A BILL
To amend sections 1901.01, 1901.02, 1901.021, 1
1901.08, and 1901.311 of the Revised Code to 2
abolish the Fostoria Municipal Court and the 3
Tiffin Municipal Court, to create the 4
Tiffin-Fostoria Municipal Court, and to declare an 5
emergency.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 1901.01, 1901.02, 1901.021, 1901.08, 7
and 1901.311 of the Revised Code be amended to read as follows:8

       Sec. 1901.01.  (A) There is hereby established a municipal 9
court in each of the following municipal corporations:10

       Akron, Alliance, Ashland, Ashtabula, Athens, Avon Lake, 11
Barberton, Bedford, Bellefontaine, Bellevue, Berea, Bowling Green, 12
Bryan, Bucyrus, Cambridge, Campbell, Canton, Carrollton, Celina, 13
Chardon, Chesapeake, Chillicothe, Cincinnati, Circleville, 14
Cleveland, Cleveland Heights, Columbus, Conneaut, Coshocton, 15
Cuyahoga Falls, Dayton, Defiance, Delaware, East Cleveland, East 16
Liverpool, Eaton, Elyria, Euclid, Fairborn, Fairfield, Findlay, 17
Fostoria, Franklin, Fremont, Gallipolis, Garfield Heights, 18
Georgetown, Girard, Greenville, Hamilton, Hillsboro, Huron, 19
Ironton, Jackson, Kenton, Kettering, Lakewood, Lancaster, Lebanon, 20
Lima, Logan, London, Lorain, Lyndhurst, Mansfield, Marietta, 21
Marion, Marysville, Mason, Massillon, Maumee, Medina, Mentor, 22
Miamisburg, Middletown, Millersburg, Mount Gilead, Mount Vernon, 23
Napoleon, Newark, New Philadelphia, Newton Falls, Niles, Norwalk, 24
Oakwood, Oberlin, Oregon, Ottawa, Painesville, Parma, Perrysburg, 25
Port Clinton, Portsmouth, Ravenna, Rocky River, Sandusky, Shaker 26
Heights, Shelby, Sidney, South Euclid, Springfield, Steubenville, 27
Struthers, Sylvania, Tiffin, Toledo, Troy, Upper Sandusky, Urbana, 28
Vandalia, Van Wert, Vermilion, Wadsworth, Wapakoneta, Warren, City 29
of Washington in Fayette county, to be known as Washington Court 30
House, Willoughby, Wilmington, Wooster, Xenia, Youngstown, and 31
Zanesville.32

       (B) There is hereby established a municipal court within 33
Clermont county in Batavia or in any other municipal corporation 34
or unincorporated territory within Clermont county that is 35
selected by the legislative authority of the Clermont county 36
municipal court. The municipal court established by this division 37
is a continuation of the municipal court previously established in 38
Batavia by this section before the enactment of this division.39

       (C) There is hereby established a municipal court within 40
Columbiana county in Lisbon or in any other municipal corporation 41
or unincorporated territory within Columbiana county, except the 42
municipal corporation of East Liverpool or Liverpool or St. Clair 43
township, that is selected by the judges of the municipal court 44
pursuant to division (I) of section 1901.021 of the Revised Code.45

       (D) Effective January 1, 2008, there is hereby established a 46
municipal court within Erie county in Milan or in any other 47
municipal corporation or unincorporated territory within Erie 48
county that is within the territorial jurisdiction of the Erie 49
county municipal court and is selected by the legislative 50
authority of that court.51

       (E) The Cuyahoga Falls municipal court shall remain in 52
existence until December 31, 2008, and shall be replaced by the 53
Stow municipal court on January 1, 2009.54

       (F) Effective January 1, 2009, there is hereby established a 55
municipal court in the municipal corporation of Stow.56

       (G) Effective July 1, 2010, there is hereby established a 57
municipal court within Montgomery county in any municipal 58
corporation or unincorporated territory within Montgomery county, 59
except the municipal corporations of Centerville, Clayton, Dayton, 60
Englewood, Germantown, Kettering, Miamisburg, Moraine, Oakwood, 61
Union, Vandalia, and West Carrollton and Butler, German, Harrison, 62
Miami, and Washington townships, that is selected by the 63
legislative authority of that court.64

       (H) Effective January 1, 2013, there is hereby established a 65
municipal court within Sandusky county in any municipal 66
corporation or unincorporated territory within Sandusky county, 67
except the municipal corporations of Bellevue and Fremont and 68
Ballville, Sandusky, and York townships, that is selected by the 69
legislative authority of that court.70

       Sec. 1901.02.  (A) The municipal courts established by 71
section 1901.01 of the Revised Code have jurisdiction within the 72
corporate limits of their respective municipal corporations, or, 73
for the Clermont county municipal court, the Columbiana county 74
municipal court, and, effective January 1, 2008, the Erie county 75
municipal court, within the municipal corporation or 76
unincorporated territory in which they are established, and are 77
courts of record. Each of the courts shall be styled 78
".................................. municipal court," inserting 79
the name of the municipal corporation, except the following 80
courts, which shall be styled as set forth below:81

       (1) The municipal court established in Chesapeake that shall 82
be styled and known as the "Lawrence county municipal court";83

       (2) The municipal court established in Cincinnati that shall 84
be styled and known as the "Hamilton county municipal court";85

       (3) The municipal court established in Ravenna that shall be 86
styled and known as the "Portage county municipal court";87

       (4) The municipal court established in Athens that shall be 88
styled and known as the "Athens county municipal court";89

       (5) The municipal court established in Columbus that shall be 90
styled and known as the "Franklin county municipal court";91

       (6) The municipal court established in London that shall be 92
styled and known as the "Madison county municipal court";93

       (7) The municipal court established in Newark that shall be 94
styled and known as the "Licking county municipal court";95

       (8) The municipal court established in Wooster that shall be 96
styled and known as the "Wayne county municipal court";97

       (9) The municipal court established in Wapakoneta that shall 98
be styled and known as the "Auglaize county municipal court";99

       (10) The municipal court established in Troy that shall be 100
styled and known as the "Miami county municipal court";101

       (11) The municipal court established in Bucyrus that shall be 102
styled and known as the "Crawford county municipal court";103

       (12) The municipal court established in Logan that shall be 104
styled and known as the "Hocking county municipal court";105

       (13) The municipal court established in Urbana that shall be 106
styled and known as the "Champaign county municipal court";107

       (14) The municipal court established in Jackson that shall be 108
styled and known as the "Jackson county municipal court";109

       (15) The municipal court established in Springfield that 110
shall be styled and known as the "Clark county municipal court";111

       (16) The municipal court established in Kenton that shall be 112
styled and known as the "Hardin county municipal court";113

       (17) The municipal court established within Clermont county 114
in Batavia or in any other municipal corporation or unincorporated 115
territory within Clermont county that is selected by the 116
legislative authority of that court that shall be styled and known 117
as the "Clermont county municipal court";118

       (18) The municipal court established in Wilmington that, 119
beginning July 1, 1992, shall be styled and known as the "Clinton 120
county municipal court";121

       (19) The municipal court established in Port Clinton that 122
shall be styled and known as "the "Ottawa county municipal court";123

       (20) The municipal court established in Lancaster that, 124
beginning January 2, 2000, shall be styled and known as the 125
"Fairfield county municipal court";126

       (21) The municipal court established within Columbiana county 127
in Lisbon or in any other municipal corporation or unincorporated 128
territory selected pursuant to division (I) of section 1901.021 of 129
the Revised Code, that shall be styled and known as the 130
"Columbiana county municipal court";131

