A BILL
To amend sections 3335.02, 3335.09, 3337.01, 3339.01, 1
3341.02, 3343.02, 3343.06, 3344.01, 3350.10, 2
3352.01, 3356.01, 3359.01, 3361.01, 3362.01, and 3
3364.01 of the Revised Code to require the boards 4
of trustees of state universities and the 5
Northeast Ohio Medical University to adopt a 6
resolution to grant or not grant to student 7
members voting power and the authority to attend 8
executive sessions.9


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 3335.02, 3335.09, 3337.01, 3339.01, 10
3341.02, 3343.02, 3343.06, 3344.01, 3350.10, 3352.01, 3356.01, 11
3359.01, 3361.01, 3362.01, and 3364.01 of the Revised Code be 12
amended to read as follows:13

       Sec. 3335.02.  (A) The government of the Ohio state 14
university shall be vested in a board of fourteen trustees in 15
2005, and seventeen trustees beginning in 2006, who shall be 16
appointed by the governor, with the advice and consent of the 17
senate. Two of the seventeen trustees shall be students at the 18
Ohio state university, and their selection and terms shall be in 19
accordance with division (B) of this section. Except as provided 20
in division (C)(D) of this section and except for the terms of 21
student members, terms of office shall be for nine years, 22
commencing on the fourteenth day of May and ending on the 23
thirteenth day of May. Each trustee shall hold office from the 24
date of appointment until the end of the term for which the 25
trustee was appointed. Any trustee appointed to fill a vacancy 26
occurring prior to the expiration of the term for which the 27
trustee's predecessor was appointed shall hold office for the 28
remainder of such term. Any trustee shall continue in office 29
subsequent to the expiration date of the trustee's term until the 30
trustee's successor takes office, or until a period of sixty days 31
has elapsed, whichever occurs first. No person who has served a 32
full nine-year term or more than six years of such a term shall be 33
eligible for reappointment until a period of four years has 34
elapsed since the last day of the term for which the person 35
previously served. The trustees shall not receive compensation for 36
their services, but shall be paid their reasonable necessary 37
expenses while engaged in the discharge of their official duties.38

       (B) The student members of the board of trustees of the Ohio 39
state university shall be students at the Ohio state university. 40
Unless student members have been granted voting power under 41
division (C) of this section, they shall have no voting power on 42
the board. Student members, shall not be considered as members of 43
the board in determining whether a quorum is present. Student 44
members, and shall not be entitled to attend executive sessions of 45
the board. The student members of the board shall be appointed by 46
the governor, with the advice and consent of the senate, from a 47
group of five candidates selected pursuant to a procedure adopted 48
by the university's student governments and approved by the 49
university's board of trustees. The initial term of office of one 50
of the student members shall commence on May 14, 1988, and shall 51
expire on May 13, 1989, and the initial term of office of the 52
other student member shall commence on May 14, 1988, and expire on 53
May 13, 1990. Thereafter, terms of office of student members shall 54
be for two years, each term ending on the same day of the same 55
month of the year as the term it succeeds. In the event a student 56
member cannot fulfill a two-year term, a replacement shall be 57
selected to fill the unexpired term in the same manner used to 58
make the original selection.59

        (C) Not later than ninety days after the effective date of 60
this amendment, the board of trustees shall adopt a resolution 61
that does one of the following:62

       (1) Grants the student members of the board voting power on 63
the board. If so granted, in addition to having voting power, the 64
student members shall be considered as members of the board in 65
determining whether a quorum is present and shall be entitled to 66
attend executive sessions of the board.67

       (2) Declares that student members do not have voting power on 68
the board.69

       Thereafter, the board may change the voting status of student 70
trustees by adopting a subsequent resolution. Each resolution 71
adopted under this division shall take effect on the fourteenth 72
day of May following the adoption of the resolution. All members 73
with voting power at the time of the adoption of a resolution may 74
vote on the resolution.75

       If student members are granted voting power under this 76
division, no student shall be disqualified from membership on the 77
board of trustees because the student receives a scholarship, 78
grant, loan, or any other financial assistance payable out of the 79
state treasury or a university fund, or because the student is 80
employed by the university in a position pursuant to a work-study 81
program or other student employment, including as a graduate 82
teaching assistant, graduate administrative assistant, or graduate 83
research assistant, the compensation for which is payable out of 84
the state treasury or a university fund.85

       Acceptance of such financial assistance or employment by a 86
student trustee shall not be considered a violation of Chapter 87
102. or section 2921.42 or 2921.43 of the Revised Code.88

       (C)(D)(1) The initial terms of office for the three 89
additional trustees appointed in 2005 shall commence on a date in 90
2005 that is selected by the governor with one term of office 91
expiring on May 13, 2009, one term of office expiring on May 13, 92
2010, and one term of office expiring on May 13, 2011, as 93
designated by the governor upon appointment. Thereafter terms of 94
office shall be for nine years, as provided in division (A) of 95
this section.96

       (2) The initial terms of office for the three additional 97
trustees appointed in 2006 shall commence on May 14, 2006, with 98
one term of office expiring on May 13, 2012, one term of office 99
expiring on May 13, 2013, and one term of office expiring on May 100
13, 2014, as designated by the governor upon appointment. 101
Thereafter terms of office shall be for nine years, as provided in 102
division (A) of this section.103

       Sec. 3335.09.  The board of trustees of the Ohio state 104
university shall elect, fix the compensation of, and remove, the 105
president and such number of professors, teachers, and other 106
employees as are necessary; but. Except as provided under division 107
(C) of section 3335.02 of the Revised Code, no trustee, or his 108
relationrelative of a trustee by blood or marriage, shall be 109
eligible to a professorship or position in the university, the 110
compensation for which is payable out of the state treasury or a 111
university fund. The board shall fix and regulate the course of 112
instruction and prescribe the extent and character of experiments 113
to be made at the university.114

