A BILL
To enact section 3717.56 of the Revised Code to 1
require that employees of food service operations 2
be trained in performing the Heimlich maneuver.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3717.56 of the Revised Code be 4
enacted to read as follows:5

       Sec. 3717.56. (A) Every food service operation or retail food 6
establishment providing the services of a food service operation 7
shall require that each employee employed by the operation or 8
establishment, within a reasonable amount of time after being 9
hired, be trained to perform the Heimlich maneuver to relieve a 10
person choking on food or food particles. With respect to any 11
employee employed by the operation or establishment on or before 12
the effective date of this section, the operation or establishment 13
shall require the employee to have the required training within a 14
reasonable amount of time after the effective date of this 15
section.16

       (B) Any employee who is required to be trained under division 17
(A) of this section who receives training to perform the Heimlich 18
maneuver is not liable in damages in a civil action for injury, 19
death, or loss to person or property resulting from the 20
individual's failure to perform the Heimlich maneuver in an 21
emergency situation or from the individual's administration of the 22
Heimlich maneuver in an emergency situation, unless the maneuver 23
is administered in a manner that constitutes willful or wanton 24
misconduct.25

        (C) A food service operation or retail food establishment 26
providing the services of a food service operation is not liable 27
in damages in a civil action for injury, death, or loss to person 28
or property resulting from an employee's administration of or 29
failure to administer the Heimlich maneuver in an emergency 30
situation, so long as the food service operation or retail food 31
establishment complies with division (A) of this section.32
