AN ACT

Amending the act of April 9, 1929 (P.L.177, No.175), entitled

2

"An act providing for and reorganizing the conduct of the

3

executive and administrative work of the Commonwealth by the

4

Executive Department thereof and the administrative

5

departments, boards, commissions, and officers thereof,

6

including the boards of trustees of State Normal Schools, or

7

Teachers Colleges; abolishing, creating, reorganizing or

8

authorizing the reorganization of certain administrative

9

departments, boards, and commissions; defining the powers and

10

duties of the Governor and other executive and administrative

11

officers, and of the several administrative departments,

12

boards, commissions, and officers; fixing the salaries of the

13

Governor, Lieutenant Governor, and certain other executive

14

and administrative officers; providing for the appointment of

15

certain administrative officers, and of all deputies and

16

other assistants and employes in certain departments, boards,

17

and commissions; and prescribing the manner in which the

18

number and compensation of the deputies and all other

19

assistants and employes of certain departments, boards and

20

commissions shall be determined," providing for contracting

21

for State trooper services.

The General Assembly of the Commonwealth of Pennsylvania

23

hereby enacts as follows:

Section 1.  The act of April 9, 1929 (P.L.177, No.175), known

25

as The Administrative Code of 1929, is amended by adding a

26

section to read:

Section 713.1.  State Trooper Services Contractual Program.--

(a)  A municipality or adjacent municipalities which, on the

2

effective date of this section, do not have an organized police

3

force may enter into an agreement with the Pennsylvania State

4

Police for State trooper service. The municipality or

5

municipalities must agree to pay for the State trooper service.

6

(b)  In order to implement this section the Commissioner of

7

the Pennsylvania State Police is authorized to enter into

8

agreements with boroughs and townships for the furnishing of

9

police protection by one or more State troopers on a contractual

10

basis. The contract price for the services shall include only

11

the labor and benefit costs of providing police protection.

12

Moneys paid for the police services shall be credited to a

13

restricted account and used for the express purpose of financing

14

the services for which the contract price was paid. State

15

troopers assigned to this program shall not be included in

16

determining the Pennsylvania State Police's total number of

17

officers and enlisted members.

(c)  The Pennsylvania State Police shall promulgate rules and

19

regulations as may be necessary to implement this program and

20

the contractual agreements authorized by this section. The rules

21

and regulations shall:

22

(1)  Require that as a prerequisite to contracting for the

23

services of a State trooper, a municipality or municipalities

24

shall adopt a resolution or ordinance authorizing the

25

contractual arrangement with the Pennsylvania State Police for

26

the payment by the municipality or municipalities of the costs

27

set pursuant to this section incurred in connection with the

28

provision of these services.

(2)  Require State troopers to remain under the direct

30

control of the Pennsylvania State Police with supervision to be

provided by the commanding officer of the field installation

2

having jurisdiction over the municipality or municipalities

3

contracting for the State trooper services.

(3)  Require that all organizational orders, regulations and

5

directives by the Pennsylvania State Police apply with full

6

force to these assigned troopers.

(4)  Require that the commander of the field installation

8

shall not remove a State trooper assigned pursuant to this

9

contractual program from his area of jurisdiction during

10

assigned hours except in cases of extreme emergency, in which

11

case the governing body of the contracting municipality or

12

municipalities shall be notified.

13

(5)  Require State troopers to enforce 75 Pa.C.S (relating to

14

vehicles), criminal laws of this Commonwealth and local

15

ordinances relating to public safety pursuant to the agreement

16

with the municipality or municipalities.

17

Section 2.  This act shall take effect in 60 days.