       Sec. 3337.01.  (A) The body politic and corporate by the name 115
and style of "The President and Trustees of the Ohio University" 116
now in the university instituted and established in Athens by the 117
name and style of "The Ohio University" shall consist of a board 118
of trustees composed of eleven members, who shall be appointed by 119
the governor, with the advice and consent of the senate. At least 120
five of the trustees who are not students shall be graduates of 121
Ohio university. Two of the trustees shall be students at Ohio 122
university, and their selection and terms shall be in accordance 123
with division (B) of this section. A majority of the board 124
constitutes a quorum. Except for the terms of student members, 125
terms of office shall be for nine years, commencing on the 126
fourteenth day of May and ending on the thirteenth day of May, 127
except that upon expiration of the term ending on May 14, 1978, 128
the new term which succeeds it shall commence on May 15, 1978, and 129
end on May 13, 1987. Each member shall hold office from the date 130
of appointment until the end of the term for which the member was 131
appointed. Any member appointed to fill a vacancy occurring prior 132
to the expiration of the term for which the member's predecessor 133
was appointed shall hold office for the remainder of such term. 134
Any member shall continue in office subsequent to the expiration 135
date of the member's term until the member's successor takes 136
office, or until a period of sixty days has elapsed, whichever 137
occurs first. No person who has served a full nine-year term or 138
more than six years of such a term shall be eligible for 139
reappointment until a period of four years has elapsed since the 140
last day of the term for which the person previously served. Such 141
trustees shall receive no compensation for their services, but 142
shall be paid their actual and necessary expenses while engaged in 143
the discharge of their official duties.144

       (B) The student members of the board of trustees of the Ohio 145
university shall be students at the Ohio university. Unless 146
student members have been granted voting power under division (C) 147
of this section, they shall have no voting power on the board. 148
Student members, shall not be considered as members of the board 149
in determining whether a quorum is present. Student members, and150
shall not be entitled to attend executive sessions of the board. 151
The student members of the board shall be appointed by the 152
governor, with the advice and consent of the senate, from a group 153
of five candidates selected pursuant to a procedure adopted by the 154
university's student governments and approved by the university's 155
board of trustees. The initial term of office of one of the 156
student members shall commence on May 14, 1988, and shall expire 157
on May 13, 1989, and the initial term of office of the other 158
student member shall commence on May 14, 1988, and expire on May 159
13, 1990. Thereafter, terms of office of student members shall be 160
for two years, each term ending on the same day of the same month 161
of the year as the term it succeeds. In the event that a student 162
member cannot fulfill the student member's two-year term, a 163
replacement shall be selected to fill the unexpired term in the 164
same manner used to make the original selection.165

       (C) Not later than ninety days after the effective date of 166
this amendment, the board of trustees shall adopt a resolution 167
that does one of the following:168

       (1) Grants the student members of the board voting power on 169
the board. If so granted, in addition to having voting power, the 170
student members shall be considered as members of the board in 171
determining whether a quorum is present and shall be entitled to 172
attend executive sessions of the board.173

       (2) Declares that student members do not have voting power on 174
the board.175

       Thereafter, the board may change the voting status of student 176

teaching assistant, graduate administrative assistant, or graduate 189
research assistant, the compensation for which is payable out of 190
the state treasury or a university fund.191

       Acceptance of such financial assistance or employment by a 192
student trustee shall not be considered a violation of Chapter 193
102. or section 2921.42 or 2921.43 of the Revised Code.194

       Sec. 3339.01.  (A) The government of Miami university shall 195
be vested in eleven trustees, who shall be appointed by the 196
governor, with the advice and consent of the senate. Two of the 197
trustees shall be students at Miami university, and their 198
selection and terms shall be in accordance with division (B) of 199
this section. A majority of the board constitutes a quorum. Except 200
for the terms of student members, terms of office shall be for 201
nine years, commencing on the first day of March and ending on the 202
last day of February, except that upon expiration of the trustee 203
term ending on March 1, 1974, the trustee term which succeeds it 204
shall commence on March 2, 1974, and end on February 28, 1983; 205
upon expiration of the trustee term ending on March 1, 1977, the 206
trustee term which succeeds it shall commence on March 2, 1977,207
and end on February 28, 1986; upon expiration of the trustee term 208
ending on March 1, 1978, the trustee term which succeeds it shall 209
commence on March 2, 1978, and end on February 28, 1987; and upon 210
expiration of the trustee term ending on March 1, 1979, the 211
trustee term which succeeds it shall commence on March 2, 1979,212
and end on February 29, 1988. Each trustee shall hold office from 213
the date of appointment until the end of the term for which the 214
trustee was appointed. Any trustee appointed to fill a vacancy 215
occurring prior to the end of the term for which the trustee's 216
predecessor was appointed shall hold office for the remainder of 217
such term. Any trustee shall continue in office subsequent to the 218
expiration date of the trustee's term until a successor takes 219
office, or until a period of sixty days has elapsed, whichever 220
occurs first. No person who has served a full nine-year term or 221
more than six years of such a term shall be eligible for 222
reappointment until a period of four years has elapsed since the 223
last day of the term for which the person previously served. The 224
trustees shall receive no compensation for their services but 225
shall be paid their reasonable necessary expenses while engaged in 226
the discharge of their official duties.227

       (B) The student members of the board of trustees of Miami 228
university shall be students at Miami university. Unless student 229
members have been granted voting power under division (C) of this 230
section, they shall have no voting power on the board. Student 231
members, shall not be considered as members of the board in 232
determining whether a quorum is present. Student members, and233
shall not be entitled to attend executive sessions of the board. 234
The student members of the board shall be appointed by the 235
governor, with the advice and consent of the senate, from a group 236
of five candidates selected pursuant to a procedure adopted by the 237
university's student governments and approved by the university's 238
board of trustees. The initial term of office of one of the 239
student members shall commence on March 1, 1988, and shall expire 240
on February 28, 1989, and the initial term of office of the other 241
student member shall commence on March 1, 1988, and expire on 242
February 28, 1990. Thereafter, terms of office of student members 243
shall be for two years, each term ending on the last day of 244
February. In the event that a student member cannot fulfill the 245
student member's two-year term, a replacement shall be selected to 246
fill the unexpired term in the same manner used to make the 247
original selection.248

       (C) Not later than ninety days after the effective date of 249
this amendment, the board of trustees shall adopt a resolution 250
that does one of the following:251

       (1) Grants the student members of the board voting power on 252
the board. If so granted, in addition to having voting power, the 253
student members shall be considered as members of the board in 254
determining whether a quorum is present and shall be entitled to 255
attend executive sessions of the board.256

