                             AN ACT

Relating to state financial administration; creating new
  provisions; amending section 2, chapter 676, Oregon Laws 2009,
  and section 20, chapter 910, Oregon Laws 2009; repealing
  section 45, chapter 660, Oregon Laws 2009, and section 2,
  chapter 910, Oregon Laws 2009; appropriating money; limiting
  expenditures; and declaring an emergency.

Be It Enacted by the People of the State of Oregon:

  SECTION 1.  { + (1) Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 3, chapter 673, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from federal funds collected or received by the
Department of Justice, is increased by $1,531,744 for
investigating and prosecuting drug trafficking organizations and
gang violence.
  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 3, chapter 673,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses from federal funds
collected or received by the Department of Justice, is increased
by $1,603,405 for federal grants relating to reducing mortgage
fraud, investigating and prosecuting individuals who target
children on the Internet, reducing violence against women and
paying medical and other costs related to victims of person
crimes.
  (3) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 2, chapter 673,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery
funds and federal funds, collected or received by the Department
of Justice, is increased by $510,000 for costs related to
training, investigating and prosecuting issues related to
domestic abuse.
  (4) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 2, chapter 673,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery
funds and federal funds, collected or received by the Department
of Justice, is increased by $337,265 for the processing and
collecting of revenue for crime victims' programs. + }

  SECTION 2.  { + For the biennium beginning July 1, 2009,
expenditures by the Department of Justice from the Department of
Justice Protection and Education Revolving Account under ORS
180.095 (1)(a) for payments of restitution and refunds are not
limited. + }
  SECTION 3.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 3 (4), chapter 680, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from federal funds collected or received by the State
Parks and Recreation Department, is increased by $122,500 for a
forest fuels reduction project in Collier Memorial State Park in
Klamath County. + }
  SECTION 4.  { + (1) Notwithstanding any other provision of law,
the General Fund appropriation made to the Emergency Board by
section 5, chapter 730, Oregon Laws 2009, for the biennium
beginning July 1, 2009, for allocation to the State Forestry
Department for fire protection expenses, is decreased by
$2,137,020.
  (2) Notwithstanding any other provision of law, the General
Fund appropriation made to the State Forestry Department by
section 1 (2), chapter 730, Oregon Laws 2009, for the biennium
beginning July 1, 2009, is increased by $2,137,020 for costs
associated with contracting for large air tankers and helicopters
to supplement fire suppression resources for the 2009 fire
season. + }
  SECTION 5.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 20 (2), chapter 910, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Judicial Department, is
increased by $1,343,662 for electronic court. + }
  SECTION 6.  { + Notwithstanding any other provision of law, the
authorized appropriations and expenditure limitations for the
biennium beginning July 1, 2009, for the Department of Human
Services are changed by the amounts specified: + }

  SECTION 7.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2, chapter 663, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, and including federal funds received from
the Department of Human Services for family preservation and
support and other services supporting children and families, but
excluding lottery funds and federal funds not described in this
section, collected or received by the State Commission on
Children and Families, is increased by $938,274 for expenditures
related to private foundation grants for Reconnecting Foster
Youth with Families and for Reading for Healthy Families. + }
  SECTION 8.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 5, chapter 665, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from federal funds other than those described in section
3, chapter 665, Oregon Laws 2009, collected or received by the
Employment Department, is increased by $1,250,000 for
expenditures related to labor market information enhancement. + }
  SECTION 9.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2 (1), chapter 671, Oregon Laws 2009, as the maximum
limit for payment of expenses and debt service, from fees, moneys
or other revenues, including Miscellaneous Receipts and federal
funds from the United States Department of Housing and Urban
Development for contract services, but excluding lottery funds
and federal funds not described in this section, collected or
received by the Housing and Community Services Department, is
increased by $131,163 for operations. + }
  SECTION 10.  { + (1) Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 4, chapter 671, Oregon Laws 2009, as the maximum limit
for payment of expenses from federal funds other than those