       (22) The municipal court established in Georgetown that, 132
beginning February 9, 2003, shall be styled and known as the 133
"Brown county municipal court";134

       (23) The municipal court established in Mount Gilead that, 135
beginning January 1, 2003, shall be styled and known as the 136
"Morrow county municipal court";137

       (24) The municipal court established in Greenville that, 138
beginning January 1, 2005, shall be styled and known as the "Darke 139
county municipal court";140

       (25) The municipal court established in Millersburg that, 141
beginning January 1, 2007, shall be styled and known as the 142
"Holmes county municipal court";143

       (26) The municipal court established in Carrollton that, 144
beginning January 1, 2007, shall be styled and known as the 145
"Carroll county municipal court";146

       (27) The municipal court established within Erie county in 147
Milan or established in any other municipal corporation or 148
unincorporated territory that is within Erie county, is within the 149
territorial jurisdiction of that court, and is selected by the 150
legislative authority of that court that, beginning January 1, 151
2008, shall be styled and known as the "Erie county municipal 152
court";153

       (28) The municipal court established in Ottawa that, 154
beginning January 1, 2011, shall be styled and known as the 155
"Putnam county municipal court";156

       (29) The municipal court established within Montgomery county 157
in any municipal corporation or unincorporated territory within 158
Montgomery county, except the municipal corporations of 159
Centerville, Clayton, Dayton, Englewood, Germantown, Kettering, 160
Miamisburg, Moraine, Oakwood, Union, Vandalia, and West Carrollton 161
and Butler, German, Harrison, Miami, and Washington townships, 162
that is selected by the legislative authority of that court and 163
that, beginning July 1, 2010, shall be styled and known as the 164
"Montgomery county municipal court";165

       (30) The municipal court established within Sandusky county 166
in any municipal corporation or unincorporated territory within 167
Sandusky county, except the municipal corporations of Bellevue and 168
Fremont and Ballville, Sandusky, and York townships, that is 169
selected by the legislative authority of that court and that, 170
beginning January 1, 2013, shall be styled and known as the 171
"Sandusky county municipal court.";172

       (31) The municipal court established in Tiffin that, 173
beginning January 1, 2014, shall be styled and known as the 174
"Tiffin-Fostoria municipal court."175

       (B) In addition to the jurisdiction set forth in division (A) 176
of this section, the municipal courts established by section 177
1901.01 of the Revised Code have jurisdiction as follows:178

       The Akron municipal court has jurisdiction within Bath, 179
Richfield, and Springfield townships, and within the municipal 180
corporations of Fairlawn, Lakemore, and Mogadore, in Summit 181
county.182

       The Alliance municipal court has jurisdiction within 183
Lexington, Marlboro, Paris, and Washington townships in Stark 184
county.185

       The Ashland municipal court has jurisdiction within Ashland 186
county.187

       The Ashtabula municipal court has jurisdiction within 188
Ashtabula, Plymouth, and Saybrook townships in Ashtabula county.189

       The Athens county municipal court has jurisdiction within 190
Athens county.191

       The Auglaize county municipal court has jurisdiction within 192
Auglaize county.193

       The Avon Lake municipal court has jurisdiction within the 194
municipal corporations of Avon and Sheffield in Lorain county.195

       The Barberton municipal court has jurisdiction within 196
Coventry, Franklin, and Green townships, within all of Copley 197
township except within the municipal corporation of Fairlawn, and 198
within the municipal corporations of Clinton and Norton, in Summit 199
county.200

       The Bedford municipal court has jurisdiction within the 201
municipal corporations of Bedford Heights, Oakwood, Glenwillow, 202
Solon, Bentleyville, Chagrin Falls, Moreland Hills, Orange, 203
Warrensville Heights, North Randall, and Woodmere, and within 204
Warrensville and Chagrin Falls townships, in Cuyahoga county.205

       The Bellefontaine municipal court has jurisdiction within 206
Logan county.207

       The Bellevue municipal court has jurisdiction within Lyme and 208
Sherman townships in Huron county and within York township in 209
Sandusky county.210

       The Berea municipal court has jurisdiction within the 211
municipal corporations of Strongsville, Middleburgh Heights, Brook 212
Park, Westview, and Olmsted Falls, and within Olmsted township, in 213
Cuyahoga county.214

       The Bowling Green municipal court has jurisdiction within the 215
municipal corporations of Bairdstown, Bloomdale, Bradner, Custar, 216
Cygnet, Grand Rapids, Haskins, Hoytville, Jerry City, Milton 217
Center, North Baltimore, Pemberville, Portage, Rising Sun, 218
Tontogany, Wayne, West Millgrove, and Weston, and within Bloom, 219
Center, Freedom, Grand Rapids, Henry, Jackson, Liberty, Middleton, 220
Milton, Montgomery, Plain, Portage, Washington, Webster, and 221
Weston townships in Wood county.222

       Beginning February 9, 2003, the Brown county municipal court 223
has jurisdiction within Brown county.224

       The Bryan municipal court has jurisdiction within Williams 225
county.226

       The Cambridge municipal court has jurisdiction within 227
Guernsey county.228

       The Campbell municipal court has jurisdiction within 229
Coitsville township in Mahoning county.230

       The Canton municipal court has jurisdiction within Canton, 231
Lake, Nimishillen, Osnaburg, Pike, Plain, and Sandy townships in 232
Stark county.233

       The Carroll county municipal court has jurisdiction within 234
Carroll county.235

       The Celina municipal court has jurisdiction within Mercer 236
county.237

       The Champaign county municipal court has jurisdiction within 238
Champaign county.239

       The Chardon municipal court has jurisdiction within Geauga 240
county.241

       The Chillicothe municipal court has jurisdiction within Ross 242
county.243

       The Circleville municipal court has jurisdiction within 244
Pickaway county.245

       The Clark county municipal court has jurisdiction within 246
Clark county.247

       The Clermont county municipal court has jurisdiction within 248
Clermont county.249

       The Cleveland municipal court has jurisdiction within the 250
municipal corporation of Bratenahl in Cuyahoga county.251

       Beginning July 1, 1992, the Clinton county municipal court 252
has jurisdiction within Clinton county.253

       The Columbiana county municipal court has jurisdiction within 254
all of Columbiana county except within the municipal corporation 255
of East Liverpool and except within Liverpool and St. Clair 256
townships.257

       The Coshocton municipal court has jurisdiction within 258
Coshocton county.259

       The Crawford county municipal court has jurisdiction within 260
Crawford county.261

        Until December 31, 2008, the Cuyahoga Falls municipal court 262
has jurisdiction within Boston, Hudson, Northfield Center, 263
Sagamore Hills, and Twinsburg townships, and within the municipal 264
corporations of Boston Heights, Hudson, Munroe Falls, Northfield, 265
Peninsula, Reminderville, Silver Lake, Stow, Tallmadge, Twinsburg, 266
and Macedonia, in Summit county.267

       Beginning January 1, 2005, the Darke county municipal court 268
has jurisdiction within Darke county except within the municipal 269
corporation of Bradford.270

       The Defiance municipal court has jurisdiction within Defiance 271
county.272

       The Delaware municipal court has jurisdiction within Delaware 273
county.274

       The East Liverpool municipal court has jurisdiction within 275
Liverpool and St. Clair townships in Columbiana county.276

       The Eaton municipal court has jurisdiction within Preble 277
county.278

       The Elyria municipal court has jurisdiction within the 279
municipal corporations of Grafton, LaGrange, and North Ridgeville, 280
and within Elyria, Carlisle, Eaton, Columbia, Grafton, and 281
LaGrange townships, in Lorain county.282