       (2) Declares that student members do not have voting power on 257
the board.258

       Thereafter, the board may change the voting status of student 259
trustees by adopting a subsequent resolution. Each resolution 260
adopted under this division shall take effect on the first day of 261
March following the adoption of the resolution. All members with 262
voting power at the time of the adoption of a resolution may vote 263
on the resolution.264

        If student members are granted voting power under this 265
division, no student shall be disqualified from membership on the 266
board of trustees because the student receives a scholarship, 267
grant, loan, or any other financial assistance payable out of the 268
state treasury or a university fund, or because the student is 269
employed by the university in a position pursuant to a work-study 270
program or other student employment, including as a graduate 271
teaching assistant, graduate administrative assistant, or graduate 272
research assistant, the compensation for which is payable out of 273
the state treasury or a university fund.274

       Acceptance of such financial assistance or employment by a 275
student trustee shall not be considered a violation of Chapter 276
102. or section 2921.42 or 2921.43 of the Revised Code.277

       Sec. 3341.02.  (A) The government of Bowling Green state 278
university is vested in a board of eleven trustees, who shall be 279
appointed by the governor, with the advice and consent of the 280
senate. Two of the trustees shall be students at Bowling Green 281
state university, and their selection and terms shall be in 282
accordance with division (B) of this section. A majority of the 283
board constitutes a quorum. Except for the terms of student 284
members, terms of office shall be for nine years, commencing on 285
the seventeenth day of May and ending on the sixteenth day of May. 286
No person who has served a full nine-year term or more than six 287
years of such a term shall be eligible for reappointment until a 288
period of four years has elapsed since the last day of the term 289
for which the person previously served.290

       (B) The student members of the board of trustees of Bowling 291
Green state university shall be students at Bowling Green state 292
university. Unless student members have been granted voting power 293
under division (C) of this section, they shall have no voting 294
power on the board. Student members, shall not be considered as 295
members of the board in determining whether a quorum is present. 296
Student members, and shall not be entitled to attend executive 297
sessions of the board. The student members of the board shall be 298
appointed by the governor, with the advice and consent of the 299
senate, from a group of five candidates selected pursuant to a 300
procedure adopted by the university's student governments and 301
approved by the university's board of trustees. The initial term 302
of office of one of the student members shall commence on March 303
17, 1988, and shall expire on March 16, 1989, and the initial term 304
of office of the other student member shall commence on March 17, 305
1988, and expire on March 16, 1990. After September 22, 2000, 306
terms of office shall commence on the seventeenth day of May and 307
shall end on the sixteenth day of May. Terms of office of student 308
members shall be for two years, each term ending on the same day 309
of the same month of the year as the term it succeeds. In the 310
event that a student member cannot fulfill the student member's 311
two-year term, a replacement shall be selected in the manner used 312
for the original selection to fill the unexpired term.313

       (C) Not later than ninety days after the effective date of 314
this amendment, the board of trustees of Bowling Green state 315
university shall adopt a resolution that does one of the 316
following:317

       (1) Grants the student members of the board voting power on 318
the board. If so granted, in addition to having voting power, the 319
student members shall be considered as members of the board in 320
determining whether a quorum is present and shall be entitled to 321
attend executive sessions of the board.322

       (2) Declares that student members do not have voting power on 323
the board.324

       Thereafter, the board may change the voting status of student 325
trustees by adopting a subsequent resolution. Each resolution 326
adopted under this division shall take effect on the seventeenth 327
day of May following the adoption of the resolution. All members 328
with voting power at the time of the adoption of a resolution may 329
vote on the resolution.330

        If student members are granted voting power under this 331
division, no student shall be disqualified from membership on the 332
board of trustees because the student receives a scholarship, 333
grant, loan, or any other financial assistance payable out of the 334
state treasury or a university fund, or because the student is 335
employed by the university in a position pursuant to a work-study 336
program or other student employment, including as a graduate 337
teaching assistant, graduate administrative assistant, or graduate 338
research assistant, the compensation for which is payable out of 339
the state treasury or a university fund.340

       Acceptance of such financial assistance or employment by a 341
student trustee shall not be considered a violation of Chapter 342
102. or section 2921.42 or 2921.43 of the Revised Code.343

       (C)(D) The government of Kent state university is vested in a 344
board of eleven trustees, who shall be appointed by the governor, 345
with the advice and consent of the senate. Two of the trustees 346
shall be students at Kent state university, and their selection 347
and terms shall be in accordance with division (D)(E) of this 348
section. A majority of the board constitutes a quorum. Except for 349
the terms of student members, terms of office shall be for nine 350
years, commencing on the seventeenth day of May and ending on the 351
sixteenth day of May. No person who has served a full nine-year 352
term or more than six years of such a term shall be eligible for 353
reappointment until a period of four years has elapsed since the 354
last day of the term for which the person previously served.355

       (D)(E) The student members of the board of trustees of Kent 356
state university shall be students at Kent state university. 357
Unless student members have been granted voting power under 358
division (F) of this section, they shall have no voting power on 359
the board. Student members, shall not be considered as members of 360
the board in determining whether a quorum is present. Student 361
members, and shall not be entitled to attend executive sessions of 362
the board. The student members of the board shall be appointed by 363
the governor, with the advice and consent of the senate, from a 364
group of five candidates selected pursuant to a procedure adopted 365
by the university's student governments and approved by the 366
university's board of trustees. The initial term of office of one 367
of the student members shall commence on May 17, 1988, and shall 368
expire on May 16, 1989, and the initial term of office of the 369
other student member shall commence on May 17, 1988, and expire on 370
May 16, 1990. Thereafter, terms of office of student members shall 371
be for two years, each term ending on the same day of the same 372
month of the year as the term it succeeds. In the event that a 373
student member cannot fulfill the student member's two-year term, 374
a replacement shall be selected to fill the unexpired term in the 375
same manner used to make the original selection.376

       (F) Not later than ninety days after the effective date of 377
this amendment, the board of trustees of Kent state university 378
shall adopt a resolution that does one of the following:379

       (1) Grants the student members of the board voting power on 380
the board. If so granted, in addition to having voting power, the 381
student members shall be considered as members of the board in 382
determining whether a quorum is present and shall be entitled to 383
attend executive sessions of the board.384

