                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Provides that coach at public university who intentionally or
recklessly commits or causes to be committed major violation of
rules of National Collegiate Athletic Association is liable for
university's actual damages and attorney fees. Applies to major
violations committed before, on or after effective date.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to coaches at public universities; and declaring an
  emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) As used in this section, 'major violation '
means a violation of the rules of the National Collegiate
Athletic Association that is deemed to be a major violation by
the association.
  (2) Notwithstanding ORS 30.265, a coach at a public university
listed in ORS 352.002 who intentionally or recklessly commits or
causes to be committed a major violation of the rules of the
National Collegiate Athletic Association is liable to the public
university for the university's actual damages incurred as a
result of the major violation.
  (3) The court shall award reasonable attorney fees to a public
university that prevails in an action under this section.
  (4) The Attorney General may independently bring an action on
behalf of a public university under this section. + }
  SECTION 2.  { + (1) Section 1 of this 2013 Act applies to all
major violations of the rules of the National Collegiate Athletic
Association committed before, on or after the effective date of
this 2013 Act.
  (2) An action under section 1 of this 2013 Act for damages
incurred as a result of a major violation of the rules of the
National Collegiate Athletic Association committed before the
effective date of this 2013 Act must be commenced within two
years after the effective date of this 2013 Act. + }
  SECTION 3.  { + This 2013 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2013 Act takes effect on its
passage. + }
