STATE OF NEW YORK ________________________________________________________________________ 9195 IN SENATE May 12, 2022 ___________ Introduced by Sen. HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public service law and the public authorities law, in relation to requiring utility service providers to disclose and report third-party contracts within a certain amount of time The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public service law is amended by adding a new section 2 28 to read as follows: 3 § 28. Notice for third-party contracts. Any gas provider of last 4 resort or electric provider of last resort shall publicly notice each 5 purchase of electricity supply, energy or capacity, within seven days of 6 purchase. The utility shall report the following to the department for 7 immediate posting of any third-party supply purchase: the price, the 8 quantity purchased, and the start and end dates of the contract. 9 § 2. Section 1020-cc of the public authorities law is amended by 10 adding a new subdivision 3 to read as follows: 11 3. Service providers shall be subject to the provisions of section 12 twenty-eight of the public service law. 13 § 3. This act shall take effect on the one hundred eightieth day after 14 it shall have become a law. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