       (2) Declares that student members do not have voting power on 385
the board.386

trustees by adopting a subsequent resolution. Each resolution 388
adopted under this division shall take effect on the seventeenth 389
day of May following the adoption of the resolution. All members 390

division, no student shall be disqualified from membership on the 394
board of trustees because the student receives a scholarship, 395
grant, loan, or any other financial assistance payable out of the 396
state treasury or a university fund, or because the student is 397
employed by the university in a position pursuant to a work-study 398
program or other student employment, including as a graduate 399
teaching assistant, graduate administrative assistant, or graduate 400
research assistant, the compensation for which is payable out of 401
the state treasury or a university fund.402

       Acceptance of such financial assistance or employment by a 403
student trustee shall not be considered a violation of Chapter 404

       (E)(G) The trustees shall receive no compensation for their 406
services but shall be paid their reasonable necessary expenses 407
while engaged in the discharge of their official duties.408

       (F)(H) Each trustee shall hold office from the date of 409
appointment until the end of the term for which the trustee was 410
appointed. Any trustee appointed to fill a vacancy occurring prior 411
to the expiration of the term for which the trustee's predecessor 412
was appointed shall hold office for the remainder of such term. 413
Any trustee shall continue in office subsequent to the expiration 414
date of the trustee's term until a successor takes office, or 415
until a period of sixty days has elapsed, whichever occurs first.416

       Sec. 3343.02.  (A) The government of Central state university 417
shall be vested in a board of trustees to be known as "the board 418
of trustees of the Central state university." Such board shall 419
consist of eleven members who shall be appointed by the governor, 420
with the advice and consent of the senate. Two of the trustees 421
shall be students at Central state university, and their selection 422
and terms shall be in accordance with division (B) of this 423
section. A majority of the board constitutes a quorum. Except for 424
the student members, terms of office shall be for nine years, 425
commencing on the first day of July and ending on the thirtieth 426
day of June. Each member shall hold office from the date of 427
appointment until the end of the term for which the member was 428
appointed. Any member appointed to fill a vacancy occurring prior 429
to the expiration of the term for which the member's predecessor 430
was appointed shall hold office for the remainder of such term. 431
Any member shall continue in office subsequent to the expiration 432
date of the member's term until the member's successor takes 433
office, or until a period of sixty days has elapsed, whichever 434
occurs first. No person who has served a full nine-year term or 435
more than six years of such a term shall be eligible for 436
reappointment until a period of four years has elapsed since the 437
last day of the term for which the person previously served.438

       (B) The student members of the board of trustees of Central 439
state university shall be students at Central state university. 440
Unless student members have been granted voting power under 441
division (C) of this section, they shall have no voting power on 442
the board. Student members, shall not be considered as members of 443
the board in determining whether a quorum is present. Student 444
members, and shall not be entitled to attend executive sessions of 445
the board. The student members of the board shall be appointed by 446
the governor, with the advice and consent of the senate, from a 447
group of five candidates selected pursuant to a procedure adopted 448
by the university's student governments and approved by the 449
university's board of trustees. The initial term of office of one 450
of the student members shall commence on July 1, 1988, and shall 451
expire on June 30, 1989, and the initial term of office of the 452
other student member shall commence on July 1, 1988, and expire on 453
June 30, 1990. Thereafter, terms of office of student members 454
shall be for two years, each term ending on the same day of the 455
same month of the year as the term it succeeds. In the event that 456
a student member cannot fulfill a two-year term, a replacement 457
shall be selected to fill the unexpired term in the same manner 458
used to make the original selection.459

student trustee shall not be considered a violation of Chapter 487
102. or section 2921.42 or 2921.43 of the Revised Code.488

       Sec. 3343.06.  The board of trustees of the Central state 489
university shall elect, fix the compensation of, and have the 490
right to remove the president, who shall be the chief executive 491
officer of the university, and elect, fix the compensation of, and 492
remove such number of professors, teachers, and other employees as 493
is necessary. NoExcept as provided under division (C) of section 494
3343.02 of the Revised Code, no trustee, or his relative of a 495
trustee by blood or marriage, is eligible to a professorship or 496
position in the university, the compensation for which is payable 497
out of the state treasury or a university fund. No, and no498
officer, teacher, or other employee of the university is eligible 499
to membership on the board of trustees of such university while 500
occupying any of said positions.501

       Sec. 3344.01.  (A) There is hereby created the Cleveland 502
state university. The government of the Cleveland state university 503
is vested in a board of eleven trustees, who shall be appointed by 504
the governor, with the advice and consent of the senate. Two of 505
the trustees shall be students at the Cleveland state university, 506
and their selection and terms shall be in accordance with division 507
(B) of this section. Except for the student members, terms of 508
office shall be for nine years, commencing on the second day of 509
May and ending on the first day of May. Each trustee shall hold 510
office from the date of appointment until the end of the term for 511
which the trustee was appointed. Any trustee appointed to fill a 512
vacancy occurring prior to the expiration of the term for which 513
the trustee's predecessor was appointed shall hold office for the 514
remainder of such term. Any trustee shall continue in office 515
subsequent to the expiration date of the trustee's term until the 516
trustee's successor takes office, or until a period of sixty days 517
has elapsed, whichever occurs first. No person who has served a 518
full nine-year term or more than six years of such a term shall be 519
eligible for reappointment until a period of four years has 520
elapsed since the last day of the term for which the person 521
previously served. The trustees shall receive no compensation for 522
their services but shall be paid their reasonable necessary 523
expenses while engaged in the discharge of their official duties. 524
A majority of the board constitutes a quorum.525

       (B) The student members of the board of trustees of the 526
Cleveland state university shall be students at Cleveland state 527
university. Unless student members have been granted voting power 528
under division (C) of this section, they shall have no voting 529
power on the board. Student members, shall not be considered as 530
members of the board in determining whether a quorum is present. 531
Student members, and shall not be entitled to attend executive 532
sessions of the board. The student members of the board shall be 533
appointed by the governor, with the advice and consent of the 534
senate, from a group of five candidates selected pursuant to a 535
procedure adopted by the university's student governments and 536
approved by the university's board of trustees. The initial term 537
of office of one of the student members shall commence on May 2, 538
1988, and shall expire on May 1, 1989, and the initial term of 539
office of the other student member shall commence on May 2, 1988,540
and expire on May 1, 1990. Thereafter, terms of office of student 541
members shall be for two years, each term ending on the same day 542
of the same month of the year as the term it succeeds. In the 543
event that a student member cannot fulfill a two-year term, a 544
replacement shall be selected to fill the unexpired term in the 545
same manner used to make the original selection.546

