AN ACT

Amending the act of September 30, 1983 (P.L.160, No.39),

2

entitled "An act establishing salaries and compensation of

3

certain public officials including justices and judges of

4

Statewide courts, judges of courts of common pleas, judges of

5

the Philadelphia Municipal Court, judges of the Philadelphia

6

Traffic Court, district justices and the Governor, the

7

Lieutenant Governor, the State Treasurer, the Auditor

8

General, the Attorney General and certain other State

9

officers and the salary and certain expenses of the members

10

of the General Assembly; and repealing certain inconsistent

11

acts," further providing for members of the General Assembly;

12

and providing for additional compensation.

The General Assembly of the Commonwealth of Pennsylvania

14

hereby enacts as follows:

15

Section 1.  Section 4 of the act of September 30, 1983

16

(P.L.160, No.39), known as the Public Official Compensation Law,

17

reenacted and amended or reenacted November 16, 2005 (P.L.385,

18

No.72), is amended to read:

19

Section 4.  Members of the General Assembly.

20

(a)  Members salary, expense and mileage.--The salary of

21

members of the General Assembly shall be [$47,000] $30,000 per 

22

annum and mileage to and from their homes at the rate of 20¢ per

23

mile, circular, for each week a member was in actual attendance

in session between their homes and the State Capitol and, except

2

as provided herein, no other compensation shall be allowed

3

whatsoever, except each member of the General Assembly shall

4

receive an allocation for clerical assistance and other expenses

5

incurred during his term in connection with the duties of his

6

office in the sum of $7,500 annually; the salary to be payable

7

in equal monthly installments the first day of the month,

8

including the installment due December 1 of each even-numbered

9

year.

(a.1)  For the period beginning with the effective date of

11

this subsection through November 30, 2009, members of the

12

General Assembly shall receive a salary of $2,500 per month and

13

mileage to and from their homes at the rate of 20¢ per mile,

14

circular, for each week a member was in actual attendance in

15

session between their homes and the State Capitol and, except as

16

provided herein, no other compensation shall be allowed, except

17

each member of the General Assembly shall receive an allocation

18

for clerical assistance and other expenses incurred during the

19

member's term in connection with the duties of the member's

20

office in the sum of $7,500 annually, the salary to be payable

21

in equal monthly installments the first day of the month.

22

(b)  Officers and leaders salaries.--

23

(1)  Senate.--

24

(i)  The following officers of the Senate who shall

25

be elected by the Senate or their respective caucuses

26

shall, in addition to their salaries as members of the

27

General Assembly, receive the following as additional

28

compensation: President pro tempore, [$26,370] $10,000;

Majority Leader, [$21,097] $5,000; Minority Leader,

(ii)  The following officers of the Senate who shall

addition to their salaries as members of the General

11

Assembly, receive the following amounts as additional

12

Majority Caucus Administrator, [$6,593] $2,000.

(iii)  The following officer of the Senate who shall

15

be appointed by the Minority Leader shall, in addition to

16

his salary as a member of the General Assembly, receive

17

the following amount as compensation: Minority Caucus

18

Administrator, [$6,593] $2,000.

(2)  House of Representatives.--The following officers of

20

the House of Representatives who shall be elected by the

21

House or their respective caucuses, in addition to their

22

salary as members of the General Assembly, shall receive the

23

following amounts as additional compensation: Speaker of the

24

House of Representatives, [$26,370] $10,000; Majority Leader,

25

[$21,097] $5,000; Minority Leader, [$21,097] $5,000; Majority

26

Whip, [$16,011] $4,000; Minority Whip, [$16,011] $4,000;

27

(3)  For the period beginning with the effective date of

6

this paragraph through November 30, 2009, the officers' and

7

leaders' salaries provided for in this subsection shall be

8

paid on a prorated basis at a rate equal to 1/12 of the

9

applicable salary amount per month.

