                             AN ACT

Relating to contract preferences for federally funded transit
  projects; and declaring an emergency.

Be It Enacted by the People of the State of Oregon:

  SECTION 1.  { + Section 2 of this 2012 Act is added to and made
a part of ORS chapter 279A. + }
  SECTION 2.  { + (1) Notwithstanding provisions of law that
require a contracting agency to award a contract to the lowest
responsible bidder or best proposer or provider of a quotation, a
contracting agency that receives and uses funds from the federal
government or an agency of the federal government for a transit
project may give preference to a bidder or proposer that exceeds
federal Buy America requirements that apply to federally funded
transit projects, as permitted under 49 C.F.R. 661.21 as that
regulation existed on the effective date of this 2012 Act.
  (2) The Department of Transportation, the Oregon Department of
Administrative Services and the Attorney General may adopt rules
under ORS 279A.065 and establish policies and procedures to
implement subsection (1) of this section. + }
  SECTION 3.  { + This 2012 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2012 Act takes effect on its
passage. + }
