                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Authorizes City of Junction City to provide water and sewer
services to existing uses on certain parcels outside urban growth
boundary incident to extension of services to state institution
in urban growth boundary.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to urban public facilities; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) As used in this section:
  (a) 'Parcel' has the meaning given that term in ORS 215.010.
  (b) 'State institution' means one or more facilities to be
developed for a public purpose by the Department of Corrections
or the Department of Human Services with a residential capacity
of approximately 220 beds and on-site laundry facilities.
  (2) If the City of Junction City extends water and sewer
services to serve a state institution on lands within the urban
growth boundary of the city and the efficient extension of the
water and sewer services dictates that the right of way for water
and sewer infrastructure crosses land that is not within the
urban growth boundary, the City of Junction City may provide
water and sewer services to uses existing on January 1, 2010, on
a parcel outside the urban growth boundary that is:
  (a) In the path of the right of way of the water and sewer
infrastructure required to serve the state institution;
  (b) Adjacent to and has ingress and egress through a parcel
described in paragraph (a) of this subsection when the actual use
to be connected is within ___ feet of the right of way of the
water and sewer infrastructure; or
  (c) Within ___ feet of the right of way of the water and sewer
infrastructure required to serve the state institution.
  (3) The authority for the City of Junction City to offer water
and sewer services pursuant to this section is granted:
  (a) Notwithstanding the provisions of a statewide land use
planning goal that limit the establishment or extension of sewer
systems outside an urban growth boundary.
  (b) Contingent upon the city's provision of water and sewer
services to a state institution as described in this section.
  (4) Water and sewer services provided pursuant to this section
may not serve as a condition, criterion or other legal basis for
new or expanded uses, or increased densification of the uses, of
a parcel outside of the urban growth boundary. + }
  SECTION 2.  { + This 2010 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2010 Act takes effect on its
passage. + }