       Beginning January 1, 2008, the Erie county municipal court 283
has jurisdiction within Erie county except within the townships of 284
Florence, Huron, Perkins, and Vermilion and the municipal 285
corporations of Bay View, Castalia, Huron, Sandusky, and 286
Vermilion.287

       The Fairborn municipal court has jurisdiction within the 288
municipal corporation of Beavercreek and within Bath and 289
Beavercreek townships in Greene county.290

       Beginning January 2, 2000, the Fairfield county municipal 291
court has jurisdiction within Fairfield county.292

       The Findlay municipal court has jurisdiction within all of 293
Hancock county except within Washington township.294

       The Fostoria municipal court has jurisdiction within Loudon 295
and Jackson townships in Seneca county, within Washington township 296
in Hancock county, and within Perry township, except within the 297
municipal corporation of West Millgrove, in Wood county. 298

       The Franklin municipal court has jurisdiction within Franklin 299
township in Warren county.300

       The Franklin county municipal court has jurisdiction within 301
Franklin county.302

       The Fremont municipal court has jurisdiction within Ballville 303
and Sandusky townships in Sandusky county.304

       The Gallipolis municipal court has jurisdiction within Gallia 305
county.306

       The Garfield Heights municipal court has jurisdiction within 307
the municipal corporations of Maple Heights, Walton Hills, Valley 308
View, Cuyahoga Heights, Newburgh Heights, Independence, and 309
Brecksville in Cuyahoga county.310

       The Girard municipal court has jurisdiction within Liberty, 311
Vienna, and Hubbard townships in Trumbull county.312

       The Hamilton municipal court has jurisdiction within Ross and 313
St. Clair townships in Butler county.314

       The Hamilton county municipal court has jurisdiction within 315
Hamilton county.316

       The Hardin county municipal court has jurisdiction within 317

       The Hillsboro municipal court has jurisdiction within all of 319
Highland county except within Madison township.320

       The Jackson county municipal court has jurisdiction within 331

       The Kettering municipal court has jurisdiction within the 333
municipal corporations of Centerville and Moraine, and within 334
Washington township, in Montgomery county.335

       Until January 2, 2000, the Lancaster municipal court has 336
jurisdiction within Fairfield county.337

       The Lawrence county municipal court has jurisdiction within 338
the townships of Fayette, Mason, Perry, Rome, Symmes, Union, and 339
Windsor in Lawrence county.340

       The Lebanon municipal court has jurisdiction within 341
Turtlecreek township in Warren county.342

       The Licking county municipal court has jurisdiction within 343
Licking county.344

       The Lima municipal court has jurisdiction within Allen 345
county.346

       The Lorain municipal court has jurisdiction within the 347
municipal corporation of Sheffield Lake, and within Sheffield 348
township, in Lorain county.349

       The Lyndhurst municipal court has jurisdiction within the 350
municipal corporations of Mayfield Heights, Gates Mills, Mayfield, 351
Highland Heights, and Richmond Heights in Cuyahoga county.352

       The Madison county municipal court has jurisdiction within 353
Madison county.354

       The Mansfield municipal court has jurisdiction within 355
Madison, Springfield, Sandusky, Franklin, Weller, Mifflin, Troy, 356
Washington, Monroe, Perry, Jefferson, and Worthington townships, 357
and within sections 35-36-31 and 32 of Butler township, in 358
Richland county.359

       The Marietta municipal court has jurisdiction within 360
Washington county.361

       The Marion municipal court has jurisdiction within Marion 362
county.363

       The Marysville municipal court has jurisdiction within Union 364
county.365

       The Mason municipal court has jurisdiction within Deerfield 366
township in Warren county.367

       The Massillon municipal court has jurisdiction within 368
Bethlehem, Perry, Sugar Creek, Tuscarawas, Lawrence, and Jackson 369
townships in Stark county.370

       The Maumee municipal court has jurisdiction within the 371
municipal corporations of Waterville and Whitehouse, within 372
Waterville and Providence townships, and within those portions of 373
Springfield, Monclova, and Swanton townships lying south of the 374
northerly boundary line of the Ohio turnpike, in Lucas county.375

       The Medina municipal court has jurisdiction within the 376
municipal corporations of Briarwood Beach, Brunswick, 377
Chippewa-on-the-Lake, and Spencer and within the townships of 378
Brunswick Hills, Chatham, Granger, Hinckley, Lafayette, 379
Litchfield, Liverpool, Medina, Montville, Spencer, and York 380
townships, in Medina county.381

       The Mentor municipal court has jurisdiction within the 382
municipal corporation of Mentor-on-the-Lake in Lake county.383

       The Miami county municipal court has jurisdiction within 384
Miami county and within the part of the municipal corporation of 385
Bradford that is located in Darke county.386

       The Miamisburg municipal court has jurisdiction within the 387
municipal corporations of Germantown and West Carrollton, and 388
within German and Miami townships in Montgomery county.389

       The Middletown municipal court has jurisdiction within 390
Madison township, and within all of Lemon township, except within 391
the municipal corporation of Monroe, in Butler county.392

       Beginning July 1, 2010, the Montgomery county municipal court 393
has jurisdiction within all of Montgomery county except for the 394
municipal corporations of Centerville, Clayton, Dayton, Englewood, 395
Germantown, Kettering, Miamisburg, Moraine, Oakwood, Union, 396
Vandalia, and West Carrollton and Butler, German, Harrison, Miami, 397
and Washington townships.398

       Beginning January 1, 2003, the Morrow county municipal court 399
has jurisdiction within Morrow county.400

       The Mount Vernon municipal court has jurisdiction within Knox 401
county.402

       The Napoleon municipal court has jurisdiction within Henry 403
county.404

       The New Philadelphia municipal court has jurisdiction within 405
the municipal corporation of Dover, and within Auburn, Bucks, 406
Fairfield, Goshen, Jefferson, Warren, York, Dover, Franklin, 407
Lawrence, Sandy, Sugarcreek, and Wayne townships in Tuscarawas 408
county.409

       The Newton Falls municipal court has jurisdiction within 410
Bristol, Bloomfield, Lordstown, Newton, Braceville, Southington, 411
Farmington, and Mesopotamia townships in Trumbull county.412

       The Niles municipal court has jurisdiction within the 413
municipal corporation of McDonald, and within Weathersfield 414
township in Trumbull county.415

       The Norwalk municipal court has jurisdiction within all of 416
Huron county except within the municipal corporation of Bellevue 417
and except within Lyme and Sherman townships.418

       The Oberlin municipal court has jurisdiction within the 419
municipal corporations of Amherst, Kipton, Rochester, South 420
Amherst, and Wellington, and within Henrietta, Russia, Camden, 421
Pittsfield, Brighton, Wellington, Penfield, Rochester, and 422
Huntington townships, and within all of Amherst township except 423
within the municipal corporation of Lorain, in Lorain county.424

       The Oregon municipal court has jurisdiction within the 425
municipal corporation of Harbor View, and within Jerusalem 426
township, in Lucas county, and north within Maumee Bay and Lake 427
Erie to the boundary line between Ohio and Michigan between the 428
easterly boundary of the court and the easterly boundary of the 429
Toledo municipal court.430

       The Ottawa county municipal court has jurisdiction within 431
Ottawa county.432

       The Painesville municipal court has jurisdiction within 433
Painesville, Perry, Leroy, Concord, and Madison townships in Lake 434
county.435

       The Parma municipal court has jurisdiction within the 436
municipal corporations of Parma Heights, Brooklyn, Linndale, North 437
Royalton, Broadview Heights, Seven Hills, and Brooklyn Heights in 438
Cuyahoga county.439