described in sections 2 and 5, chapter 671, Oregon Laws 2009,
collected or received by the Housing and Community Services
Department, is increased by $20,452,513 for expenditures related
to cash grants exchanged for or in lieu of federal low-income
housing tax credits as authorized by section 1602 of the American
Recovery and Reinvestment Act of 2009 (P.L. 111-5).
  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 4, chapter 671,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses from federal funds other
than those described in sections 2 and 5, chapter 671, Oregon
Laws 2009, collected or received by the Housing and Community
Services Department, is increased by $6,829,635 for expenditures
related to administration of the Neighborhood Stabilization
Program grant from the United States Department of Housing and
Urban Development. + }
  SECTION 11.  { + (1) Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 1 (1), chapter 116, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Public Utility Commission of
Oregon, is increased by $222,361 for implementation of portions
of the Enhancing State Government Energy Assurance Capabilities
and Planning for Smart Grid Resiliency Initiative grant awarded
by the United States Department of Energy.
  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 2, chapter 116,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses from federal funds
collected or received by the Public Utility Commission of Oregon,
is increased by $416,474 for expenditures related to the Oregon
Electricity Regulators Assistance Project. + }
  SECTION 12.  { + (1) Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 1 (15), chapter 739, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts and federal funds received as
reimbursement from the United States Department of
Transportation, but excluding lottery funds and federal funds not
described in this section, collected or received by the
Department of Transportation, is increased by $700,000 for
transportation work zone safety patrol grants.
  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 2 (5), chapter
739, Oregon Laws 2009, for the biennium beginning July 1, 2009,
as the maximum limit for payment of expenses from federal funds
other than those described in section 1, chapter 739, Oregon Laws
2009, collected or received by the Department of Transportation,
is increased by $2,000,000 for transportation safety grants. + }
  SECTION 13.  { + (1) For the biennium beginning July 1, 2009,
expenditures by the Oregon Department of Administrative Services
for the federal funds debt service on Build America Bonds are not
limited.
  (2) For the biennium beginning July 1, 2009, expenditures by
the Department of Human Services for the federal funds debt
service on Build America Bonds are not limited.

  (3) For the biennium beginning July 1, 2009, expenditures by
the Oregon Military Department for the federal funds debt service
on Build America Bonds are not limited.
  (4) For the biennium beginning July 1, 2009, expenditures by
the Oregon Youth Authority for the federal funds debt service on
Build America Bonds are not limited.
  (5) For the biennium beginning July 1, 2009, expenditures by
the Department of Community Colleges and Workforce Development
for the federal funds debt service on Build America Bonds are not
limited.
  (6) For the biennium beginning July 1, 2009, expenditures by
the Oregon University System for the federal funds debt service
on Build America Bonds are not limited.
  (7) For the biennium beginning July 1, 2009, expenditures by
the Department of Transportation for the federal funds debt
service on Build America Bonds are not limited.
  (8) For the biennium beginning July 1, 2009, expenditures by
the State Department of Energy for the federal funds debt service
on Build America Bonds are not limited.
  (9) For the biennium beginning July 1, 2009, expenditures by
the Department of Corrections for the federal funds debt service
on Build America Bonds are not limited. + }
  SECTION 14.  { + (1) Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 3, chapter 727, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from federal funds other than those described in
sections 4 and 5, chapter 727, Oregon Laws 2009, collected or
received by the Department of Community Colleges and Workforce
Development, is increased by $2,153,427 for a State Energy Sector
Partnership and Training grant.
  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 4, chapter 727,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses from federal funds other
than those described in section 5, chapter 727, Oregon Laws 2009,
collected or received by the Department of Community Colleges and
Workforce Development for the Oregon Youth Conservation Corps, is
increased by $3,125,000 for the Oregon Youth Employment
Initiative.
  (3) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 2 (1), chapter
727, Oregon Laws 2009, for the biennium beginning July 1, 2009,
as the maximum limit for payment of expenses from fees, moneys or
other revenues, including Miscellaneous Receipts, but excluding
lottery funds, federal funds and those funds described in section
6, chapter 727, Oregon Laws 2009, collected or received by the
Department of Community Colleges and Workforce Development for
the Department of Community Colleges and Workforce Development,
is increased by $478,460 for a State Labor Market Information
Improvement Grant. + }
  SECTION 15.  { + (1) Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2 (1), chapter 721, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Oregon Business Development
Department for business, innovation and trade, is decreased by
$18,989.

