Presession filed (at the request of House Interim Committee on Judiciary) SUMMARY The following summary is not prepared by the sponsors of the measure and is not a part of the body thereof subject to consideration by the Legislative Assembly. It is an editor's brief statement of the essential features of the measure. Increases number of Court of Appeals judges from 10 to 13. Provides that new positions become operative October 1, 2013. { - Further increases number of Court of Appeals judges from 13 to 16. Provides that those positions become operative October 1, 2015. - } A BILL FOR AN ACT Relating to the Court of Appeals; creating new provisions; and amending ORS 2.540. Be It Enacted by the People of the State of Oregon: SECTION 1. ORS 2.540 is amended to read: 2.540. (1) The Court of Appeals shall consist of { - 10 - } { + 13 + } judges. (2) A judge of the Court of Appeals shall be an elector of the county of the residence of the judge and be admitted to the practice of law in this state. (3) Each judge of the Court of Appeals shall hold office for a term of six years and until a successor is elected and qualified. SECTION 2. { + (1) The amendments to ORS 2.540 by section 1 of this 2012 Act become operative October 1, 2013. (2) As soon as possible after the amendments to ORS 2.540 by section 1 of this 2012 Act become operative, the Governor shall appoint persons to serve on the Court of Appeals in the positions created by the amendments to ORS 2.540 by section 1 of this 2012 Act until successors are elected and qualified. + } ----------
