                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Requires State Board of Higher Education, Oregon Health and
Science University Board of Directors or community college board
to receive approval from commodity commission for disposition of
intellectual property if commission provided monetary assistance
to board to acquire property. Requires board to share ownership
of acquired intellectual property with commodity commission in
manner proportionate to amount spent by commission.

                        A BILL FOR AN ACT
Relating to intellectual property rights.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + For any intellectual property acquired by the
State Board of Higher Education, the Oregon Health and Science
University Board of Directors or a community college board with
monetary assistance from a commodity commission established under
ORS 576.051 to 576.455:
  (1) The board may not take any action to dispose of the
intellectual property by sale, lease, license or other action
without the approval of a majority of the members of the
commodity commission.
  (2) The board shall share ownership of the intellectual
property with the commodity commission.
  (3)(a) Except as provided in paragraph (b) of this subsection,
the commodity commission's percentage share of the intellectual
property shall be equal to the percentage share of the commodity
commission's annual budget spent on the monetary assistance in
the year that the contribution was made to the board.
  (b) If the commodity commission's contribution was made over
multiple years, the commodity commission's percentage share of
the intellectual property shall be equal to the average
percentage share of the commodity commission's annual budget
spent on the monetary assistance during the years in which the
commodity commission provided monetary assistance. + }
