Specifies exception for city or county that assumes primary responsibility for enforcement of traffic laws on portion of state highway. Declares emergency, effective on passage. A BILL FOR AN ACT Relating to traffic offenses; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. { + Section 2 of this 2013 Act is added to and made a part of ORS 153.640 to 153.680. + } SECTION 2. { + (1) As used in this section, 'state highway' has the meaning given that term in ORS 366.005. 'State highway ' includes interstate highways. (2) Notwithstanding any other provision of ORS 153.640 to 153.680, but subject to subsection (3) of this section, if a court enters a judgment of conviction for a traffic offense committed on a state highway, the full amount of the fine imposed under the judgment is payable to the state and shall be deposited in the Criminal Fine Account. (3) A city or county may enter into an agreement with the Oregon State Police that provides that the city or county will be the primary law enforcement agency responsible for enforcing traffic laws on specified portions of state highways. If a city or county has entered into an agreement under this subsection, fines collected by a court for a traffic offense committed on any portion of a state highway described in the agreement shall be credited and distributed as provided in ORS 153.640 to 153.680. + } SECTION 3. { + Section 2 of this 2013 Act applies only to traffic offenses that are committed on or after the effective date of this 2013 Act. + } SECTION 4. { + This 2013 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2013 Act takes effect on its passage. + } ----------
