AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, in discipline, removal

3

and retirement of judicial officers, further prohibiting

4

magisterial district judges serving as arbitrators.

5

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

Section 1.  Section 3304 of Title 42 of the Pennsylvania

8

Consolidated Statutes is amended to read:

9

§ 3304.  Acting as collection agent or paid arbitrator

10

prohibited.

11

(a)  Collection agent.--No judge or magisterial district

12

judge shall act as agent for a person in the collection of a

13

claim or judgment for money.

14

(b)  Arbitrator.--[No] Except as provided in subsection (c),

15

no judge or magisterial district judge shall receive any fee or

16

emolument for performing the duties of an arbitrator.

17

(c)  Arbitrator exception.--Except as may otherwise be

18

provided by general rule, the prohibition contained in

subsection (b) shall not apply to a magisterial district judge

2

serving as an arbitrator of any matter that cannot be properly

3

commenced in the magisterial district judge's magisterial

4

district.

5

Section 2.  This act shall take effect in 60 days.
