A BILL
To amend section 4501.21 and to enact section 4503.90 1
of the Revised Code to create the "Nationwide 2
Children's Hospital" license plate.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and section 4
4503.90 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.491, 4503.493, 4503.494, 4503.496, 4503.498, 4503.499, 10
4503.50, 4503.501, 4503.502, 4503.505, 4503.51, 4503.522, 11
4503.523, 4503.531, 4503.545, 4503.55, 4503.551, 4503.552, 12
4503.553, 4503.561, 4503.562, 4503.564, 4503.591, 4503.67, 13
4503.68, 4503.69, 4503.701, 4503.71, 4503.711, 4503.712, 4503.713, 14
4503.72, 4503.73, 4503.74, 4503.75, 4503.751, 4503.85, 4503.89, 15
4503.90, 4503.92, and 4503.94 of the Revised Code. 16

       (B) The registrar shall pay the contributions the registrar 17
collects in the fund as follows: 18

        The registrar shall pay the contributions received pursuant 19
to section 4503.491 of the Revised Code to the breast cancer fund 20
of Ohio, which shall use that money only to pay for programs that 21
provide assistance and education to Ohio breast cancer patients 22
and that improve access for such patients to quality health care 23
and clinical trials and shall not use any of the money for 24
abortion information, counseling, services, or other 25
abortion-related activities. 26

        The registrar shall pay the contributions received pursuant 27
to section 4503.493 of the Revised Code to the autism society of 28
Ohio, which shall use the contributions for programs and autism 29
awareness efforts throughout the state. 30

       The registrar shall pay the contributions the registrar 31
receives pursuant to section 4503.494 of the Revised Code to the 32
national multiple sclerosis society for distribution in equal 33
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 34
chapters of the national multiple sclerosis society. These 35
chapters shall use the money they receive under this section to 36
assist in paying the expenses they incur in providing services 37
directly to their clients.38

       The registrar shall pay the contributions the registrar 39
receives pursuant to section 4503.496 of the Revised Code to the 40
Ohio sickle cell and health association, which shall use the 41
contributions to help support educational, clinical, and social 42
support services for adults who have sickle cell disease.43

       The registrar shall pay the contributions the registrar 44
receives pursuant to section 4503.498 of the Revised Code to 45
special olympics Ohio, inc., which shall use the contributions for 46
its programs, charitable efforts, and other activities. 47

       The registrar shall pay the contributions the registrar 48
receives pursuant to section 4503.499 of the Revised Code to the 49
children's glioma cancer foundation, which shall use the 50
contributions for its research and other programs. 51

        The registrar shall pay the contributions the registrar 52
receives pursuant to section 4503.50 of the Revised Code to the 53
future farmers of America foundation, which shall deposit the 54
contributions into its general account to be used for educational 55
and scholarship purposes of the future farmers of America 56
foundation. 57

        The registrar shall pay the contributions the registrar 58
receives pursuant to section 4503.501 of the Revised Code to the 59
4-H youth development program of the Ohio state university 60
extension program, which shall use those contributions to pay the 61
expenses it incurs in conducting its educational activities. 62

        The registrar shall pay the contributions received pursuant 63
to section 4503.502 of the Revised Code to the Ohio cattlemen's 64
foundation, which shall use those contributions for scholarships 65
and other educational activities. 66

       The registrar shall pay the contributions received pursuant 67
to section 4503.505 of the Revised Code to the organization Ohio 68
region phi theta kappa, which shall use those contributions for 69
scholarships for students who are members of that organization. 70

        The registrar shall pay each contribution the registrar 71
receives pursuant to section 4503.51 of the Revised Code to the 72
university or college whose name or marking or design appears on 73
collegiate license plates that are issued to a person under that 74
section. A university or college that receives contributions from 75
the fund shall deposit the contributions into its general 76
scholarship fund. 77

        The registrar shall pay the contributions the registrar 78
receives pursuant to section 4503.522 of the Revised Code to the 79
"friends of Perry's victory and international peace memorial, 80
incorporated," a nonprofit corporation organized under the laws of 81
this state, to assist that organization in paying the expenses it 82
incurs in sponsoring or holding charitable, educational, and 83
cultural events at the monument. 84

