AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

Statutes, in liquid fuels and fuels tax, further providing

3

for the definition of "average wholesale price."

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  The definition of "average wholesale price" in

7

section 9002 of Title 75 of the Pennsylvania Consolidated

8

Statutes is amended to read:

§ 9002.  Definitions.

10

The following words and phrases when used in this chapter

11

shall have the meanings given to them in this section unless the

12

context clearly indicates otherwise:

"Average wholesale price."  The average wholesale price per

15

gallon of all taxable liquid fuels and fuels, excluding the

16

Federal excise tax and all liquid fuels taxes, as determined by

17

the Department of Revenue for the 12-month period ending on the

18

September 30 immediately prior to January 1 of the year for

which the rate is to be set. In no case shall the average

2

wholesale price be less than 90¢ nor more than [$1.25] $1.50 per

3

gallon for the 12-month period ending September 30, 2010, and no

4

less than 90¢ nor more than $2 per gallon for the 12-month

5

period ending September 30, 2011, and each year thereafter.

Section 2.  This act shall take effect immediately.
