  Requires insurer to provide process for nurse practitioner
practicing in rural or frontier area to earn same reimbursement
paid to primary care physician.

                        A BILL FOR AN ACT
Relating to reimbursement of nurse practitioner services;
  amending ORS 743A.036.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 743A.036 is amended to read:
  743A.036. (1) Whenever any policy of health insurance provides
for reimbursement for any service which is within the lawful
scope of practice of a duly licensed and certified nurse
practitioner, including prescribing or dispensing drugs, the
insured under the policy is entitled to reimbursement for such
service whether it is performed by a physician licensed by the
Oregon Medical Board or by a duly licensed nurse practitioner.
   { +  (2) An insurer shall provide a process through which a
nurse practitioner may obtain the same reimbursement for a
service that the insurer pays to a primary care physician for the
service if:
  (a) The nurse practitioner maintains an independent primary
care practice in a rural or frontier area, as designated by the
Office of Rural Health; and
  (b) No licensed primary care physician is practicing in a
location that is less than 15 miles from the location of the
practice of the nurse practitioner. + }

group practice health maintenance organizations that are
federally qualified pursuant to Title XIII of the Health
Maintenance Organization Act  { +  or to nurse practitioners
employed by or in a professional services contract with a
licensed health care facility, ambulatory surgical center or
physician's office + }.