  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 2 (2), chapter
721, Oregon Laws 2009, for the biennium beginning July 1, 2009,
as the maximum limit for payment of expenses from fees, moneys or
other revenues, including Miscellaneous Receipts, but excluding
lottery funds and federal funds, collected or received by the
Oregon Business Development Department, is increased by $531,520
for infrastructure financing.
  (3) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 4 (1), chapter
721, Oregon Laws 2009, for the biennium beginning July 1, 2009,
as the maximum limit for payment of expenses from federal funds
collected or received by the Oregon Business Development
Department for business, innovation and trade, is increased by
$5,000,000 for federal grants relating to development of a
biomass utilization project in Grant County. + }
  SECTION 16.  { + (1) Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2 (3), chapter 860, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of Corrections, is
increased by $760,781 for education, treatment and other services
provided to offenders.
  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 3, chapter 860,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses from federal funds
collected or received by the Department of Corrections, is
increased by $1,362,077 for services related to workplace and
community transition training and for the costs of incarcerating
illegal aliens. + }
  SECTION 17.  { + Notwithstanding any other law limiting
expenditures, the amount of $700,000 is established for the
biennium beginning July 1, 2009, as the maximum limit for payment
of expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of Corrections for
capital improvements, including repair of the wastewater
treatment system at the Deer Ridge Correctional Institution and
installation of a solar water heating system at the Eastern
Oregon Correctional Institution. + }
  SECTION 18.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2 (3), chapter 862, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of State Police,
is increased by $60,000 for forensic services requested by
Western Oregon University. + }
  SECTION 19.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 1 (1), chapter 736, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of State Lands, is

increased by $1,268,061 for expenses related to the Portland
Harbor. + }
  SECTION 20.  { + (1) In addition to and not in lieu of any
other appropriation, there is appropriated to the Emergency
Board, for the biennium beginning July 1, 2009, out of the
General Fund, the amount of $2,825,910, to be allocated to the
Department of State Lands for expenses related to expert witness
fees for the Portland Harbor.
  (2) If any of the moneys appropriated by subsection (1) of this
section are not allocated by the Emergency Board prior to
December 1, 2010, the moneys remaining on that date become
available for any purpose for which the Emergency Board lawfully
may allocate funds. + }
  SECTION 21.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2 (2), chapter 736, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from federal funds collected or received by the
Department of State Lands, is increased by $39,700 for Natural
Heritage Advisory Council grant-supported projects. + }
  SECTION 22.  { + (1) Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2 (2), chapter 643, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, and including federal funds for contract
services, but excluding lottery funds and federal funds not
described in section 2, chapter 643, Oregon Laws 2009, collected
or received by the State Department of Agriculture, is increased
by $397,081.
  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 2 (4), chapter
643, Oregon Laws 2009, for the biennium beginning July 1, 2009,
as the maximum limit for payment of expenses from fees, moneys or
other revenues, including Miscellaneous Receipts, and including
federal funds for contract services, but excluding lottery funds
and federal funds not described in section 2, chapter 643, Oregon
Laws 2009, collected or received by the State Department of
Agriculture, is increased by $108,796 for costs related to
management oversight of commodity inspections.
  (3) Notwithstanding any other provision of law, the General
Fund appropriation made to the State Department of Agriculture by
section 1 (2), chapter 643, Oregon Laws 2009, for the biennium
beginning July 1, 2009, for food safety, is decreased by
$400,000.
  (4) Notwithstanding any other provision of law, the General
Fund appropriation made to the State Department of Agriculture by
section 1 (3), chapter 643, Oregon Laws 2009, for the biennium
beginning July 1, 2009, for natural resources is increased by
$225,000. + }
  SECTION 23.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 3, chapter 157, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Board of Naturopathic
Examiners, is increased by $49,781 for the purpose of conducting
investigations. + }