       The Perrysburg municipal court has jurisdiction within the 440
municipal corporations of Luckey, Millbury, Northwood, Rossford, 441
and Walbridge, and within Perrysburg, Lake, and Troy townships, in 442
Wood county.443

       The Portage county municipal court has jurisdiction within 444
Portage county.445

       The Portsmouth municipal court has jurisdiction within Scioto 446
county.447

       The Putnam county municipal court has jurisdiction within 448
Putnam county.449

       The Rocky River municipal court has jurisdiction within the 450
municipal corporations of Bay Village, Westlake, Fairview Park, 451
and North Olmsted, and within Riveredge township, in Cuyahoga 452
county.453

       The Sandusky municipal court has jurisdiction within the 454
municipal corporations of Castalia and Bay View, and within 455
Perkins township, in Erie county.456

       Beginning January 1, 2013, the Sandusky county municipal 457
court has jurisdiction within all of Sandusky county except within 458
the municipal corporations of Bellevue and Fremont and Ballville, 459
Sandusky, and York townships.460

       The Shaker Heights municipal court has jurisdiction within 461
the municipal corporations of University Heights, Beachwood, 462
Pepper Pike, and Hunting Valley in Cuyahoga county.463

       The Shelby municipal court has jurisdiction within Sharon, 464
Jackson, Cass, Plymouth, and Blooming Grove townships, and within 465
all of Butler township except sections 35-36-31 and 32, in 466
Richland county.467

       The Sidney municipal court has jurisdiction within Shelby 468
county.469

       Beginning January 1, 2009, the Stow municipal court has 470
jurisdiction within Boston, Hudson, Northfield Center, Sagamore 471
Hills, and Twinsburg townships, and within the municipal 472
corporations of Boston Heights, Cuyahoga Falls, Hudson, Munroe 473
Falls, Northfield, Peninsula, Reminderville, Silver Lake, Stow, 474
Tallmadge, Twinsburg, and Macedonia, in Summit county.475

       The Struthers municipal court has jurisdiction within the 476
municipal corporations of Lowellville, New Middleton, and Poland, 477
and within Poland and Springfield townships in Mahoning county.478

       The Sylvania municipal court has jurisdiction within the 479
municipal corporations of Berkey and Holland, and within Sylvania, 480
Richfield, Spencer, and Harding townships, and within those 481
portions of Swanton, Monclova, and Springfield townships lying 482
north of the northerly boundary line of the Ohio turnpike, in 483
Lucas county.484

       TheBeginning January 1, 2014, the Tiffin-Fostoria municipal 485
court has jurisdiction within Adams, Big Spring, Bloom, Clinton, 486
Eden, Hopewell, Jackson, Liberty, Loudon, Pleasant, Reed, Scipio, 487
Seneca, Thompson, and Venice townships in Seneca county, within 488
Washington township in Hancock county, and within Perry township, 489
except within the municipal corporation of West Millgrove, in Wood 490
county.491

       The Toledo municipal court has jurisdiction within Washington 492
township, and within the municipal corporation of Ottawa Hills, in 493
Lucas county.494

       The Upper Sandusky municipal court has jurisdiction within 495
Wyandot county.496

       The Vandalia municipal court has jurisdiction within the 497
municipal corporations of Clayton, Englewood, and Union, and 498
within Butler, Harrison, and Randolph townships, in Montgomery 499
county.500

       The Van Wert municipal court has jurisdiction within Van Wert 501
county.502

       The Vermilion municipal court has jurisdiction within the 503
townships of Vermilion and Florence in Erie county and within all 504
of Brownhelm township except within the municipal corporation of 505
Lorain, in Lorain county.506

       The Wadsworth municipal court has jurisdiction within the 507
municipal corporations of Gloria Glens Park, Lodi, Seville, and 508
Westfield Center, and within Guilford, Harrisville, Homer, Sharon, 509
Wadsworth, and Westfield townships in Medina county.510

       The Warren municipal court has jurisdiction within Warren and 511
Champion townships, and within all of Howland township except 512
within the municipal corporation of Niles, in Trumbull county.513

       The Washington Court House municipal court has jurisdiction 514
within Fayette county.515

       The Wayne county municipal court has jurisdiction within 516
Wayne county.517

       The Willoughby municipal court has jurisdiction within the 518
municipal corporations of Eastlake, Wickliffe, Willowick, 519
Willoughby Hills, Kirtland, Kirtland Hills, Waite Hill, 520
Timberlake, and Lakeline, and within Kirtland township, in Lake 521
county.522

       Through June 30, 1992, the Wilmington municipal court has 523
jurisdiction within Clinton county.524

       The Xenia municipal court has jurisdiction within 525
Caesarcreek, Cedarville, Jefferson, Miami, New Jasper, Ross, 526
Silvercreek, Spring Valley, Sugarcreek, and Xenia townships in 527
Greene county.528

       (C) As used in this section:529

       (1) "Within a township" includes all land, including, but not 530
limited to, any part of any municipal corporation, that is 531
physically located within the territorial boundaries of that 532
township, whether or not that land or municipal corporation is 533
governmentally a part of the township.534

       (2) "Within a municipal corporation" includes all land within 535
the territorial boundaries of the municipal corporation and any 536
townships that are coextensive with the municipal corporation.537

       Sec. 1901.021.  (A) Except as otherwise provided in division 538
(M) of this section, the judge or judges of any municipal court 539
established under division (A) of section 1901.01 of the Revised 540
Code having territorial jurisdiction outside the corporate limits 541
of the municipal corporation in which it is located may sit 542
outside the corporate limits of the municipal corporation within 543
the area of its territorial jurisdiction.544

       (B) Two or more of the judges of the Hamilton county 545
municipal court shall be assigned by the presiding judge of the 546
court to sit outside the municipal corporation of Cincinnati.547

       (C) Two of the judges of the Portage county municipal court 548
shall sit within the municipal corporation of Ravenna, and one of 549
the judges shall sit within the municipal corporation of Kent. The 550
judges may sit in other incorporated areas of Portage county.551

       (D) One of the judges of the Wayne county municipal court 552
shall sit within the municipal corporation of Wooster, and one 553
shall sit within the municipal corporation of Orrville. Both 554
judges may sit in other incorporated areas of Wayne county.555

       (E) The judge of the Auglaize county municipal court shall 556
sit within the municipal corporations of Wapakoneta and St. Marys 557
and may sit in other incorporated areas in Auglaize county.558

       (F) At least one of the judges of the Miami county municipal 559
court shall sit within the municipal corporations of Troy, Piqua, 560
and Tipp City, and the judges may sit in other incorporated areas 561
of Miami county.562

       (G) The judge of the Crawford county municipal court shall 563
sit within the municipal corporations of Bucyrus and Galion and 564
may sit in other incorporated areas in Crawford county.565

       (H) The judge of the Jackson county municipal court shall sit 566
within the municipal corporations of Jackson and Wellston and may 567
sit in other incorporated areas in Jackson county.568

       (I) Each judge of the Columbiana county municipal court may 569
sit within the municipal corporation of Lisbon, Salem, or East 570
Palestine until the judges jointly select a central location 571
within the territorial jurisdiction of the court. When the judges 572
select a central location, the judges shall sit at that location.573

       (J) In any municipal court, other than the Hamilton county 574
municipal court and the Montgomery county municipal court, that 575
has more than one judge, the decision for one or more judges to 576
sit outside the corporate limits of the municipal corporation 577
shall be made by rule of the court as provided in division (C) of 578
sections 1901.14 and 1901.16 of the Revised Code.579

