77th OREGON LEGISLATIVE ASSEMBLY--2013 Regular Session Enrolled House Bill 2962 Sponsored by COMMITTEE ON JUDICIARY CHAPTER ................ AN ACT Relating to speedy trial; creating new provisions; amending ORS 135.750; repealing ORS 135.747; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. { + ORS 135.747 is repealed on April 1, 2014. + } SECTION 2. ORS 135.750 is amended to read: 135.750. If the defendant is not proceeded against { - or tried, - } as provided in ORS 135.745 { - and 135.747 - } , and sufficient reason therefor is shown, the court may order the action to be continued and in the meantime may release the defendant from custody as provided in ORS 135.230 to 135.290, for the appearance of the defendant to answer the charge or action. SECTION 3. { + The amendments to ORS 135.750 by section 2 of this 2013 Act become operative on April 1, 2014. + } SECTION 4. { + The repeal of ORS 135.747 by section 1 of this 2013 Act and the amendments to ORS 135.750 by section 2 of this 2013 Act apply to all criminal proceedings, regardless of whether the case is pending on or the prosecution was initiated before April 1, 2014. + } SECTION 5. { + This 2013 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2013 Act takes effect on its passage. + } ---------- Passed by House April 17, 2013 Repassed by House June 11, 2013 .............................................................
