A BILL FOR AN ACT Relating to tort liability for land use errors by public body. Be It Enacted by the People of the State of Oregon: SECTION 1. { + Section 2 of this 2013 Act is added to and made a part of ORS chapter 195. + } SECTION 2. { + (1) A local government is liable in tort under ORS 30.260 to 30.300 for the economic injuries incurred by a person who acts in good faith reliance on the negligent misrepresentations of a local government regarding the effect of the local government's comprehensive plan, and land use regulations implementing the plan, on the private real property of the person.