       (K) The assignment of a judge to sit in a municipal 580
corporation other than that in which the court is located does not 581
affect the jurisdiction of the mayor except as provided in section 582
1905.01 of the Revised Code.583

       (L) The judges of the Clermont county municipal court may sit 584
in any municipal corporation or unincorporated territory within 585
Clermont county.586

       (M) Beginning July 1, 2010, the judges of the Montgomery 587
county municipal court shall sit in the same locations as the 588
judges of the Montgomery county county court sat before the county 589
court was abolished on that date. The legislative authority of the 590
Montgomery county municipal court may determine after that date 591
that the judges of the Montgomery county municipal court shall sit 592
in any municipal corporation or unincorporated territory within 593
Montgomery county.594

       (N) The judge of the Tiffin-Fostoria municipal court shall 595
sit within each of the municipal corporations of Tiffin and 596
Fostoria on a weekly basis. Cases that arise within the municipal 597
corporation of Tiffin and within Adams, Big Spring, Bloom, 598
Clinton, Eden, Hopewell, Liberty, Pleasant, Reed, Scioto, Seneca, 599
Thompson, and Venice townships in Seneca county shall be filed in 600
the office of the clerk of the court located in the municipal 601
corporation of Tiffin. Cases that arise in the municipal 602
corporation of Fostoria and within Loudon and Jackson townships in 603
Seneca county, within Washington township in Hancock county, and 604
within Perry township, except within the municipal corporation of 605
West Millgrove, in Wood county, shall be filed in the office of 606
the special deputy clerk located in the municipal corporation of 607
Fostoria.608

       Sec. 1901.08. The number of, and the time for election of, 609
judges of the following municipal courts and the beginning of 610
their terms shall be as follows:611

       In the Akron municipal court, two full-time judges shall be 612
elected in 1951, two full-time judges shall be elected in 1953, 613
one full-time judge shall be elected in 1967, and one full-time 614
judge shall be elected in 1975.615

       In the Alliance municipal court, one full-time judge shall be 616
elected in 1953.617

       In the Ashland municipal court, one full-time judge shall be 618
elected in 1951.619

       In the Ashtabula municipal court, one full-time judge shall 620
be elected in 1953.621

       In the Athens county municipal court, one full-time judge 622
shall be elected in 1967.623

       In the Auglaize county municipal court, one full-time judge 624
shall be elected in 1975.625

       In the Avon Lake municipal court, one part-time judge shall 626
be elected in 1957.627

       In the Barberton municipal court, one full-time judge shall 628
be elected in 1969, and one full-time judge shall be elected in 629
1971.630

       In the Bedford municipal court, one full-time judge shall be 631
elected in 1975, and one full-time judge shall be elected in 1979.632

       In the Bellefontaine municipal court, one full-time judge 633
shall be elected in 1993.634

       In the Bellevue municipal court, one part-time judge shall be 635
elected in 1951.636

       In the Berea municipal court, one full-time judge shall be 637
elected in 2005.638

       In the Bowling Green municipal court, one full-time judge 639
shall be elected in 1983.640

       In the Brown county municipal court, one full-time judge 641
shall be elected in 2005. Beginning February 9, 2003, the 642
part-time judge of the Brown county county court that existed 643
prior to that date whose term commenced on January 2, 2001, shall 644
serve as the full-time judge of the Brown county municipal court 645
until December 31, 2005.646

       In the Bryan municipal court, one full-time judge shall be 647
elected in 1965.648

       In the Cambridge municipal court, one full-time judge shall 649
be elected in 1951.650

       In the Campbell municipal court, one part-time judge shall be 651
elected in 1963.652

       In the Canton municipal court, one full-time judge shall be 653
elected in 1951, one full-time judge shall be elected in 1969, and 654
two full-time judges shall be elected in 1977.655

       In the Carroll county municipal court, one full-time judge 656
shall be elected in 2009. Beginning January 1, 2007, the judge 657
elected in 2006 to the part-time judgeship of the Carroll county 658
county court that existed prior to that date shall serve as the 659
full-time judge of the Carroll county municipal court until 660
December 31, 2009.661

       In the Celina municipal court, one full-time judge shall be 662
elected in 1957.663

       In the Champaign county municipal court, one full-time judge 664
shall be elected in 2001.665

       In the Chardon municipal court, one full-time judge shall be 666
elected in 1963.667

       In the Chillicothe municipal court, one full-time judge shall 668
be elected in 1951, and one full-time judge shall be elected in 669
1977.670

       In the Circleville municipal court, one full-time judge shall 671
be elected in 1953.672

       In the Clark county municipal court, one full-time judge 673
shall be elected in 1989, and two full-time judges shall be 674
elected in 1991. The full-time judges of the Springfield municipal 675
court who were elected in 1983 and 1985 shall serve as the judges 676
of the Clark county municipal court from January 1, 1988, until 677
the end of their respective terms.678

       In the Clermont county municipal court, two full-time judges 679
shall be elected in 1991, and one full-time judge shall be elected 680
in 1999.681

       In the Cleveland municipal court, six full-time judges shall 682
be elected in 1975, three full-time judges shall be elected in 683
1953, and four full-time judges shall be elected in 1955.684

       In the Cleveland Heights municipal court, one full-time judge 685
shall be elected in 1957.686

       In the Clinton county municipal court, one full-time judge 687
shall be elected in 1997. The full-time judge of the Wilmington 688
municipal court who was elected in 1991 shall serve as the judge 689
of the Clinton county municipal court from July 1, 1992, until the 690
end of that judge's term on December 31, 1997.691

       In the Columbiana county municipal court, two full-time 692
judges shall be elected in 2001.693

       In the Conneaut municipal court, one full-time judge shall be 694
elected in 1953.695

       In the Coshocton municipal court, one full-time judge shall 696
be elected in 1951.697

       In the Crawford county municipal court, one full-time judge 698
shall be elected in 1977.699

       In the Cuyahoga Falls municipal court, one full-time judge 700
shall be elected in 1953, and one full-time judge shall be elected 701
in 1967. Effective December 31, 2008, the Cuyahoga Falls municipal 702
court shall cease to exist; however, the judges of the Cuyahoga 703
Falls municipal court who were elected pursuant to this section in 704
2003 and 2007 for terms beginning on January 1, 2004, and January 705
1, 2008, respectively, shall serve as full-time judges of the Stow 706
municipal court until December 31, 2009, and December 31, 2013, 707
respectively.708

       In the Darke county municipal court, one full-time judge 709
shall be elected in 2005. Beginning January 1, 2005, the part-time 710
judge of the Darke county county court that existed prior to that 711
date whose term began on January 1, 2001, shall serve as the 712
full-time judge of the Darke county municipal court until December 713
31, 2005.714

       In the Dayton municipal court, three full-time judges shall 715
be elected in 1987, their terms to commence on successive days 716
beginning on the first day of January next after their election, 717
and two full-time judges shall be elected in 1955, their terms to 718
commence on successive days beginning on the second day of January 719
next after their election.720

       In the Defiance municipal court, one full-time judge shall be 721
elected in 1957.722

       In the Delaware municipal court, one full-time judge shall be 723
elected in 1953, and one full-time judge shall be elected in 2007.724

       In the East Cleveland municipal court, one full-time judge 725
shall be elected in 1957.726

       In the East Liverpool municipal court, one full-time judge 727
shall be elected in 1953.728

       In the Eaton municipal court, one full-time judge shall be 729
elected in 1973.730

       In the Elyria municipal court, one full-time judge shall be 731
elected in 1955, and one full-time judge shall be elected in 1973.732

       In the Erie county municipal court, one full-time judge shall 733
be elected in 2007.734