  SECTION 24.  { + (1) Notwithstanding any other provision of
law, the General Fund appropriation made to the Emergency Board
by section 2 (1), chapter 646, Oregon Laws 2009, for the biennium
beginning July 1, 2009, for allocation to the Columbia River
Gorge Commission for operating expenses, is decreased by $25,000.
  (2) Notwithstanding any other provision of law, the General
Fund appropriation made to the Columbia River Gorge Commission by
section 1 (1), chapter 646, Oregon Laws 2009, for the biennium
beginning July 1, 2009, is increased by $25,000 for the joint
operating program. + }
  SECTION 25.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2 (4), chapter 862, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of State Police,
is increased by $2,096,756 for costs of replacing the Computer
Aided Dispatch System and the Records Management System. + }
  SECTION 26.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2 (1), chapter 685, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of Public Safety
Standards and Training for operations, is increased by $706,000
for costs of additional basic law enforcement classes. + }
  SECTION 27.  { + There is appropriated to the State Department
of Fish and Wildlife, for the biennium beginning July 1, 2009,
out of the General Fund, the amount of $1,508,135 for deposit in
the Fish and Wildlife Deferred Maintenance Subaccount established
under ORS 496.303 (7). + }
  SECTION 28. Section 2, chapter 676, Oregon Laws 2009, is
amended to read:

expenditures, the amount of $4,575,874 is established for the
biennium beginning July 1, 2009, as the maximum limit for payment
of expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Legislative Administration

expenditures, the following amounts are established for the
biennium beginning July 1, 2009, as the maximum limits for

  SECTION 29.  { + (1) Notwithstanding any other provision of
law, the General Fund appropriation made to the Department of
Community Colleges and Workforce Development by section 1 (4),
chapter 727, Oregon Laws 2009, for the biennium beginning July 1,
2009, for debt service on the outstanding general obligation
bonds sold pursuant to Article XI-G of the Oregon Constitution,
is increased by $350,000.
  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 2 (3), chapter
727, Oregon Laws 2009, for the biennium beginning July 1, 2009,
as the maximum limit for payment of expenses from fees, moneys or
other revenues, including Miscellaneous Receipts, but excluding
lottery funds, federal funds and those funds described in section
6, chapter 727, Oregon Laws 2009, collected or received by the
Department of Community Colleges and Workforce Development for
debt service, is decreased by $350,000. + }
  SECTION 30.  { + (1) Notwithstanding any other provision of
law, the General Fund appropriation made to the Department of
Corrections by section 1 (4), chapter 860, Oregon Laws 2009, for
the biennium beginning July 1, 2009, for community corrections,
is increased by $103,784,840.
  (2) Notwithstanding any other provision of law, the General
Fund appropriation made to the Department of Corrections by
section 1 (1), chapter 860, Oregon Laws 2009, for the biennium
beginning July 1, 2009, for operations and health services, is
decreased by $103,784,840.
  (3) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 2 (2), chapter
860, Oregon Laws 2009, for the biennium beginning July 1, 2009,

Mortuary and Cemetery Board, is decreased by $3,894.
  (3) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 3, chapter 157,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery
funds and federal funds, collected or received by the Oregon
Board of Naturopathic Medicine, is decreased by $1,579.
  (4) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 4, chapter 157,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery
funds and federal funds, collected or received by the
Occupational Therapy Licensing Board, is decreased by $987.

as the maximum limit for payment of expenses from fees, moneys or
other revenues, including Miscellaneous Receipts, the proceeds of
bonds for the Orphan Site Account and federal funds from
congestion mitigation and air quality grants, for drinking water
protection, beach bacteria monitoring, laboratory accreditation
and the Tillamook Estuary Partnership and for smoke monitoring
laboratory services, but excluding lottery funds and federal
funds not described in section 2, chapter 648, Oregon Laws 2009,
collected or received by the Department of Environmental Quality
for water quality, is decreased by $3,573.
  (4) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 3, chapter 648,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses from lottery moneys
allocated from the Parks and Natural Resources Fund to the
Department of Environmental Quality for activities and projects
to implement section 4 (10), Article XV of the Oregon
Constitution, is decreased by $10,400.
  (5) Notwithstanding any other provision of law, the General
Fund appropriation made to the Department of Environmental
Quality by section 1 (3), chapter 648, Oregon Laws 2009, for the
biennium beginning July 1, 2009, for land quality, is decreased