       The registrar shall pay the contributions the registrar 85
receives pursuant to section 4503.523 of the Revised Code to the 86
fairport lights foundation, which shall use the money to pay for 87
the restoration, maintenance, and preservation of the lighthouses 88
of fairport harbor. 89

       The registrar shall pay the contributions the registrar 90
receives pursuant to section 4503.531 of the Revised Code to the 91
thank you foundation, incorporated, a nonprofit corporation 92
organized under the laws of this state, to assist that 93
organization in paying for the charitable activities and programs 94
it sponsors in support of United States military personnel, 95
veterans, and their families.96

        The registrar shall pay the contributions the registrar 97
receives pursuant to section 4503.55 of the Revised Code to the 98
pro football hall of fame, which shall deposit the contributions 99
into a special bank account that it establishes and which shall be 100
separate and distinct from any other account the pro football hall 101
of fame maintains, to be used exclusively for the purpose of 102
promoting the pro football hall of fame as a travel destination. 103

        The registrar shall pay the contributions that are paid to 104
the registrar pursuant to section 4503.545 of the Revised Code to 105
the national rifle association foundation, which shall use the 106
money to pay the costs of the educational activities and programs 107
the foundation holds or sponsors in this state. 108

        The registrar shall pay to the Ohio pet fund the 109
contributions the registrar receives pursuant to section 4503.551 110
of the Revised Code and any other money from any other source, 111
including donations, gifts, and grants, that is designated by the 112
source to be paid to the Ohio pet fund. The Ohio pet fund shall 113
use the moneys it receives under this section to support programs 114
for the sterilization of dogs and cats and for educational 115
programs concerning the proper veterinary care of those animals, 116
and for expenses of the Ohio pet fund that are reasonably 117
necessary for it to obtain and maintain its tax-exempt status and 118
to perform its duties. 119

        The registrar shall pay the contributions the registrar 120
receives pursuant to section 4503.552 of the Revised Code to the 121
rock and roll hall of fame and museum, incorporated. 122

        The registrar shall pay the contributions the registrar 123
receives pursuant to section 4503.553 of the Revised Code to the 124
Ohio coalition for animals, incorporated, a nonprofit corporation. 125
Except as provided in division (B) of this section, the coalition 126
shall distribute the money to its members, and the members shall 127
use the money only to pay for educational, charitable, and other 128
programs of each coalition member that provide care for unwanted, 129
abused, and neglected horses. The Ohio coalition for animals may 130
use a portion of the money to pay for reasonable marketing costs 131
incurred in the design and promotion of the license plate and for 132
administrative costs incurred in the disbursement and management 133
of funds received under this section. 134

        The registrar shall pay the contributions the registrar 135
receives pursuant to section 4503.561 of the Revised Code to the 136
state of Ohio chapter of ducks unlimited, inc., which shall 137
deposit the contributions into a special bank account that it 138
establishes. The special bank account shall be separate and 139
distinct from any other account the state of Ohio chapter of ducks 140
unlimited, inc., maintains and shall be used exclusively for the 141
purpose of protecting, enhancing, restoring, and managing wetlands 142
and conserving wildlife habitat. The state of Ohio chapter of 143
ducks unlimited, inc., annually shall notify the registrar in 144
writing of the name, address, and account to which such payments 145
are to be made. 146

        The registrar shall pay the contributions the registrar 147
receives pursuant to section 4503.562 of the Revised Code to the 148
Mahoning river consortium, which shall use the money to pay the 149
expenses it incurs in restoring and maintaining the Mahoning river 150
watershed. 151

       The registrar shall pay the contributions the registrar 152
receives pursuant to section 4503.564 of the Revised Code to 153
Antioch college for the use of the Glen Helen ecology institute to 154
pay expenses related to the Glen Helen nature preserve.155

        The registrar shall pay to a sports commission created 156
pursuant to section 4503.591 of the Revised Code each contribution 157
the registrar receives under that section that an applicant pays 158
to obtain license plates that bear the logo of a professional 159
sports team located in the county of that sports commission and 160
that is participating in the license plate program pursuant to 161
division (E) of that section, irrespective of the county of 162
residence of an applicant. 163