       In the Euclid municipal court, one full-time judge shall be 735
elected in 1951.736

       In the Fairborn municipal court, one full-time judge shall be 737
elected in 1977.738

       In the Fairfield county municipal court, one full-time judge 739
shall be elected in 2003, and one full-time judge shall be elected 740
in 2005.741

       In the Fairfield municipal court, one full-time judge shall 742
be elected in 1989.743

       In the Findlay municipal court, one full-time judge shall be 744
elected in 1955, and one full-time judge shall be elected in 1993.745

       In the Fostoria municipal court, one full-time judge shall be 746
elected in 1975.747

       In the Franklin municipal court, one part-time judge shall be 748
elected in 1951.749

       In the Franklin county municipal court, two full-time judges 750
shall be elected in 1969, three full-time judges shall be elected 751
in 1971, seven full-time judges shall be elected in 1967, one 752
full-time judge shall be elected in 1975, one full-time judge 753
shall be elected in 1991, and one full-time judge shall be elected 754
in 1997.755

       In the Fremont municipal court, one full-time judge shall be 756
elected in 1975.757

       In the Gallipolis municipal court, one full-time judge shall 758
be elected in 1981.759

       In the Garfield Heights municipal court, one full-time judge 760
shall be elected in 1951, and one full-time judge shall be elected 761
in 1981.762

       In the Girard municipal court, one full-time judge shall be 763
elected in 1963.764

       In the Hamilton municipal court, one full-time judge shall be 765
elected in 1953.766

       In the Hamilton county municipal court, five full-time judges 767
shall be elected in 1967, five full-time judges shall be elected 768
in 1971, two full-time judges shall be elected in 1981, and two 769
full-time judges shall be elected in 1983. All terms of judges of 770
the Hamilton county municipal court shall commence on the first 771
day of January next after their election, except that the terms of 772
the additional judges to be elected in 1981 shall commence on 773
January 2, 1982, and January 3, 1982, and that the terms of the 774
additional judges to be elected in 1983 shall commence on January 775
4, 1984, and January 5, 1984.776

       In the Hardin county municipal court, one part-time judge 777
shall be elected in 1989.778

       In the Hillsboro municipal court, one full-time judge shall 779
be elected in 2011. On and after December 30, 2008, the part-time 780
judge of the Hillsboro municipal court who was elected in 2005 781
shall serve as a full-time judge of the court until the end of 782
that judge's term on December 31, 2011.783

       In the Hocking county municipal court, one full-time judge 784
shall be elected in 1977.785

       In the Holmes county municipal court, one full-time judge 786
shall be elected in 2007. Beginning January 1, 2007, the part-time 787
judge of the Holmes county county court that existed prior to that 788
date whose term commenced on January 1, 2007, shall serve as the 789
full-time judge of the Holmes county municipal court until 790
December 31, 2007.791

       In the Huron municipal court, one part-time judge shall be 792
elected in 1967.793

       In the Ironton municipal court, one full-time judge shall be 794
elected in 1951.795

       In the Jackson county municipal court, one full-time judge 796
shall be elected in 2001. On and after March 31, 1997, the 797
part-time judge of the Jackson county municipal court who was 798
elected in 1995 shall serve as a full-time judge of the court 799
until the end of that judge's term on December 31, 2001.800

       In the Kettering municipal court, one full-time judge shall 801
be elected in 1971, and one full-time judge shall be elected in 802
1975.803

       In the Lakewood municipal court, one full-time judge shall be 804
elected in 1955.805

       In the Lancaster municipal court, one full-time judge shall 806
be elected in 1951, and one full-time judge shall be elected in 807
1979. Beginning January 2, 2000, the full-time judges of the 808
Lancaster municipal court who were elected in 1997 and 1999 shall 809
serve as judges of the Fairfield county municipal court until the 810
end of those judges' terms.811

       In the Lawrence county municipal court, one part-time judge 812
shall be elected in 1981.813

       In the Lebanon municipal court, one part-time judge shall be 814
elected in 1955.815

       In the Licking county municipal court, one full-time judge 816
shall be elected in 1951, and one full-time judge shall be elected 817
in 1971.818

       In the Lima municipal court, one full-time judge shall be 819
elected in 1951, and one full-time judge shall be elected in 1967.820

       In the Lorain municipal court, one full-time judge shall be 821
elected in 1953, and one full-time judge shall be elected in 1973.822

       In the Lyndhurst municipal court, one full-time judge shall 823
be elected in 1957.824

       In the Madison county municipal court, one full-time judge 825
shall be elected in 1981.826

       In the Mansfield municipal court, one full-time judge shall 827
be elected in 1951, and one full-time judge shall be elected in 828
1969.829

       In the Marietta municipal court, one full-time judge shall be 830
elected in 1957.831

       In the Marion municipal court, one full-time judge shall be 832
elected in 1951.833

       In the Marysville municipal court, one full-time judge shall 834
be elected in 2011. On and after January 18, 2007, the part-time 835
judge of the Marysville municipal court who was elected in 2005 836
shall serve as a full-time judge of the court until the end of 837
that judge's term on December 31, 2011.838

       In the Mason municipal court, one part-time judge shall be 839
elected in 1965.840

       In the Massillon municipal court, one full-time judge shall 841
be elected in 1953, and one full-time judge shall be elected in 842
1971.843

       In the Maumee municipal court, one full-time judge shall be 844
elected in 1963.845

       In the Medina municipal court, one full-time judge shall be 846
elected in 1957.847

       In the Mentor municipal court, one full-time judge shall be 848
elected in 1971.849

       In the Miami county municipal court, one full-time judge 850
shall be elected in 1975, and one full-time judge shall be elected 851
in 1979.852

       In the Miamisburg municipal court, one full-time judge shall 853
be elected in 1951.854

       In the Middletown municipal court, one full-time judge shall 855
be elected in 1953.856

       In the Montgomery county municipal court:857

       One judge shall be elected in 2011 to a part-time judgeship 858
for a term to begin on January 1, 2012. If any one of the other 859
judgeships of the court becomes vacant and is abolished after July 860
1, 2010, this judgeship shall become a full-time judgeship on that 861
date. If only one other judgeship of the court becomes vacant and 862
is abolished as of December 31, 2021, this judgeship shall be 863
abolished as of that date. Beginning July 1, 2010, the part-time 864
judge of the Montgomery county county court that existed before 865
that date whose term commenced on January 1, 2005, shall serve as 866
a part-time judge of the Montgomery county municipal court until 867
December 31, 2011.868

       One judge shall be elected in 2011 to a full-time judgeship 869
for a term to begin on January 2, 2012, and this judgeship shall 870
be abolished on January 1, 2016. Beginning July 1, 2010, the 871
part-time judge of the Montgomery county county court that existed 872
before that date whose term commenced on January 2, 2005, shall 873
serve as a full-time judge of the Montgomery county municipal 874
court until January 1, 2012.875

       One judge shall be elected in 2013 to a full-time judgeship 876
for a term to begin on January 2, 2014. Beginning July 1, 2010, 877
the part-time judge of the Montgomery county county court that 878
existed before that date whose term commenced on January 2, 2007, 879
shall serve as a full-time judge of the Montgomery county 880
municipal court until January 1, 2014.881

       One judge shall be elected in 2013 to a judgeship for a term 882
to begin on January 1, 2014. If no other judgeship of the court 883
becomes vacant and is abolished by January 1, 2014, this judgeship 884
shall be a part-time judgeship. When one or more of the other 885
judgeships of the court becomes vacant and is abolished after July 886
1, 2010, this judgeship shall become a full-time judgeship. 887
Beginning July 1, 2010, the part-time judge of the Montgomery 888
county county court that existed before that date whose term 889
commenced on January 1, 2007, shall serve as this judge of the 890
Montgomery county municipal court until December 31, 2013.891