Fund appropriation made to the Department of State Police by
section 1 (2), chapter 862, Oregon Laws 2009, for the biennium
beginning July 1, 2009, is decreased by $142,122 for savings
related to vacancies and services and supplies.
  (3) Notwithstanding any other provision of law, the General
Fund appropriation made to the Department of State Police by
section 1 (3), chapter 862, Oregon Laws 2009, for the biennium
beginning July 1, 2009, is decreased by $203,746 for savings
related to vacancies.
  (4) Notwithstanding any other provision of law, the General
Fund appropriation made to the Department of State Police by
section 1 (6), chapter 862, Oregon Laws 2009, for the biennium
beginning July 1, 2009, is decreased by $669,981 for savings
related to debt service requirements. + }
  SECTION 69.  { + (1) Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2 (4), chapter 862, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of State Police,
is increased by $47,742 for debt service payments.
  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 3 (4), chapter
862, Oregon Laws 2009, for the biennium beginning July 1, 2009,
as the maximum limit for payment of expenses from federal funds
collected or received by the Department of State Police, is
increased by $770,849 for receipt of federal grant funds relating
to background checks. + }
  SECTION 70.  { + (1) Notwithstanding any other provision of
law, the General Fund appropriation made to the Department of
Corrections by section 1 (5), chapter 860, Oregon Laws 2009, for
the biennium beginning July 1, 2009, is decreased by $4,181,890
for savings related to debt service requirements.
  (2) Notwithstanding any other provision of law, the General
Fund appropriation made to the Department of Corrections by
section 1 (1), chapter 860, Oregon Laws 2009, for the biennium
beginning July 1, 2009, is increased by $471,089 for the
estimated costs of changes in the earned credit program.
  (3) Notwithstanding any other provision of law, the General
Fund appropriation made to the Department of Corrections for
administration, public services, general services and human
resources by section 1 (2), chapter 860, Oregon Laws 2009, for
the biennium beginning July 1, 2009, is decreased by $2,500,000
for undesignated reductions.

  (4) Notwithstanding any other provision of law, the General
Fund appropriation made to the Department of Corrections for
transitional services by section 1 (3), chapter 860, Oregon Laws
2009, for the biennium beginning July 1, 2009, is decreased by
$1,500,000 for undesignated reductions. + }
  SECTION 71.  { + Notwithstanding any other provision of law,
the General Fund appropriation made to the State Board of Parole
and Post-Prison Supervision by section 1, chapter 681, Oregon
Laws 2009, for the biennium beginning July 1, 2009, is increased
by $443,208 for costs related to Attorney General legal services,
psychiatric evaluations and other costs. + }
  SECTION 72.  { + Notwithstanding any other provision of law,
the General Fund appropriation made to the State Commission on
Children and Families by section 1, chapter 663, Oregon Laws
2009, for the biennium beginning July 1, 2009, is increased by
$1,000,000 for relief nurseries. + }
  SECTION 73.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 3, chapter 731, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from lottery moneys allocated from the Administrative
Services Economic Development Fund to the Office of the Governor
for the Economic Revitalization Team is decreased by $72,315. + }
  SECTION 74.  { + (1) In addition to and not in lieu of any
other appropriation, there is appropriated to the Emergency
Board, for the biennium beginning July 1, 2009, out of the
General Fund, the amount of $30,000,000 to be allocated to the
Department of Human Services for costs of increased caseloads and
increases in cost-per-case and for program needs.
  (2) If any of the moneys appropriated by subsection (1) of this
section are not allocated by the Emergency Board prior to
December 1, 2010, the moneys remaining on that date become
available for any purpose for which the Emergency Board lawfully
may allocate funds. + }
  SECTION 75.  { + Notwithstanding any other provision of law,
the General Fund appropriation made to the Judicial Department by
section 1 (1), chapter 723, Oregon Laws 2009, for the biennium
beginning July 1, 2009, is decreased by $2,037,306. + }
  SECTION 76.  { + Notwithstanding any other provision of law,
the General Fund appropriation made to the Public Defense
Services Commission by section 1 (2), chapter 684, Oregon Laws
2009, for the biennium beginning July 1, 2009, is decreased by
$1,000,000. + }
  SECTION 77.  { + (1) In addition to and not in lieu of any
other appropriation, there is appropriated to the Emergency
Board, for the biennium beginning July 1, 2009, out of the
General Fund, the amount of $3,500,000, to be allocated to the
Public Defense Services Commission for the costs associated with
providing public defense.
  (2) If any of the moneys appropriated by subsection (1) of this
section are not allocated by the Emergency Board prior to
December 1, 2010, the moneys remaining on that date become
available for any purpose for which the Emergency Board lawfully
may allocate funds. + }
  SECTION 78.  { + Notwithstanding any other provision of law,
the General Fund appropriation made to the Emergency Board by
section 1, chapter 910, Oregon Laws 2009, for the biennium
beginning July 1, 2009, is decreased by $12,282,457. + }
  SECTION 79.  { + Section 2, chapter 910, Oregon Laws 2009, is
repealed. + }