       (C) Not later than ninety days after the effective date of 547
this amendment, the board of trustees shall adopt a resolution 548
that does one of the following:549

       (1) Grants the student members of the board voting power on 550
the board. If so granted, in addition to having voting power, the 551
student members shall be considered as members of the board in 552
determining whether a quorum is present and shall be entitled to 553
attend executive sessions of the board.554

       (2) Declares that student members do not have voting power on 555
the board.556

       Thereafter, the board may change the voting status of student 557
trustees by adopting a subsequent resolution. Each resolution 558
adopted under this division shall take effect on the second day of 559
May following the adoption of the resolution. All members with 560
voting power at the time of the adoption of a resolution may vote 561
on the resolution.562

       If student members are granted voting power under this 563
division, no student shall be disqualified from membership on the 564
board of trustees because the student receives a scholarship, 565
grant, loan, or any other financial assistance payable out of the 566
state treasury or a university fund, or because the student is 567
employed by the university in a position pursuant to a work-study 568
program or other student employment, including as a graduate 569
teaching assistant, graduate administrative assistant, or graduate 570
research assistant, the compensation for which is payable out of 571
the state treasury or a university fund.572

       Acceptance of such financial assistance or employment by a 573
student trustee shall not be considered a violation of Chapter 574
102. or section 2921.42 or 2921.43 of the Revised Code.575

       Sec. 3350.10. (A) There is hereby created the northeast Ohio 576
medical university. The principal goal of the medical university 577
shall be to collaborate with the university of Akron, Cleveland 578
state university, Kent state university, and Youngstown state 579
university to graduate physicians oriented to the practice of 580
medicine at the community level, especially family physicians. To 581
accomplish this goal, the medical university may incorporate in 582
the clinical experience provided its students the several 583
community hospitals in the cities and areas served by the medical 584
university; utilize practicing physicians as teachers; and to the 585
fullest extent possible utilize the basic science capabilities of 586
the university of Akron, Cleveland state university, Kent state 587
university, and Youngstown state university.588

       (1) Until December 22, 2008, the government of the northeast 589
Ohio medical university is vested in a nine-member board of 590
trustees consisting of the presidents of the university of Akron, 591
Kent state university, and Youngstown state university; one member 592
each of the boards of trustees of the university of Akron, Kent 593
state university, and Youngstown state university, to be appointed 594
by their respective boards of trustees for a term of six years 595
ending on the first day of May or until the trustee's term on the 596
respective university board of trustees expires, whichever occurs 597
first; and one person each to be appointed by the boards of 598
trustees of the university of Akron, Kent state university, and 599
Youngstown state university, for a term of nine years ending on 600
the first day of May; except that the term of those first 601
appointed by the several boards of trustees shall expire on the 602
first day of May next following their appointment. Vacancies shall 603
be filled for the unexpired term in the manner provided for 604
original appointment. The trustees shall receive no compensation 605
for their services but shall be paid their reasonable necessary 606
expenses while engaged in the discharge of their official duties. 607
A majority of the board constitutes a quorum.608

       (2) Beginning December 22, 2008, the government of the 609
northeast Ohio medical university is vested in a board of eleven 610
trustees, who shall be appointed by the governor, with the advice 611
and consent of the senate. Two of the trustees shall be current 612
students of the medical university, and their selection and terms 613
shall be in accordance with division (B) of this section. Except 614
as provided in division (A)(3) of this section and except for the 615
student members, terms of office shall be for nine years. Each 616
trustee shall hold office from the date of appointment until the 617
end of the term for which the trustee was appointed. Any trustee 618
appointed to fill a vacancy occurring prior to the expiration of 619
the term for which the trustee's predecessor was appointed shall 620
hold office for the remainder of such term. Any trustee shall 621
continue in office subsequent to the expiration date of the 622
trustee's term until the trustee's successor takes office, or 623
until a period of sixty days has elapsed, whichever occurs first. 624
No person who has served a full nine-year term or more than six 625
years of such a term shall be eligible for reappointment until a 626
period of four years has elapsed since the last day of the term 627
for which the person previously served. The trustees shall receive 628
no compensation for their services but shall be paid their 629
reasonable necessary expenses while engaged in the discharge of 630
their official duties. A majority of the board constitutes a 631
quorum.632

        (3) Not later than December 22, 2008, the governor, with the 633
advice and consent of the senate, shall appoint the two student 634
trustees and successors for the trustees serving under division 635
(A)(1) of this section. Except for the student trustees, who shall 636
serve terms pursuant to division (B) of this section, the initial 637
terms of office for trustees appointed under division (A)(2) of 638
this section shall be as follows: one term ending September 23, 639
2009; one term ending September 23, 2010; one term ending 640
September 23, 2011; one term ending September 23, 2012; one term 641
ending September 23, 2013; one term ending September 23, 2014; one 642
term ending September 23, 2015; one term ending September 23, 643
2016; one term ending September 23, 2017. Thereafter, terms of 644
office shall be for nine years, as provided in division (A)(2) of 645
this section.646

        (B) The student members of the board of trustees of the 647
northeast Ohio medical university shall be students of the 648
northeast Ohio medical university. Unless student members have 649
been granted voting power under division (C) of this section, they 650
shall have no voting power on the board. Student members, shall 651
not be considered as members of the board in determining whether a 652
quorum is present. Student members, and shall not be entitled to 653
attend executive sessions of the board. The student members of the 654
board shall be appointed by the governor, with the advice and 655
consent of the senate, from a group of five candidates selected 656
pursuant to a procedure adopted by the university's student 657
governments and approved by the university's board of trustees. 658
The initial term of office of one of the student members shall 659
commence December 22, 2008, and shall expire on June 30, 2009, and 660
the initial term of office of the other student member shall 661
commence December 22, 2008, and shall expire on June 30, 2010. 662
Thereafter, terms of office of student members shall be for two 663
years, each term ending on the same day of the same month of the 664
year as the term it succeeds. In the event that a student member 665
cannot fulfill a two-year term, a replacement shall be selected to 666
fill the unexpired term in the same manner used to make the 667
original selection.668