       If any one of the judgeships of the court becomes vacant 892
before December 31, 2021, that judgeship is abolished on the date 893
that it becomes vacant, and the other judges of the court shall be 894
or serve as full-time judges. The abolishment of judgeships for 895
the Montgomery county municipal court shall cease when the court 896
has two full-time judgeships.897

       In the Morrow county municipal court, one full-time judge 898
shall be elected in 2005. Beginning January 1, 2003, the part-time 899
judge of the Morrow county county court that existed prior to that 900
date shall serve as the full-time judge of the Morrow county 901
municipal court until December 31, 2005.902

       In the Mount Vernon municipal court, one full-time judge 903
shall be elected in 1951.904

       In the Napoleon municipal court, one full-time judge shall be 905
elected in 2005.906

       In the New Philadelphia municipal court, one full-time judge 907
shall be elected in 1975.908

       In the Newton Falls municipal court, one full-time judge 909
shall be elected in 1963.910

       In the Niles municipal court, one full-time judge shall be 911
elected in 1951.912

       In the Norwalk municipal court, one full-time judge shall be 913
elected in 1975.914

       In the Oakwood municipal court, one part-time judge shall be 915
elected in 1953.916

       In the Oberlin municipal court, one full-time judge shall be 917
elected in 1989.918

       In the Oregon municipal court, one full-time judge shall be 919
elected in 1963.920

       In the Ottawa county municipal court, one full-time judge 921
shall be elected in 1995, and the full-time judge of the Port 922
Clinton municipal court who is elected in 1989 shall serve as the 923
judge of the Ottawa county municipal court from February 4, 1994, 924
until the end of that judge's term.925

       In the Painesville municipal court, one full-time judge shall 926
be elected in 1951.927

       In the Parma municipal court, one full-time judge shall be 928
elected in 1951, one full-time judge shall be elected in 1967, and 929
one full-time judge shall be elected in 1971.930

       In the Perrysburg municipal court, one full-time judge shall 931
be elected in 1977.932

       In the Portage county municipal court, two full-time judges 933
shall be elected in 1979, and one full-time judge shall be elected 934
in 1971.935

       In the Port Clinton municipal court, one full-time judge 936
shall be elected in 1953. The full-time judge of the Port Clinton 937
municipal court who is elected in 1989 shall serve as the judge of 938
the Ottawa county municipal court from February 4, 1994, until the 939
end of that judge's term.940

       In the Portsmouth municipal court, one full-time judge shall 941
be elected in 1951, and one full-time judge shall be elected in 942
1985.943

       In the Putnam county municipal court, one full-time judge 944
shall be elected in 2011. Beginning January 1, 2011, the part-time 945
judge of the Putnam county county court that existed prior to that 946
date whose term commenced on January 1, 2007, shall serve as the 947
full-time judge of the Putnam county municipal court until 948
December 31, 2011.949

       In the Rocky River municipal court, one full-time judge shall 950
be elected in 1957, and one full-time judge shall be elected in 951
1971.952

       In the Sandusky municipal court, one full-time judge shall be 953
elected in 1953.954

       In the Sandusky county municipal court, one full-time judge 955
shall be elected in 2013. Beginning on January 1, 2013, the two 956
part-time judges of the Sandusky county county court that existed 957
prior to that date shall serve as part-time judges of the Sandusky 958
county municipal court until December 31, 2013. If either 959
judgeship becomes vacant before January 1, 2014, that judgeship is 960
abolished on the date it becomes vacant, and the person who holds 961
the other judgeship shall serve as the full-time judge of the 962
Sandusky county municipal court until December 31, 2013.963

       In the Shaker Heights municipal court, one full-time judge 964
shall be elected in 1957.965

       In the Shelby municipal court, one part-time judge shall be 966
elected in 1957.967

       In the Sidney municipal court, one full-time judge shall be 968
elected in 1995.969

       In the South Euclid municipal court, one full-time judge 970
shall be elected in 1999. The part-time judge elected in 1993, 971
whose term commenced on January 1, 1994, shall serve until 972
December 31, 1999, and the office of that judge is abolished on 973
January 1, 2000.974

       In the Springfield municipal court, two full-time judges 975
shall be elected in 1985, and one full-time judge shall be elected 976
in 1983, all of whom shall serve as the judges of the Springfield 977
municipal court through December 31, 1987, and as the judges of 978
the Clark county municipal court from January 1, 1988, until the 979
end of their respective terms.980

       In the Steubenville municipal court, one full-time judge 981
shall be elected in 1953.982

       In the Stow municipal court, one full-time judge shall be 983
elected in 2009, and one full-time judge shall be elected in 2013. 984
Beginning January 1, 2009, the judge of the Cuyahoga Falls 985
municipal court that existed prior to that date whose term 986
commenced on January 1, 2008, shall serve as a full-time judge of 987
the Stow municipal court until December 31, 2013. Beginning 988
January 1, 2009, the judge of the Cuyahoga Falls municipal court 989
that existed prior to that date whose term commenced on January 1, 990
2004, shall serve as a full-time judge of the Stow municipal court 991
until December 31, 2009.992

       In the Struthers municipal court, one part-time judge shall 993
be elected in 1963.994

       In the Sylvania municipal court, one full-time judge shall be 995
elected in 1963.996

       In the Tiffin-Fostoria municipal court, one full-time judge 997
shall be elected in 19532013.998

       In the Toledo municipal court, two full-time judges shall be 999
elected in 1971, four full-time judges shall be elected in 1975, 1000
and one full-time judge shall be elected in 1973.1001

       In the Upper Sandusky municipal court, one full-time judge 1002
shall be elected in 2011. The part-time judge elected in 2005, 1003
whose term commenced on January 1, 2006, shall serve as a 1004
full-time judge on and after January 1, 2008, until the expiration 1005
of that judge's term on December 31, 2011, and the office of that 1006
judge is abolished on January 1, 2012.1007

       In the Vandalia municipal court, one full-time judge shall be 1008
elected in 1959.1009

       In the Van Wert municipal court, one full-time judge shall be 1010
elected in 1957.1011

       In the Vermilion municipal court, one part-time judge shall 1012
be elected in 1965.1013

       In the Wadsworth municipal court, one full-time judge shall 1014
be elected in 1981.1015

       In the Warren municipal court, one full-time judge shall be 1016
elected in 1951, and one full-time judge shall be elected in 1971.1017

       In the Washington Court House municipal court, one full-time 1018
judge shall be elected in 1999. The part-time judge elected in 1019
1993, whose term commenced on January 1, 1994, shall serve until 1020
December 31, 1999, and the office of that judge is abolished on 1021
January 1, 2000.1022

       In the Wayne county municipal court, one full-time judge 1023
shall be elected in 1975, and one full-time judge shall be elected 1024
in 1979.1025

       In the Willoughby municipal court, one full-time judge shall 1026
be elected in 1951.1027

       In the Wilmington municipal court, one full-time judge shall 1028
be elected in 1991, who shall serve as the judge of the Wilmington 1029
municipal court through June 30, 1992, and as the judge of the 1030
Clinton county municipal court from July 1, 1992, until the end of 1031
that judge's term on December 31, 1997.1032

       In the Xenia municipal court, one full-time judge shall be 1033
elected in 1977.1034

       In the Youngstown municipal court, one full-time judge shall 1035
be elected in 1951, and one full-time judge shall be elected in 1036
2013.1037

