                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Requires State Department of Agriculture to develop proposed
requirement for certification, sale or labeling of agricultural
product as organically produced. Requires that proposed
requirement include prohibition against selling or labeling
agricultural product as having been organically produced if
product contains detectable levels of artificially derived
compound. Requires department to submit proposal to United States
Secretary of Agriculture for approval. Establishes timelines for
submission of proposed requirement, implementation of requirement
if approval is received and reporting to interim committee of
Legislative Assembly regarding status of approval request.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to the designation of agricultural products as
  organically produced; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) As used in this section, 'agricultural
product' means any agricultural commodity or product, whether raw
or processed, including any commodity or product derived from
livestock that is marketed within this state for human
consumption.
  (2) The State Department of Agriculture shall develop a
proposed requirement for the certification, sale or labeling in
this state of agricultural products that are sold or labeled as
being organically produced. The proposed requirement shall
include, but need not be limited to, a prohibition in this state
against selling or labeling an agricultural product as having
been organically produced if the product contains any detectable
level of an artificially derived compound.
  (3) The department shall ensure that the proposed requirement
complies with all requirements set forth in 7 U.S.C. section 6507
(b)(2)(A) to (C). The department shall submit the proposed
requirement to the United States Secretary of Agriculture and
request approval of the proposed requirement by the secretary
under 7 U.S.C. section 6507 (b)(2)(D).
  (4) The department shall submit the proposed requirement as
provided under subsection (3) of this section no later than
January 2, 2014. If the secretary approves the proposed
requirement, the department shall adopt rules to make

implementation of the requirement operative no later than 90 days
after the effective date authorized by the secretary.
  (5) The department shall report as provided by ORS 192.245 to
an interim committee of the Legislative Assembly dealing with
matters related to agriculture no later than October 1, 2015
regarding the status of the submission made to the secretary
under this section requesting approval of the proposed
requirement. + }
  SECTION 2.  { + This 2013 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2013 Act takes effect on its
passage. + }
