Sunsets January 1, { - 2015 - } { + 2022 + }. { - Declares emergency, effective on passage. - } { + Takes effect on 91st day following adjournment sine die. + } A BILL FOR AN ACT Relating to funding for technology projects for the Department of Revenue; creating new provisions; appropriating money; and prescribing an effective date. Be It Enacted by the People of the State of Oregon: SECTION 1. { + (1) The Department of Revenue Technology Modernization Fund is established, separate and distinct from the General Fund. Interest earned on the fund is credited to the fund. All moneys in the fund are continuously appropriated to the Department of Revenue for the purposes set forth in sections 2 and 3 of this 2012 Act. (2) The department shall transfer any unexpended balance remaining in the fund on or after June 30, 2021, to the General Fund. + } SECTION 2. { + (1) The Director of the Department of Revenue, subject to ORS chapters 279A and 279B, may enter into contracts for goods and services for a technology project under the terms of which the compensation the Department of Revenue pays to the contractor is a percentage of the revenue that exceeds a baseline amount that the department sets after consultation with the Legislative Revenue Office and that is realized as a result of the successful implementation of the technology project. The terms and conditions of the contract into which the department enters with the contractor shall specify the percentage of revenue that exceeds the baseline amount the department sets and is therefore payable to the contractor. (2) Contracts the director enters into under subsection (1) of this section are exempt from the provisions of ORS 283.085 to 283.092 and ORS 286A.035. (3) The director shall periodically determine the total amount of revenue that exceeds the baseline amount of revenue that the department sets under subsection (1) of this section and that is attributable to the successful implementation of the technology project described in subsection (1) of this section. The department shall deposit amounts determined in accordance with this subsection into the Department of Revenue Technology Modernization Fund established under section 1 of this 2012 Act. + } SECTION 3. { + (1) The Director of the Department of Revenue may pay moneys due to a contractor under the terms and conditions of a contract described in section 2 of this 2012 Act from the Department of Revenue Technology Modernization Fund established in section 1 of this 2012 Act. (2) The director may reimburse the Department of Revenue for the department's expenses of administering and implementing the contract and the technology project described in section 2 of this 2012 Act from moneys available in the fund. (3) The director shall account to the Legislative Assembly during each regular legislative session for the moneys deposited into and the expenditures from the fund during the previous calendar year. + } SECTION 4. { + Sections 1, 2 and 3 of this 2012 Act are repealed on January 1, 2022. + } SECTION 5. { + This 2012 Act takes effect on the 91st day after the date on which the 2012 regular session of the Seventy-sixth Legislative Assembly adjourns sine die. + } ----------