       (C) Not later than ninety days after the effective date of 669
this amendment, the board of trustees shall adopt a resolution 670
that does one of the following:671

with division (B) of this section. Except for the terms of student 704
members, terms of office shall be for nine years, commencing on 705
the first day of July and ending on the thirtieth day of June. 706
Each trustee shall hold office from the date of appointment until 707
the end of the term for which the trustee was appointed. Any 708
trustee appointed to fill a vacancy occurring prior to the 709
expiration of the term for which the trustee's predecessor was 710
appointed shall hold office for the remainder of such term. Any 711
trustee shall continue in office subsequent to the expiration date 712
of the trustee's term until the trustee's successor takes office, 713
or until a period of sixty days has elapsed, whichever occurs 714
first. No person who has served a full nine-year term or more than 715
six years of such a term shall be eligible for reappointment until 716
a period of four years has elapsed since the last day of the term 717
for which the person previously served. The trustees shall receive 718
no compensation for their services but shall be paid their 719

university's board of trustees. The initial term of office of one 734
of the student members shall commence on July 1, 1988, and shall 735
expire on June 30, 1989, and the initial term of office of the 736
other student member shall commence on July 1, 1988, and shall 737
expire on June 30, 1990. Thereafter, terms of office of student 738
members shall be for two years, each term ending on the same day 739
of the same month of the year as the term it succeeds. In the 740
event that a student member cannot fulfill a two-year term, a 741
replacement shall be selected to fill the unexpired term in the 742
same manner used to make the original selection.743

of this section. Except for the terms of student members, terms of 779
office shall be for nine years, commencing on the second day of 780
May and ending on the first day of May. Each trustee shall hold 781
office from the date of appointment until the end of the term for 782
which the trustee was appointed. Any trustee appointed to fill a 783
vacancy occurring prior to the expiration of the term for which 784
the trustee's predecessor was appointed shall hold office for the 785
remainder of such term. Any trustee shall continue in office 786
subsequent to the expiration date of the trustee's term until the 787
trustee's successor takes office, or until a period of sixty days 788
has elapsed, whichever occurs first. No person who has served a 789
full nine-year term or more than six years of such a term shall be 790
eligible to reappointment until a period of four years has elapsed 791

of office of one of the student members shall commence on May 2, 809
1988, and shall expire on May 1, 1989, and the initial term of 810
office of the other student member shall commence on May 2, 1988,811
and expire on May 1, 1990. Thereafter, terms of office of student 812
members shall be for two years, each term ending on the same day 813
of the same month of the year as the term it succeeds. In the 814
event that a student member cannot fulfill a two-year term, a 815
replacement shall be selected to fill the unexpired term in the 816
same manner used to make the original selection.817

appointed. Any trustee appointed to fill a vacancy occurring prior 858
to the expiration of the term for which the trustee's predecessor 859

Any trustee shall continue in office subsequent to the expiration 861
date of the trustee's term until the trustee's successor takes 862

       Sec. 3361.01.  (A) There is hereby created a state university 922
to be known as the "university of Cincinnati." The government of 923
the university of Cincinnati is vested in a board of eleven 924
trustees who shall be appointed by the governor, with the advice 925
and consent of the senate. Two of the trustees shall be students 926
at the university of Cincinnati, and their selection and terms 927
shall be in accordance with division (B) of this section. The 928
terms of the first nine members of the board of trustees shall 929
commence upon the effective date of the transfer of assets of the 930
state-affiliated university of Cincinnati to the university of 931
Cincinnati hereby created. One of such trustees shall be appointed 932
for a term ending on the first day of January occurring at least 933
twelve months after such date of transfer, and each of the other 934
trustees shall be appointed for respective terms ending on each 935
succeeding first day of January, so that one term will expire on 936
each first day of January after expiration of the shortest term. 937
Except for the two student trustees, each successor trustee shall 938
be appointed for a term ending on the first day of January, nine 939
years from the expiration date of the term the trustee succeeds, 940
except that any person appointed to fill a vacancy shall be 941
appointed to serve only for the unexpired term.942

       Any trustee shall continue in office subsequent to the 943
expiration date of the trustee's term until the trustee's 944
successor takes office, or until a period of sixty days has 945
elapsed, whichever occurs first.946

       No person who has served a full nine-year term or longer or 947
more than six years of such a term shall be eligible to 948
reappointment until a period of four years has elapsed since the 949

sessions of the board. The student members of the board shall be 962
appointed by the governor, with the advice and consent of the 963
senate, from a group of five candidates selected pursuant to a 964
procedure adopted by the university's student governments and 965
approved by the university's board of trustees. The initial term 966
of office of one of the student members shall commence on May 14, 967
1988, and shall expire on May 13, 1989, and the initial term of 968
office of the other student member shall commence on May 14, 1988,969
and expire on May 13, 1990. Thereafter, terms of office of student 970
members shall be for two years, each term ending on the same day 971
of the same month of the year as the term it succeeds. In the 972
event that a student cannot fulfill a two-year term, a replacement 973
shall be selected to fill the unexpired term in the same manner 974
used to make the original selection.975

       (C) Not later than ninety days after the effective date of 976
this amendment, the board of trustees shall adopt a resolution 977
that does one of the following:978

       (1) Grants the student members of the board voting power on 979
the board. If so granted, in addition to having voting power, the 980

board of trustees because the student receives a scholarship, 994
grant, loan, or any other financial assistance payable out of the 995
state treasury or a university fund, or because the student is 996
employed by the university in a position pursuant to a work-study 997
program or other student employment, including as a graduate 998
teaching assistant, graduate administrative assistant, or graduate 999
research assistant, the compensation for which is payable out of 1000
the state treasury or a university fund.1001

       Acceptance of such financial assistance or employment by a 1002
student trustee shall not be considered a violation of Chapter 1003
102. or section 2921.42 or 2921.43 of the Revised Code.1004