  SECTION 80.  { + (1) Notwithstanding any other provision of
law, the General Fund appropriation made to the Department of
Revenue by section 1, chapter 655, Oregon Laws 2009, for the
biennium beginning July 1, 2009, is decreased by $174,300.
  (2) Notwithstanding any other provision of law, the General
Fund appropriation made to the Department of Revenue by section
2, chapter 655, Oregon Laws 2009, for the biennium beginning July
1, 2009, is decreased by $200,000. + }
  SECTION 81.  { + Notwithstanding any other provision of law,
the General Fund appropriation made to the Oregon Youth Authority
by section 1 (1), chapter 725, Oregon Laws 2009, for the biennium
beginning July 1, 2009, is decreased by $774,634. + }
  SECTION 82.  { + (1) Notwithstanding any other provision of
law, the General Fund appropriation made to the Department of
Community Colleges and Workforce Development for operations by
section 1 (1), chapter 727, Oregon Laws 2009, for the biennium
beginning July 1, 2009, is decreased by $82,496.
  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 3, chapter 727,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses from federal funds other
than those described in section 4 or 5, chapter 727, Oregon Laws
2009, collected or received by the Department of Community
Colleges and Workforce Development is increased by $11,598.
  (3) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 7, chapter 727,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses by the Department of
Community Colleges and Workforce Development from lottery moneys
allocated from the Administrative Services Economic Development
Fund to the department for debt service on lottery bonds is
decreased by $376,500. + }
  SECTION 83.  { + (1) Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 3 (2), chapter 721, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from lottery moneys allocated from the Administrative
Services Economic Development Fund to the Oregon Business
Development Department is decreased by $287,076.
  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 3 (4), chapter
721, Oregon Laws 2009, for the biennium beginning July 1, 2009,
as the maximum limit for payment of expenses from lottery moneys
allocated from the Administrative Services Economic Development
Fund to the Oregon Business Development Department for debt
service is decreased by $2,079,041. + }
  SECTION 84.  { + (1) Notwithstanding any other provision of
law, the General Fund appropriation made to the Bureau of Labor
and Industries by section 1, chapter 724, Oregon Laws 2009, for
the biennium beginning July 1, 2009, is decreased by $241,600.
  (2) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 2, chapter 724,
Oregon Laws 2009, for the biennium beginning July 1, 2009, as the
maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery
funds and federal funds collected or received by the Bureau of
Labor and Industries, is increased by $190,926.
  (3) Notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 3 (1), chapter
724, Oregon Laws 2009, for the biennium beginning July 1, 2009,