       In the Zanesville municipal court, one full-time judge shall 1038
be elected in 1953.1039

       Sec. 1901.311. (A) A municipal court may establish one or 1040
more branch offices and may appoint a special deputy clerk to 1041
administer each branch office. Each special deputy clerk shall 1042
take an oath of office before entering upon the duties of his1043
office, and, when so qualified, may perform any one or more of the 1044
duties appertaining to the office of clerk, as the court 1045
prescribes. Special deputy clerks appointed by the court pursuant 1046
to this section shall receive such compensation payable in either 1047
biweekly installments or semimonthly installments, as determined 1048
by the payroll administrator, out of the city treasury as the 1049
court may prescribe, except that the compensation of any special 1050
deputy clerk of a county-operated municipal court shall be payable 1051
out of the treasury of the county in which the court is located. 1052
The court may require any of the special deputy clerks to give 1053
bond of not less than three thousand dollars, conditioned for the 1054
faithful performance of his duties.1055

       (B) The Tiffin-Fostoria municipal court shall establish a 1056
branch office in Fostoria and shall appoint a special deputy clerk 1057
to administer the branch office on a full-time basis. The special 1058
deputy clerk shall take the oath of office, perform the duties 1059
appertaining to the office of the clerk of court as the court 1060
prescribes, and receive compensation as provided in division (A) 1061
of this section.1062

       Section 2.  That existing sections 1901.01, 1901.02, 1063
1901.021, 1901.08, and 1901.311 of the Revised Code are hereby 1064
repealed.1065

       Section 3. (A) Effective January 1, 2014, the Fostoria 1066
Municipal Court is abolished.1067

       (B) All causes, judgments, executions, and other proceedings 1068
pending in the Fostoria Municipal Court at the close of business 1069
on December 31, 2013, shall be transferred to and proceed in the 1070
Tiffin-Fostoria Municipal Court on January 1, 2014, as if 1071
originally instituted in the Tiffin-Fostoria Municipal Court. 1072
Parties to those causes, judgments, executions, and proceedings 1073
may make any amendments to their pleadings that are required to 1074
conform to the rules of the Tiffin-Fostoria Municipal Court. The 1075
Clerk of the Fostoria Municipal Court or other custodian shall 1076
transfer to the Tiffin-Fostoria Municipal Court all pleadings, 1077
orders, entries, dockets, bonds, papers, records, books, exhibits, 1078
files, moneys, property, and persons that belong to, are in the 1079
possession of, or are subject to the jurisdiction of the Fostoria 1080
Municipal Court, or any officer of that court, at the close of 1081
business on December 31, 2013, and that pertain to those causes, 1082
judgments, executions, and proceedings.1083

       (C) All employees of the Fostoria Municipal court shall be 1084
transferred to and shall become employees of the Tiffin-Fostoria 1085
Municipal Court on January 1, 2014.1086

       (D) Effective January 1, 2014, the full-time judgeship in the 1087
Fostoria Municipal court is abolished.1088

       Section 4. (A) Effective January 1, 2014, the Tiffin 1089
Municipal Court is abolished.1090

       (B) All causes, judgments, executions, and other proceedings 1091
pending in the Tiffin Municipal Court at the close of business on 1092
December 31, 2013, shall be transferred to and proceed in the 1093
Tiffin-Fostoria Municipal Court on January 1, 2014, as if 1094
originally instituted in the Tiffin-Fostoria Municipal Court. 1095
Parties to those causes, judgments, executions, and proceedings 1096
may make any amendments to their pleadings that are required to 1097
conform to the rules of the Tiffin-Fostoria Municipal Court. The 1098
Clerk of the Tiffin Municipal Court or other custodian shall 1099
transfer to the Tiffin-Fostoria Municipal Court all pleadings, 1100
orders, entries, dockets, bonds, papers, records, books, exhibits, 1101
files, moneys, property, and persons that belong to, are in the 1102
possession of, or are subject to the jurisdiction of the Tiffin 1103
Municipal Court, or any officer of that court, at the close of 1104

judgments, executions, and proceedings.1106

       (C) All employees of the Tiffin Municipal Court shall be 1107
transferred to and shall become employees of the Tiffin-Fostoria 1108
Municipal Court on January 1, 2014.1109

       (D) Effective January 1, 2014, the full-time judgeship in the 1110
Tiffin Municipal Court is abolished.1111

       Section 5. (A) The nomination of the new municipal court 1112
judge of the Tiffin-Fostoria Municipal Court created by this act 1113
and who is to be elected in 2013 shall be by nominating petition 1114
signed by at least fifty electors, shall be filed with the board 1115
of elections, and shall otherwise conform to the provisions of 1116
section 3513.261 of the Revised Code. The nominating petition 1117
shall designate the term of the office to which the candidate 1118
seeks election as provided in section 3513.28 of the Revised Code.1119

       (B) Notwithstanding any other provision of law, the 1120
nominating petition shall be filed not later than four p.m. of the 1121
ninetieth day prior to the general election in November, 2013. 1122
Notwithstanding section 3513.04 of the Revised Code, no person is 1123
prohibited from seeking election as a new judge created by this 1124
act because the person sought, by declaration of candidacy, a 1125
party nomination for an office or position at the May, 2013 1126
primary election.1127

       (C) The petitions for the office of municipal judge of the 1128
Fostoria Municipal Court to be elected in 2013, term to begin 1129
January 1, 2014, and the petitions for the office of municipal 1130
judge of the Tiffin Municipal Court to be elected in 2013, term to 1131
begin January 1, 2014, that contain signatures that were affixed 1132
prior to the effective date of this act shall be accepted for the 1133
office of municipal judge of the Tiffin-Fostoria Municipal Court 1134
to be elected in 2013, term to begin January 1, 2014, if those 1135
petitions meet the other requirements of Title XXXV of the Revised 1136
Code.1137

       (D) Upon the effective date of this act, any nominating 1138
petitions that have been filed for the election of municipal court 1139
judge of the Fostoria Municipal Court to be elected in 2013 and 1140
any nominating petitions that have been filed for the election of 1141
municipal court judge of the Tiffin Municipal Court to be elected 1142
in 2013 shall be considered nominating petitions for the election 1143
of the municipal court judge of the Tiffin-Fostoria Municipal 1144
Court to be elected to a six-year term in 2013. This section does 1145
not prevent any other qualified persons from seeking, in 2013, the 1146
office of judge of the Tiffin-Fostoria Municipal Court.1147

       (E) If a person filed a declaration of candidacy and petition 1148
for the office of municipal judge of the Fostoria Municipal Court 1149
or a declaration of candidacy and petition for the office of 1150
municipal judge of the Tiffin Municipal Court and paid the fees 1151
required under section 3513.10 of the Revised Code, or filed a 1152
nominating petition for the office of municipal judge of the 1153
Fostoria Municipal Court or a nominating petition for the office 1154
of municipal judge of the Tiffin Municipal Court and paid the fees 1155
required under section 3513.261 of the Revised Code, that person 1156
is not required to pay the fee for filing a nominating petition 1157
for the office of municipal judge of the Tiffin-Fostoria Municipal 1158
Court.1159

       Section 6. This act is hereby declared to be an emergency 1160
measure necessary for the immediate preservation of the public 1161
peace, health, and safety. The reason for this necessity is that 1162
the judge for municipal court that is created by this act is 1163
necessary for the efficient administration of justice in the 1164
jurisdictions covered by the court and that the candidates for the 1165
judicial position cannot file the candidates' nominating petitions 1166
before the deadline created by this act unless this act 1167
immediately becomes effective. Therefore, this act shall go into 1168
immediate effect.1169
