To enact section 5123.193 of the Revised Code | 1 |
regarding the admission of sex offenders to | 2 |
residential facilities for persons with | 3 |
developmental disabilities. | 4 |
Section 1. That section 5123.193 of the Revised Code be | 5 |
enacted to read as follows: | 6 |
Sec. 5123.193. (A) Before an individual is admitted as a | 7 |
resident to a residential facility, the residential facility shall | 8 |
do both of the following: | 9 |
(1) Search for the individual's name in the internet-based | 10 |
sex offender and child-victim offender database established under | 11 |
division (A)(11) of section 2950.13 of the Revised Code; | 12 |
(2) If the search results identify the individual as a sex | 13 |
offender, notify both of the following that the individual may be | 14 |
admitted to the residential facility: | 15 |
(a) All local law enforcement agencies with jurisdiction over | 16 |
the residential facility's location; | 17 |
(b) Leaders of the community in which the residential | 18 |
facility is located who the residential facility has reason to | 19 |
believe would help disseminate to other members of the community | 20 |
the information about the individual's possible admission. | 21 |
(B) Each residential facility shall develop a protocol for | 22 |
establishing and implementing all of the following plans when the | 23 |
residential facility admits as a resident an individual who is | 24 |
identified as a sex offender pursuant to the search conducted | 25 |
under division (A)(1) of this section: | 26 |
(1) A resident supervision plan that provides for the | 27 |
residential facility to identify and provide the proper amount of | 28 |
supervision the individual needs at the residential facility; | 29 |
(2) A medical emergency plan for the individual and other | 30 |
residents of the residential facility; | 31 |
(3) A community engagement plan that includes methods for | 32 |
both of the following: | 33 |
(a) Members of the community in which the residential | 34 |
facility is located to express concerns about the residential | 35 |
facility's operation; | 36 |
(b) The residential facility to address the community | 37 |
members' concerns that are expressed to the residential facility. | 38 |
(C) A residential facility that admits as a resident an | 39 |
individual who is identified as a sex offender pursuant to the | 40 |
search conducted under division (A)(1) of this section shall do | 41 |
both of the following: | 42 |
(1) In accordance with the protocol developed under division | 43 |
(B) of this section, establish and implement the plans specified | 44 |
in that division; | 45 |
(2) Subject to division (D) of this section, provide copies | 46 |
of the plans to the local law enforcement agencies and community | 47 |
leaders to whom the residential facility provides notice about the | 48 |
individual pursuant to division (A)(2) of this section. | 49 |
(D) A residential facility shall redact all medical | 50 |
information about individuals from the copies of the plans that | 51 |
the residential facility provides to local law enforcement | 52 |
agencies and community leaders pursuant to division (C)(2) of this | 53 |
section. | 54 |