as the maximum limit for payment by the Bureau of Labor and
Industries of administrative expenses from the Wage Security Fund
is increased by $25,674. + }
  SECTION 85.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2 (1), chapter 686, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts and the Oregon War Veterans' Bond Sinking
Account, but excluding lottery funds and federal funds, collected
or received by the Department of Veterans' Affairs for
administration, grants and services supplied to veterans, is
increased by $90,000 for expenses for Educational Aid grants from
the Veterans' Small Business Repair Loan Fund. + }
  SECTION 86.  { + (1) In addition to and not in lieu of any
other appropriation, there is appropriated to the Emergency
Board, for the biennium beginning July 1, 2009, out of the
General Fund, the amount of $168,359, to be allocated to the
Department of Veterans' Affairs for educational benefits for
veterans.
  (2) If any of the moneys appropriated by subsection (1) of this
section are not allocated by the Emergency Board prior to
December 1, 2010, the moneys remaining on that date become
available for any purpose for which the Emergency Board lawfully
may allocate funds. + }
  SECTION 87.  { + (1) Notwithstanding any other law limiting
expenditures, the amount of $2,694,971 is established for the
biennium beginning July 1, 2009, as the maximum limit for payment
of expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Oregon Department of
Administrative Services, for debt service on projects funded with
certificates of participation sold under chapter 2, Oregon Laws
2009.
  (2) Notwithstanding any other provision of law, the General
Fund appropriation made to the Oregon Department of
Administrative Services by section 4 (1), chapter 910, Oregon
Laws 2009, for the biennium beginning July 1, 2009, is decreased
by $2,694,971. + }
  SECTION 88.  { + (1) In addition to and not in lieu of any
other appropriation, there is appropriated to the Psychiatric
Security Review Board, for the biennium beginning July 1, 2009,
out of the General Fund, the amount of $227,377 for the records
and relief program established by chapter 826, Oregon Laws 2009.
  (2) Notwithstanding any other law limiting expenditures, the
amount of $109,762 is established for the biennium beginning July
1, 2009, as the maximum limit for payment of expenses from fees,
moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, collected or received
by the Psychiatric Security Review Board for the records and
relief program established by chapter 826, Oregon Laws 2009. + }
  SECTION 89.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2, chapter 723, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Judicial Department, is
increased by $117,424. + }

expenditures, the limitation on expenditures established by
section 2, chapter 723, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Judicial Department, is
increased by $74,370. + }
  SECTION 92.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 4, chapter 657, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses to support the county fairs in this state from lottery
moneys allocated from the Administrative Services Economic
Development Fund to the Oregon Department of Administrative
Services that are deposited in the County Fair Account
established under ORS 565.445, is decreased by $213,545. + }
  SECTION 93.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 56 (2)(c), chapter 910, Oregon Laws 2009, for the
biennium beginning July 1, 2009, as the maximum limit for payment
of expenses by the Oregon Department of Administrative Services
from lottery moneys allocated from the Administrative Services
Economic Development Fund for debt service and related costs, is
decreased by $156,951. + }
  SECTION 94.  { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 5, chapter 643, Oregon Laws 2009, for the biennium
beginning July 1, 2009, as the maximum limit for payment of
expenses from lottery moneys allocated from the Administrative
Services Economic Development Fund to the State Department of
Agriculture for deposit in the County Fair Account established by
ORS 565.445 to support county fairs, is decreased by $1,555. + }
  SECTION 95.  { + Notwithstanding any other provision of law,
the General Fund appropriation made to the Oregon University
System by section 1 (1), chapter 670, Oregon Laws 2009, for the
biennium beginning July 1, 2009, for education and general
services of higher education is decreased by $67,139. + }
  SECTION 96.  { + Notwithstanding any other provision of law,
the General Fund appropriation made to the Department of
Transportation by section 31 (3), chapter 910, Oregon Laws 2009,
for the biennium beginning July 1, 2009, for Senior and Disabled
Transportation Operating Grants is decreased by $2,300,000. + }
  SECTION 97.  { + Notwithstanding any other provision of law
limiting expenditures, the limitation on expenditures established
by section 1 (13), chapter 739, Oregon Laws 2009, for the
biennium beginning July 1, 2009, as the maximum limit for payment
of expenses from fees, moneys or other revenues, including
Miscellaneous Receipts and federal funds received as
reimbursement from the United States Department of
Transportation, but excluding lottery funds and federal funds not
described in section 1, chapter 739, Oregon Laws 2009, collected