       Sec. 3362.01.  (A) There is hereby created a state university 1005
to be known as "Shawnee state university." The government of 1006
Shawnee state university is vested in a board of eleven trustees 1007
who shall be appointed by the governor, with the advice and 1008
consent of the senate. Two of the trustees shall be students at 1009
Shawnee state university, and their selection and terms shall be 1010
in accordance with division (B) of this section. The remaining 1011
trustees shall be appointed as follows: one for a term of one 1012
year, one for a term of two years, one for a term of three years, 1013
one for a term of four years, one for a term of five years, one 1014
for a term of six years, one for a term of seven years, one for a 1015
term of eight years, and one for a term of nine years. Thereafter1016
Except for the student members, terms of office shall be for nine 1017
years. All terms of office shall commence on the first day of July 1018
and end on the thirtieth day of June. 1019

       Each trustee shall hold office from the date of appointment 1020
until the end of the term for which the trustee was appointed. Any 1021
trustee appointed to fill a vacancy occurring prior to the 1022
expiration of the term for which the trustee's predecessor was 1023
appointed shall hold office for the remainder of such term. Any 1024
trustee shall continue in office subsequent to the expiration date 1025
of the trustee's term until the trustee's successor takes office, 1026
or until a period of sixty days has elapsed, whichever occurs 1027
first. No person who has served a full nine-year term or more than 1028
six years of such a term shall be eligible for reappointment until 1029
a period of four years has elapsed since the last day of the term 1030
for which the person previously served.1031

       The trustees shall receive no compensation for their services 1032
but shall be paid their reasonable and necessary expenses while 1033
engaged in the discharge of their official duties.1034

       A majority of the board constitutes a quorum.1035

       (B) The student members of the board of trustees of Shawnee 1036
state university shall be students at Shawnee state university. 1037
Unless student members have been granted voting power under 1038
division (C) of this section, they shall have no voting power on 1039
the board. Student members, shall not be considered as members of 1040
the board in determining whether a quorum is present. Student 1041
members, and shall not be entitled to attend executive sessions of 1042
the board. The student members of the board shall be appointed by 1043
the governor, with the advice and consent of the senate, from a 1044
group of five candidates selected pursuant to a procedure adopted 1045
by the university's student governments and approved by the 1046
university's board of trustees. The initial term of office of one 1047
of the student members shall commence on July 1, 1988, and shall 1048
expire on June 30, 1989, and the initial term of office of the 1049
other student member shall commence on July 1, 1988, and expire on 1050
June 30, 1990. Thereafter, terms of office of student members 1051
shall be for two years, each term ending on the same day of the 1052
same month of the year as the term it succeeds. In the event a 1053
student member cannot fulfill a two-year term, a replacement shall 1054
be selected to fill the unexpired term in the same manner used to 1055
make the original selection.1056

       (C) Not later than ninety days after the effective date of 1057
this amendment, the board of trustees shall adopt a resolution 1058
that does one of the following:1059

       (1) Grants the student members of the board voting power on 1060
the board. If so granted, in addition to having voting power, the 1061
student members shall be considered as members of the board in 1062
determining whether a quorum is present and shall be entitled to 1063
attend executive sessions of the board.1064

       (2) Declares that student members do not have voting power on 1065
the board.1066

       Thereafter, the board may change the voting status of student 1067
trustees by adopting a subsequent resolution. Each resolution 1068
adopted under this division shall take effect on the first day of 1069
July following the adoption of the resolution. All members with 1070
voting power at the time of the adoption of a resolution may vote 1071
on the resolution.1072

       If student members are granted voting power under this 1073
division, no student shall be disqualified from membership on the 1074
board of trustees because the student receives a scholarship, 1075
grant, loan, or any other financial assistance payable out of the 1076
state treasury or a university fund, or because the student is 1077
employed by the university in a position pursuant to a work-study 1078
program or other student employment, including as a graduate 1079
teaching assistant, graduate administrative assistant, or graduate 1080
research assistant, the compensation for which is payable out of 1081
the state treasury or a university fund.1082

       Acceptance of such financial assistance or employment by a 1083
student trustee shall not be considered a violation of Chapter 1084
102. or section 2921.42 or 2921.43 of the Revised Code.1085

       Sec. 3364.01. (A) The university of Toledo, as authorized 1086
under former Chapter 3360. of the Revised Code, and the medical 1087
university of Ohio at Toledo, as authorized under former sections 1088
3350.01 to 3350.05 of the Revised Code, shall be combined as one 1089
state university to be known as the "university of Toledo."1090

       (B)(1) The government of the combined university of Toledo is 1091
vested in a board of trustees which, except as prescribed in 1092
division (B)(2) of this section, shall be appointed by the 1093
governor with the advice and consent of the senate. The initial 1094
board of trustees of the combined university shall be as 1095
prescribed in division (B)(2) of this section. After the 1096
abolishment of offices as prescribed in division (B)(2)(a) of this 1097
section, the board of trustees of the combined university shall 1098
consist of nine voting members, who shall serve for terms of nine 1099
years, and two nonvoting members, who shall be students of the 1100
combined university and who shall serve for terms of two years. 1101
Terms of office of trustees shall begin on the second day of July 1102
and end on the first day of July.1103

       (2) The initial board of trustees of the combined university 1104
shall consist of seventeen voting members who are the eight 1105
members who made up the board of trustees of the medical 1106
university of Ohio at Toledo prior to May 1, 2006, under former 1107
section 3350.01 of the Revised Code, and whose terms would expire 1108
under that section after May 1, 2006; the eight voting members who 1109
made up the board of trustees of the university of Toledo, under 1110
former section 3360.01 of the Revised Code, and whose terms would 1111
expire under that section after July 1, 2006; and one additional 1112
member appointed by the governor with the advice and consent of 1113
the senate. The terms of office, abolishment of office, and 1114
succession of the voting members of the initial board shall be as 1115
prescribed in division (B)(2)(a) of this section. The initial 1116
board also shall consist of two nonvoting members who are students 1117
of the combined university, as prescribed in division (B)(2)(b) of 1118
this section.1119

       (a) The term of office of the voting member of the initial 1120
board of trustees of the combined university who was not formerly 1121
a member of either the board of trustees of the medical university 1122
of Ohio at Toledo or the board of trustees of the university of 1123
Toledo shall be for nine years, beginning on July 2, 2006, and 1124
ending on July 1, 2015.1125

