AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, defining "mobile phone"; providing for prohibiting

3

the use of mobile phones in school zones; and imposing a

4

penalty.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Section 102 of Title 75 of the Pennsylvania

8

Consolidated Statutes is amended by adding a definition to read:

9

§ 102.  Definitions.

10

Subject to additional definitions contained in subsequent

11

provisions of this title which are applicable to specific

12

provisions of this title, the following words and phrases when

13

used in this title shall have, unless the context clearly

14

indicates otherwise, the meanings given to them in this section:

"Mobile phone."  A telecommunications device that receives an

17

analog signal or digital signal, or both, and that is designed

18

for handheld use.

Section 2.  Title 75 is amended by adding a section to read:

§ 3316.  Prohibiting use of mobile phones in school zones.

4

(a)  General rule.--No driver may operate a vehicle or school

5

bus while using a mobile phone within a school zone when the

6

school zone lights are illuminated with intermittent flashes.

7

(b)  Exceptions.--This section shall not apply to:

8

(1)  Law enforcement officers and operators of emergency

9

vehicles when on duty and acting in their official

10

capacities.

11

(2)  Other persons when they are reporting an accident or

12

emergency.

13

(c)  Posting.--All school zones shall be posted with signs

14

designated by the department.

15

(d)  Penalty.--A person who violates subsection (a) commits a

16

summary offense and shall, upon conviction, be sentenced to pay

17

a fine of $100. A conviction under this section shall not

18

constitute a moving violation unless the offense involves an

19

accident.

20

Section 3.  This act shall take effect in 60 days.
