| To enact section 121.92 of the Revised Code to create | 1 |
| the Cybersecurity, Education, and Economic | 2 |
| Development Council. | 3 |
| Section 1. That section 121.92 of the Revised Code is hereby | 4 |
| enacted to read as follows: | 5 |
| Sec. 121.92. (A) There is hereby created the cybersecurity, | 6 |
| education, and economic development council. | 7 |
| (B) The council shall consist of the following members: | 8 |
| (1) The following members appointed by the governor: | 9 |
| (a) A representative from the department of administrative | 10 |
| services; | 11 |
| (b) A representative from the department of public safety | 12 |
| division of homeland security; | 13 |
| (c) A representative of the department of development; | 14 |
| (d) Two representatives from institutions of higher | 15 |
| education, as defined in section 2741.01 of the Revised Code, that | 16 |
| have cybersecurity-related programs; | 17 |
| (e) A representative from a community college as defined in | 18 |
| section 3354.01 of the Revised Code, state community college as | 19 |
| defined in section 3358.01 of the Revised Code, or technical | 20 |
| college as defined in section 3357.01 of the Revised Code, that | 21 |
| has a cybersecurity-related program; | 22 |
| (f) An adjutant general liaison who is experienced in the | 23 |
| cybersecurity field; | 24 |
| (g) A representative from a nonprofit corporation organized | 25 |
| under Chapter 1702. of the Revised Code who has a cybersecurity | 26 |
| background. | 27 |
| (2) Four representatives of organizations or businesses who | 28 |
| have a cybersecurity background, two of whom shall be appointed by | 29 |
| the speaker of the house of representatives and two of whom shall | 30 |
| be appointed by the president of the senate. | 31 |
| (C) The terms of office for all members of the council shall | 32 |
| be two years, with each term ending on the same day of the same | 33 |
| month as the term it succeeds. Each member shall hold office from | 34 |
| the date of appointment until the end of the term for which the | 35 |
| member was appointed. Members may be reappointed. | 36 |
| Vacancies shall be filled in the same manner as original | 37 |
| appointments. Any member appointed to fill a vacancy occurring | 38 |
| prior to the expiration of the term for which the member's | 39 |
| predecessor was appointed shall hold office for the remainder of | 40 |
| that term. A member shall continue in office subsequent to the | 41 |
| expiration date of the member's term until the member's successor | 42 |
| takes office or until a period of sixty days has elapsed, | 43 |
| whichever occurs first. | 44 |
| (D) The council shall elect a chairperson who shall be a | 45 |
| non-voting member of the council. The council shall meet at least | 46 |
| quarterly at the call of the chair. A majority of the voting | 47 |
| members of the council constitutes a quorum. | 48 |
| The council is a public body for purposes of section 121.22 | 49 |
| of the Revised Code. In addition to the exceptions specified in | 50 |
| division (G) of section 121.22 of the Revised Code, and in | 51 |
| accordance with the procedures specified in that division, the | 52 |
| council may hold an executive session for the sole purpose of | 53 |
| considering details relative to the security arrangements and | 54 |
| emergency response protocols for any state or local government | 55 |
| entity, including state institutions of higher education, | 56 |
| considered in the course of the council's duties. | 57 |
| (E) Members shall serve without compensation, except to the | 58 |
| extent that serving on the council is considered part of their | 59 |
| regular employment duties. | 60 |
| (F) As requested by the council, the office of information | 61 |
| security and privacy management within the department of | 62 |
| administrative services shall provide staff and other | 63 |
| administrative support for the council as necessary to carry out | 64 |
| the council's duties. | 65 |
| (G) The council shall conduct a study and make | 66 |
| recommendations regarding both of the following: | 67 |
| (1) Improving the infrastructure of the state's cybersecurity | 68 |
| operations with existing resources and through partnerships | 69 |
| between government, business, and institutions of higher | 70 |
| education; | 71 |
| (2) Specific actions that would accelerate growth of the | 72 |
| cybersecurity industry in the state. | 73 |
| (H) No later than December 31, 2012, the council shall submit | 74 |
| a report of the council's findings to the governor, lieutenant | 75 |
| governor, speaker of the house of representatives, president of | 76 |
| the senate, and the chairpersons of the committees of the house of | 77 |
| representatives and the senate that predominantly deal with | 78 |
| economic development, education, and public safety. | 79 |