       The terms of office of the sixteen other voting members of 1126
the initial board of trustees shall expire on July 1 of the year 1127
they otherwise would expire under former section 3350.01 or 1128
3360.01 of the Revised Code.1129

       The office of one voting member whose term expires on July 1, 1130
2007, shall be abolished on that date. The governor, with the 1131
advice and consent of the senate, shall appoint a successor to the 1132
office of the other voting member whose term expires on that date 1133
to a nine-year term beginning on July 2, 2007.1134

       The office of one voting member whose term expires on July 1, 1135
2008, shall be abolished on that date. The governor, with the 1136
advice and consent of the senate, shall appoint a successor to the 1137
office of the other voting member whose term expires on that date 1138
to a nine-year term beginning on July 2, 2008.1139

       The office of one voting member whose term expires on July 1, 1140
2009, shall be abolished on that date. The governor, with the 1141
advice and consent of the senate, shall appoint a successor to the 1142
office of the other voting member whose term expires on that date 1143
to a nine-year term beginning on July 2, 2009.1144

       The office of one voting member whose term expires on July 1, 1145
2010, shall be abolished on that date. The governor, with the 1146
advice and consent of the senate, shall appoint a successor to the 1147
office of the other voting member whose term expires on that date 1148
to a nine-year term beginning on July 2, 2010.1149

       The office of one voting member whose term expires on July 1, 1150
2011, shall be abolished on that date. The governor, with the 1151
advice and consent of the senate, shall appoint a successor to the 1152
office of the other voting member whose term expires on that date 1153
to a nine-year term beginning on July 2, 2011.1154

       The office of one voting member whose term expires on July 1, 1155
2012, shall be abolished on that date. The governor, with the 1156
advice and consent of the senate, shall appoint a successor to the 1157
office of the other voting member whose term expires on that date 1158
to a nine-year term beginning on July 2, 2012.1159

       The office of one voting member whose term expires on July 1, 1160
2013, shall be abolished on that date. The governor, with the 1161
advice and consent of the senate, shall appoint a successor to the 1162
office of the other voting member whose term expires on that date 1163
to a nine-year term beginning on July 2, 2013.1164

       The office of one voting member whose term expires on July 1, 1165
2014, shall be abolished on that date. The governor, with the 1166
advice and consent of the senate, shall appoint a successor to the 1167
office of the other voting member whose term expires on that date 1168
to a nine-year term beginning on July 2, 2014.1169

       The governor, with the advice and consent of the senate, 1170
shall appoint a successor to the office of the voting member whose 1171
term expires on July 1, 2015, to a nine-year term beginning on 1172
July 2, 2015.1173

       Thereafter the terms of office of all subsequent voting1174
members of the board of trustees, other than the student members,1175
shall be for nine years beginning on the second day of July and 1176
ending on the first day of July.1177

       (b) One of the student members of the initial board of 1178
trustees shall be the student member of the former university of 1179
Toledo board of trustees, appointed under former section 3360.01 1180
of the Revised Code, whose term would expire under that section on 1181
July 1, 2007. The term of that student member shall expire on July 1182
1, 2007. The other student member shall be a new appointee, 1183
representing the portion of the combined university that made up 1184
the former medical university of Ohio at Toledo, appointed to a 1185
two-year term beginning on July 2, 2006, and ending on July 1, 1186
2008. That student trustee shall be appointed by the governor, 1187
with the advice and consent of the senate, from a group of three 1188
candidates selected pursuant to a procedure adopted by the 1189
university's student governments and approved by the university's 1190
board of trustees. Thereafter appointment and terms of office of 1191
student members of the board of trustees shall be as prescribed by 1192
division (B)(3) of this section.1193

       (3) The student members of the board of trustees of the 1194
combined university shall be appointed by the governor, with the 1195
advice and consent of the senate, from a group of six candidates 1196
selected pursuant to a procedure adopted by the university's 1197
student governments and approved by the university's board of 1198
trustees. Terms of office of student members shall be for two 1199
years, each term ending on the same day of the same month of the 1200
year as the term it succeeds. In the event that a student member 1201
cannot fulfill a two-year term, a replacement shall be selected to 1202
fill the unexpired term in the same manner used to make the 1203
original selection. Unless the student members of the board have 1204
been granted voting power under division (D) of this section, they 1205
shall have no voting power, shall not be considered members of the 1206
board in determining whether a quorum is present, and shall not be 1207
entitled to attend executive sessions of the board.1208

       (4) Each trustee shall hold office from the date of 1209
appointment until the end of the term for which the trustee was 1210
appointed. Any trustee appointed to fill a vacancy occurring prior 1211
to the expiration of the term for which the trustee's predecessor 1212
was appointed shall hold office for the remainder of such term. 1213
Any trustee shall continue in office subsequent to the expiration 1214
date of the trustee's term until the trustee's successor takes 1215
office, or until a period of sixty days has elapsed, whichever 1216
occurs first.1217

       (5) No person who has served as a voting member of the board 1218
of trustees for a full nine-year term or more than six years of 1219
such a term and no person who is a voting member of the initial 1220
board of trustees as prescribed in division (B)(2)(a) of this 1221
section is eligible for reappointment to the board until a period 1222
of four years has elapsed since the last day of the term for which 1223
the person previously served.1224

       No person who served as a voting member of the board of 1225
trustees of the former university of Toledo, as authorized under 1226
former Chapter 3360. of the Revised Code, for a full nine-year 1227
term or more than six years of such a term, and no person who 1228
served on the board of trustees of the former medical university 1229
of Ohio at Toledo, as authorized under former sections 3350.01 to 1230
3350.05 of the Revised Code, for a full nine-year term or more 1231
than six years of such a term is eligible for appointment to the 1232
board of trustees of the combined university until a period of 1233
four years has elapsed since the last day of the term for which 1234
the person previously served.1235

       (C) The trustees shall receive no compensation for their 1236

       Section 2.  That existing sections 3335.02, 3335.09, 3337.01, 1273
3339.01, 3341.02, 3343.02, 3343.06, 3344.01, 3350.10, 3352.01, 1274
3356.01, 3359.01, 3361.01, 3362.01, and 3364.01 of the Revised 1275
Code are hereby repealed.1276