        The registrar shall pay to a community charity each 164
contribution the registrar receives under section 4503.591 of the 165
Revised Code that an applicant pays to obtain license plates that 166
bear the logo of a professional sports team that is participating 167
in the license plate program pursuant to division (G) of that 168
section. 169

        The registrar shall pay the contributions the registrar 170
receives pursuant to section 4503.67 of the Revised Code to the 171
Dan Beard council of the boy scouts of America. The council shall 172
distribute all contributions in an equitable manner throughout the 173
state to regional councils of the boy scouts. 174

        The registrar shall pay the contributions the registrar 175
receives pursuant to section 4503.68 of the Revised Code to the 176
great river council of the girl scouts of the United States of 177
America. The council shall distribute all contributions in an 178
equitable manner throughout the state to regional councils of the 179
girl scouts. 180

        The registrar shall pay the contributions the registrar 181
receives pursuant to section 4503.69 of the Revised Code to the 182
Dan Beard council of the boy scouts of America. The council shall 183
distribute all contributions in an equitable manner throughout the 184
state to regional councils of the boy scouts. 185

       The registrar shall pay the contributions the registrar 186
receives pursuant to section 4503.701 of the Revised Code to the 187
Prince Hall grand lodge of free and accepted masons of Ohio, which 188
shall use the contributions for scholarship purposes.189

        The registrar shall pay the contributions the registrar 190
receives pursuant to section 4503.71 of the Revised Code to the 191
fraternal order of police of Ohio, incorporated, which shall 192
deposit the fees into its general account to be used for purposes 193
of the fraternal order of police of Ohio, incorporated. 194

        The registrar shall pay the contributions the registrar 195
receives pursuant to section 4503.711 of the Revised Code to the 196
fraternal order of police of Ohio, incorporated, which shall 197
deposit the contributions into an account that it creates to be 198
used for the purpose of advancing and protecting the law 199
enforcement profession, promoting improved law enforcement 200
methods, and teaching respect for law and order. 201

       The registrar shall pay the contributions received pursuant 202
to section 4503.712 of the Revised Code to Ohio concerns of police 203
survivors, which shall use those contributions to provide whatever 204
assistance may be appropriate to the families of Ohio law 205
enforcement officers who are killed in the line of duty. 206

       The registrar shall pay the contributions received pursuant 207
to section 4503.713 of the Revised Code to the greater Cleveland 208
peace officers memorial society, which shall use those 209
contributions to honor law enforcement officers who have died in 210
the line of duty and support its charitable purposes.211

       The registrar shall pay the contributions the registrar 212
receives pursuant to section 4503.72 of the Revised Code to the 213
organization known on March 31, 2003, as the Ohio CASA/GAL 214
association, a private, nonprofit corporation organized under 215
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 216
shall use these contributions to pay the expenses it incurs in 217
administering a program to secure the proper representation in the 218
courts of this state of abused, neglected, and dependent children, 219
and for the training and supervision of persons participating in 220
that program. 221

        The registrar shall pay the contributions the registrar 222
receives pursuant to section 4503.73 of the Revised Code to Wright 223
B. Flyer, incorporated, which shall deposit the contributions into 224
its general account to be used for purposes of Wright B. Flyer, 225
incorporated. 226

       The registrar shall pay the contributions the registrar 227
receives pursuant to section 4503.74 of the Revised Code to the 228
Columbus zoological park association, which shall disburse the 229
moneys to Ohio's major metropolitan zoos, as defined in section 230
4503.74 of the Revised Code, in accordance with a written 231
agreement entered into by the major metropolitan zoos. 232

       The registrar shall pay the contributions the registrar 233
receives pursuant to section 4503.75 of the Revised Code to the 234
rotary foundation, located on March 31, 2003, in Evanston, 235
Illinois, to be placed in a fund known as the permanent fund and 236
used to endow educational and humanitarian programs of the rotary 237
foundation. 238

       The registrar shall pay the contributions the registrar 239
receives pursuant to section 4503.751 of the Revised Code to the 240
Ohio association of realtors, which shall deposit the 241
contributions into a property disaster relief fund maintained 242
under the Ohio realtors charitable and education foundation.243