(c)  First annual cost-of-living adjustment for members.--For

11

the 12-month period beginning December 1, 1996, through November

12

30, 1997, the salary of the members of the General Assembly

13

shall be increased by a cost-of-living factor which shall be

14

determined by increasing the amounts contained in subsection (a)

15

by the percentage change in the Consumer Price Index for All

16

Urban Consumers (CPI-U) for the Pennsylvania, New Jersey,

17

Delaware and Maryland area, officially reported by the United

18

States Department of Labor, Bureau of Labor Statistics for the

19

period from July 1, 1990, through October 31, 1996. The

20

percentage increase and the new salary amounts shall be

21

determined jointly by the Chief Clerk of the Senate and the

22

Chief Clerk of the House of Representatives and published by

23

them in the Pennsylvania Bulletin within 20 days immediately

24

prior to the cost-of-living increase taking effect.

25

(c.1)  First annual cost-of-living adjustment for officers

26

and leaders.--For the 12-month period beginning December 1,

27

1996, through November 30, 1997, the additional compensation of

28

the officers and leaders of the General Assembly shall be

29

increased by a cost-of-living factor which shall be determined

30

by increasing the amounts contained in subsection (b) by the

percentage change in the Consumer Price Index for All Urban

2

Consumers (CPI-U) for the Pennsylvania, New Jersey, Delaware and

3

Maryland area, officially reported by the United States

4

Department of Labor, Bureau of Labor Statistics for the period

5

from July 1, 1990, through October 31, 1996. The percentage

6

increase and the new compensation amounts shall be determined

7

jointly by the Chief Clerk of the Senate and the Chief Clerk of

8

the House of Representatives and published by them in the

9

Pennsylvania Bulletin on or before November 30 immediately prior

10

to the cost-of-living increase taking effect.

[(d)  Subsequent annual cost-of-living adjustment for

12

members.--For the 12-month period beginning December 1, 1997,

13

through November 30, 1998, and for each like 12-month period

14

thereafter, the salary of the members of the General Assembly

15

shall be increased by an annual cost-of-living adjustment

16

calculated by applying the percentage change in the Consumer

17

Price Index for All Urban Consumers (CPI-U) for the

18

Pennsylvania, New Jersey, Delaware and Maryland area, for the

19

most recent 12-month period for which figures have been

20

officially reported by the United States Department of Labor,

21

Bureau of Labor Statistics immediately prior to the date the

22

adjustment is due to take effect, to the then current salary

23

amounts. The percentage increase and the new salary amounts

24

shall be determined jointly by the Chief Clerk of the Senate and

25

the Chief Clerk of the House of Representatives prior to the

26

annual effective date of the adjustment and shall be published

27

by them in the Pennsylvania Bulletin within ten days of the date

28

such determination is made.

(d.1)  Subsequent annual cost-of-living adjustment for

30

officers and leaders.--For the 12-month period beginning

December 1, 1997, through November 30, 1998, and for each like

2

12-month period thereafter, the additional compensation of the

3

officers and leaders of the General Assembly shall be increased

4

by an annual cost-of-living adjustment calculated by applying

5

the percentage change in the Consumer Price Index for All Urban

6

Consumers (CPI-U) for the Pennsylvania, New Jersey, Delaware and

7

Maryland area, for the most recent 12-month period for which

8

figures have been officially reported by the United States

9

Department of Labor, Bureau of Labor Statistics immediately

10

prior to the date the adjustment is due to take effect, to the

11

then current compensation. The percentage increase and the new

12

compensation amounts shall be determined jointly by the Chief

13

Clerk of the Senate and the Chief Clerk of the House of

14

Representatives prior to the annual effective date of the

15

adjustment and shall be published in the Pennsylvania Bulletin

16

within 20 days immediately prior to each cost-of-living increase

17

taking effect.]

Section 2.  The act is amended by adding a section to read:

19

Section 5.3.  Additional compensation.--No member of the

20

General Assembly may receive health care benefits as a form of

21

compensation for service as a member.

22

Section 3.  This act shall take effect as follows:

23

(1)  The amendment or addition of sections 4(a.1) and 5.3

24

of the act shall take effect in 30 days.

25

(2)  The amendment of section 4(a), (b) and (d) shall

26

take effect December 1, 2009.

27

(3)  The remainder of this act shall take effect

28

immediately.
