                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Requires Oregon State Lottery Commission to adopt policies to
mitigate public harms associated with lottery games, marketing
practices and retail regulations at request of Director of Oregon
State Lottery.

                        A BILL FOR AN ACT
Relating to public harms associated with lottery games; creating
  new provisions; and amending ORS 461.200.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 461.200 is amended to read:
  461.200.  { + (1) + } Within 105 days after the confirmation by
the Senate of the Director of the Oregon State Lottery and at
least three commissioners, the director shall begin public sales
of tickets or shares.
   { +  (2) + } The Oregon State Lottery shall be initiated and
shall continue to be operated so as to produce the maximum amount
of net revenues to benefit the public purpose described in
section 4, Article XV of the Constitution of the State of Oregon,
commensurate with the public good. { +  To achieve this end, the
Oregon State Lottery shall actively work to balance its mission
to maximize revenues while minimizing the impact of problem
gambling in Oregon.
  (3) + } Other state government departments, boards,
commissions, agencies and their officers shall cooperate with the
lottery commission so as to aid the lottery commission in
fulfilling these objectives.
  SECTION 2.  { + Section 3 of this 2012 Act is added to and made
a part of ORS chapter 461. + }
  SECTION 3.  { + (1) At the request of the Director of the
Oregon State Lottery, the Oregon State Lottery Commission shall
adopt a comprehensive policy to mitigate the public harms
associated with lottery games, marketing practices and retail
regulations. The policy shall include:
  (a) A code of conduct for marketing or otherwise promoting the
Oregon State Lottery and the playing of lottery games;
  (b) Strategies to enhance the personal responsibility of
persons who play lottery games;
  (c) Strategies to mitigate the risks of playing lottery games;

  (d) Institutional structures to protect persons from negative
consequences associated with lottery games;
  (e) Research on harm mitigation practices and outcomes; and
  (f) Methods to implement the strategies described in this
subsection.
  (2) The commission shall appoint committees, as appropriate, to
make recommendations and advise on the adoption of the
comprehensive policy. A committee shall include persons with
expertise in solving problems caused by gambling to advise the
commission regarding:
  (a) Strategies to mitigate public harms and negative
consequences associated with lottery games and the marketing of
lottery games;
  (b) Further research to be conducted; and
  (c) A method of evaluation to assess the strategies described
in subsection (1) of this section and to track progress in
meeting implementation goals. + }