        The registrar shall pay the contributions the registrar 244
receives pursuant to section 4503.85 of the Revised Code to the 245
Ohio sea grant college program to be used for Lake Erie area 246
research projects. 247

       The registrar shall pay the contributions the registrar 248
receives pursuant to section 4503.89 of the Revised Code to the 249
American red cross of greater Columbus on behalf of the Ohio 250
chapters of the American red cross, which shall use the 251
contributions for disaster readiness, preparedness, and response 252
programs on a statewide basis.253

       The registrar shall pay the contributions the registrar 254
receives pursuant to section 4503.90 of the Revised Code to the 255
nationwide children's hospital foundation.256

       The registrar shall pay the contributions received pursuant 257
to section 4503.92 of the Revised Code to support our troops, 258
incorporated, a national nonprofit corporation, which shall use 259
those contributions in accordance with its articles of 260
incorporation and for the benefit of servicemembers of the armed 261
forces of the United States and their families when they are in 262
financial need. 263

       The registrar shall pay the contributions the registrar 264
receives pursuant to section 4503.94 of the Revised Code to the 265
Michelle's leading star foundation, which shall use the money 266
solely to fund the rental, lease, or purchase of the simulated 267
driving curriculum of the Michelle's leading star foundation by 268
boards of education of city, exempted village, local, and joint 269
vocational school districts.270

       (C) All investment earnings of the license plate contribution 271
fund shall be credited to the fund. Not later than the first day 272
of May of every year, the registrar shall distribute to each 273
entity described in division (B) of this section the investment 274
income the fund earned the previous calendar year. The amount of 275
such a distribution paid to an entity shall be proportionate to 276
the amount of money the entity received from the fund during the 277
previous calendar year.278

       Sec. 4503.90. (A) The owner or lessee of any passenger car, 279
noncommercial motor vehicle, recreational vehicle, or other 280
vehicle of a class approved by the registrar of motor vehicles may 281
apply to the registrar for the registration of the vehicle and 282
issuance of nationwide children's hospital license plates. An 283
application made under this section may be combined with a request 284
for a special reserved license plate under section 4503.40 or 285
4503.42 of the Revised Code. Upon receipt of the completed 286
application and compliance by the applicant with divisions (B) and 287
(C) of this section, the registrar shall issue to the applicant 288
the appropriate vehicle registration and a set of nationwide 289
children's hospital license plates and a validation sticker, or a 290
validation sticker alone when required by section 4503.191 of the 291
Revised Code.292

       In addition to the letters and numbers ordinarily inscribed 293
on the license plates, nationwide children's hospital license 294
plates shall be inscribed with identifying words or markings that 295
are designed by the nationwide children's hospital and approved by 296
the registrar. Nationwide children's hospital license plates shall 297
display county identification stickers that identify the county of 298
registration by name or number.299

       (B) The nationwide children's hospital license plates and a 300
validation sticker, or validation sticker alone, shall be issued 301
upon receipt of a contribution as provided in division (C)(1) of 302
this section and upon payment of the regular license tax as 303
prescribed under section 4503.04 of the Revised Code, any 304
applicable motor vehicle license tax levied under Chapter 4504. of 305
the Revised Code, any applicable additional fee prescribed by 306
section 4503.40 or 4503.42 of the Revised Code, a fee of ten 307
dollars for the purpose of compensating the bureau of motor 308
vehicles for additional services required in the issuing of 309
nationwide children's hospital license plates, and compliance with 310
all other applicable laws relating to the registration of motor 311
vehicles.312

       (C)(1) For each application for registration and registration 313
renewal notice the registrar receives under this section, the 314
registrar shall collect a contribution of twenty-five dollars. The 315
registrar shall deposit this contribution into the state treasury 316
to the credit of the license plate contribution fund created in 317
section 4501.21 of the Revised Code.318

       (2) The registrar shall deposit the additional fee of ten 319
dollars paid to compensate the bureau for the additional services 320
required in the issuing of nationwide children's hospital license 321
plates into the state treasury to the credit of the state bureau 322
of motor vehicles fund created by section 4501.25 of the Revised 323
Code.324

       Section 2. That existing section 4501.21 of the Revised Code 325
is hereby repealed.326
