STATE OF NEW YORK ________________________________________________________________________ 8986 IN SENATE June 11, 2018 ___________ Introduced by Sen. PHILLIPS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the racing, pari-mutuel wagering and breeding law, in relation to the composition of the local advisory board for the Belmont racetrack facility The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 6 of section 212 of the racing, pari-mutuel 2 wagering and breeding law, as added by chapter 18 of the laws of 2008, 3 is amended to read as follows: 4 6. Within thirty days following the appointment of the members of the 5 franchise oversight board, the members of the oversight board shall 6 establish a local advisory board for each racing operation comprised of 7 the following members to meet at least twice yearly: 8 a. The local advisory board for the Saratoga racetrack facility shall 9 be comprised of fifteen members and include five designees from each of 10 the following: the board of supervisors, the mayor of the city of Sara- 11 toga and the franchised corporation. 12 b. The local advisory board for the Aqueduct racetrack facility shall 13 be comprised of fifteen members, nine of whom shall be designees of New 14 York City Queens Community Board Ten, three designees of the franchised 15 corporation and three designees of the video lottery gaming operator. 16 c. The local advisory board for the Belmont racetrack facility shall 17 be comprised of fifteen members and include five designees from each of 18 the following: the temporary president of the senate, the speaker of the 19 assembly and the franchised corporation. All such designees shall 20 reside, work or own a business within five miles of the Belmont race- 21 track facility; provided, however, no one shall designate more than two 22 individuals from any one community or village. The board shall advise on 23 matters relevant to the operations and capital improvements of the fran- 24 chised corporation at the Belmont racetrack facility. To avoid dupli- 25 cation, the advisory board shall not advise on the proposed development 26 being separately reviewed by the community advisory committee formed by 27 the empire state development corporation. LBD16267-01-8S. 8986 2 1 The members of the local advisory boards shall serve for a period of 2 two years. In the event of a vacancy occurring during a term of appoint- 3 ment by reason of death, resignation, disqualification or otherwise such 4 vacancy shall be filled for the unexpired term in the same manner as the 5 original appointment. The members of the local advisory board shall 6 serve without compensation, except that each member shall be allowed the 7 necessary and actual expenses incurred in the performance of his or her 8 duties pursuant to this section. 9 § 2. This act shall take effect immediately.
