | (d) Compensation of commissioners of the Pennsylvania Public |
29 | Utility Commission.--Each of the commissioners of the |
30 | Pennsylvania Public Utility Commission shall receive an annual |

1 | salary commensurate with the annual salary received by the |
2 | Secretary of Commerce, except the chairman, who shall receive an |
3 | additional $2,500 per year. |
4 | [(e) Annual cost-of-living adjustment.--Beginning January 1, |
5 | 1997, and each January 1 thereafter, the stated annual salaries |
6 | of the Governor and Lieutenant Governor, the State Treasurer, |
7 | the Auditor General, the Attorney General and the heads of the |
8 | departments and members of boards and commissions denoted herein |
9 | shall be increased by an annual cost-of-living increase |
10 | calculated by applying the percentage change in the Consumer |
11 | Price Index for All Urban Consumers (CPI-U) for the |
12 | Pennsylvania, New Jersey, Delaware and Maryland area, for the |
13 | most recent 12-month period for which figures have been |
14 | officially reported by the United States Department of Labor, |
15 | Bureau of Labor Statistics immediately prior to the date the |
16 | adjustment is due to take effect, to the then current salary |
17 | amounts authorized. The percentage increase and the salary |
18 | amounts shall be determined by the Governor prior to the annual |
19 | effective date of the adjustment and shall be published by the |
20 | Secretary of the Budget in the Pennsylvania Bulletin within ten |
21 | days of the date the determination is made.] |
22 | Section 3. Section 4(d) and (d.1) of the act, reenacted |
23 | November 16, 2005 (P.L.385, No.72), are amended to read: |
24 | Section 4. Members of the General Assembly. |

26 | [(d) Subsequent annual cost-of-living adjustment for |
27 | members.--For the 12-month period beginning December 1, 1997, |
28 | through November 30, 1998, and for each like 12-month period |
29 | thereafter, the salary of the members of the General Assembly |
30 | shall be increased by an annual cost-of-living adjustment |

1 | calculated by applying the percentage change in the Consumer |
2 | Price Index for All Urban Consumers (CPI-U) for the |
3 | Pennsylvania, New Jersey, Delaware and Maryland area, for the |
4 | most recent 12-month period for which figures have been |
5 | officially reported by the United States Department of Labor, |
6 | Bureau of Labor Statistics immediately prior to the date the |
7 | adjustment is due to take effect, to the then current salary |
8 | amounts. The percentage increase and the new salary amounts |
9 | shall be determined jointly by the Chief Clerk of the Senate and |
10 | the Chief Clerk of the House of Representatives prior to the |
11 | annual effective date of the adjustment and shall be published |
12 | by them in the Pennsylvania Bulletin within ten days of the date |
13 | such determination is made. |
14 | (d.1) Subsequent annual cost-of-living adjustment for |
15 | officers and leaders.--For the 12-month period beginning |
16 | December 1, 1997, through November 30, 1998, and for each like |
17 | 12-month period thereafter, the additional compensation of the |
18 | officers and leaders of the General Assembly shall be increased |
19 | by an annual cost-of-living adjustment calculated by applying |
20 | the percentage change in the Consumer Price Index for All Urban |
21 | Consumers (CPI-U) for the Pennsylvania, New Jersey, Delaware and |
22 | Maryland area, for the most recent 12-month period for which |
23 | figures have been officially reported by the United States |
24 | Department of Labor, Bureau of Labor Statistics immediately |
25 | prior to the date the adjustment is due to take effect, to the |
26 | then current compensation. The percentage increase and the new |
27 | compensation amounts shall be determined jointly by the Chief |
28 | Clerk of the Senate and the Chief Clerk of the House of |
29 | Representatives prior to the annual effective date of the |
30 | adjustment and shall be published in the Pennsylvania Bulletin |

1 | within 20 days immediately prior to each cost-of-living increase |
2 | taking effect.] |
3 | Section 4. The amendment of sections 2.1(i), 3(e) and 4(d) |
4 | and (d.1) of the act shall apply to all persons elected or |
5 | appointed to their respective offices after the effective date |
6 | of this section. |
7 | Section 5. This act shall take effect in 60 days. |
