WEIK -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT authorizing the county of Suffolk to alienate certain lands used as parklands to enable Sunrise Wind, LLC to construct, maintain and operate a subterranean conduit and electrical distribution cable system, together with subterranean transition joint bays and link boxes, on county of Suffolk parkland located at Southaven County Park, Smith Point County Park and Smith Point County Marina and appurtenanc- es thereto The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subject to the provisions of this act, the county of 2 Suffolk is hereby authorized, acting by and through its governing body, 3 and upon such terms and conditions as determined by such governing body, 4 to discontinue as parklands and convey the lands described in sections 5 three and four of this act to Sunrise Wind, LLC for the purpose of 6 constructing, maintaining and operating a subterranean conduit and elec- 7 trical distribution cable system, together with subterranean transition 8 joint bays and link boxes, on county of Suffolk parkland located at 9 Southaven County Park, Smith Point County Park and Smith Point County 10 Marina and appurtenances thereto. 11 § 2. The authorization contained in section one of this act shall only 12 be effective on the condition that the county of Suffolk receives fair 13 market value of the interests being transferred by this act. 14 § 3. Upon completion of construction, Sunrise Wind, LLC, in agreement 38 and in consultation with the Suffolk County Department of Parks, Recre- 39 ation & Conservation, shall restore the surface of the land such that 40 the land shall continue to be used for park purposes. 41 § 6. In the event that the county of Suffolk received any funding 42 support or assistance from the federal government for the purchase, 43 maintenance, or improvement of the parklands set forth in sections three 44 and four of this act, the discontinuance and alienation of such park- 45 lands authorized by the provisions of this act shall not occur until the 46 county of Suffolk has complied with any federal requirements pertaining 47 to the alienation or conversion of parklands, including satisfying the 48 secretary of the interior that the alienation or conversion complies 49 with all conditions which the secretary of the interior deems necessary 50 to assure the substitution of other lands shall be equivalent in fair 51 market value and usefulness to the lands being alienated or converted. 52 § 7. This act shall take effect immediately.
