                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure.

  Authorizes State Treasurer to issue Article XI-P general
obligation bonds to provide matching funds to school districts
for improvements to school security infrastructure.
  Directs Superintendent of Public Instruction to establish grant
program in collaboration with Director of Office of Emergency
Management for purpose of disbursing funds to improve school
security infrastructure.
  Sunsets grant program on July 1, 2015.
  Declares emergency, effective July 1, 2013.

                        A BILL FOR AN ACT
Relating to school capital improvements for security; and
  declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) Notwithstanding ORS 286A.798 (1)(b), in
addition to and not in lieu of any authorization to issue general
obligation bonds under ORS 286A.035, in the biennium beginning
July 1, 2013, the State Treasurer may issue Article XI-P bonds
in:
  (a) An amount not to exceed $18.75 million of net proceeds for
the purpose specified in subsection (2) of this section, plus an
amount estimated by the State Treasurer to pay estimated
bond-related costs; and
  (b) The manner provided by ORS 286A.796 to 286A.806.
  (2) Subject to the standards applicable to moneys deposited in
the School Capital Matching Fund established under ORS 286A.806,
the Department of Education, in collaboration with the Office of
Emergency Management, shall use the net proceeds of bonds issued
under this section and any interest earned by the net proceeds
for capital costs that improve school security infrastructure, as
described in section 2 of this 2013 Act. + }
  SECTION 2.  { + (1) The Superintendent of Public Instruction,
in collaboration with the Director of the Office of Emergency
Management, shall develop a grant program for the disbursement of
funds to school districts for improvements to school security
infrastructure. The funds for the grant program are to be
provided from net proceeds and interest earnings of bonds issued
pursuant to the authority provided in Article XI-P of the Oregon
Constitution and section 1 of this 2013 Act.
  (2) The grant program shall include the appointment of a grant
committee. The grant committee:
  (a) Shall include persons with experience in administering
state grant programs and representatives of entities with
knowledge about the improvement of security infrastructure; and
  (b) May include any number of persons with qualifications that
the superintendent and director determine necessary.
  (3) Grants awarded as provided by this section must be used for
capital costs that improve the security of buildings or property
used for the instruction of students in the public schools of
this state in any grade from kindergarten through grade 12.
Improvements may include access control for exterior and interior
doors, exterior and interior video monitoring, communications
enhancements, exterior and interior lighting upgrades,
installation or upgrades of alarm systems, perimeter fencing or
window blinds.
  (4) The superintendent and director shall determine the form
and method of applying for grants, any eligibility requirements
for grant applicants, and general terms and conditions of the
grants. The grant process shall:
  (a) Require that the grant applicant provide matching funds for
any grant;
  (b) Require that the grant applicant demonstrate how the grant
will be used as part of a safety plan developed for the school
district; and
  (c) Allow an applicant to appeal any determination of grant
funding to the superintendent and director for reevaluation.
  (5) The grant committee has the responsibility to review and
make determinations on grant applications under the grant program
established pursuant to this section. + }
  SECTION 3.  { + Section 2 of this 2013 Act is repealed July 1,
2015. + }
  SECTION 4.  { + This 2013 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2013 Act takes effect on July 1,
2013. + }
