It is an editor's brief statement of the essential features of the measure as introduced. Permits Director of Human Services and Director of Oregon Health Authority to suspend public assistance to recipient who fails without good cause to provide documentation to investigator in connection with possible overpayment of public assistance. Declares emergency, effective on passage. A BILL FOR AN ACT Relating to investigation of public assistance overpayment; amending ORS 411.593; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. ORS 411.593 is amended to read: 411.593. (1) In connection with any public assistance investigation or hearing, the Director of Human Services, the Director of the Oregon Health Authority or any examiner, referee or other officer duly appointed to conduct the investigation or hearing may by subpoena compel the attendance and testimony of witnesses and the production of books, accounts, documents and other papers, and may administer oaths, take depositions and fix the fees and mileage of witnesses. (2) The Department of Human Services and the Oregon Health Authority shall provide for defraying the expenses of such investigations or hearings, which may be held in any part of the state. { + (3) After giving a recipient of public assistance notice and an opportunity for a contested case hearing under ORS chapter 183, the Director of Human Services or the Director of the Oregon Health Authority may suspend the public assistance provided for the needs of the recipient if the recipient fails without good cause to provide documentation of eligibility for public assistance that is requested by an investigator in connection with possible overpayment of public assistance to the recipient. The suspension shall remain in effect until the recipient provides the requested documentation or provides other valid verification of eligibility. + } SECTION 2. { + This 2013 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2013 Act takes effect on its passage. + } ----------
