MAY, KRUEGER -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conser- vation AN ACT to amend the environmental conservation law, in relation to requiring the governor to submit an annual agency climate expenditure report The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The environmental conservation law is amended by adding a 2 new section 75-0121 to read as follows: 3 § 75-0121. Agency climate expenditure reporting. 4 1. Definitions. For the purposes of this section, the following terms 5 shall have the following meanings: 6 (a) "Agency" means any department, board, bureau, commission, divi- 7 sion, office, or committee of the state, or state authority. 8 (b) "State authority" shall mean a public authority or public benefit 9 corporation created by or existing under the public authorities law, or 10 any other law of the state of New York, with one or more of its members 11 appointed by the governor or who serve as members by virtue of holding a 12 civil office of the state, other than an interstate or international 13 authority or public benefit corporation, including subsidiaries of such 14 public authority or public benefit corporation. 15 (c) "State climate goals" means the statewide greenhouse gas emissions 16 limits established pursuant to section 75-0107 of this article and any 17 rules or regulations promulgated thereto, and any state measures and 18 actions contained in the scoping plan created pursuant to subdivision 19 thirteen of section 75-0103 of this article. 20 2. Annual agency climate expenditure report. In addition to the infor- 21 mation required by article VII of the constitution, the governor shall 22 submit to the temporary president of the senate and the speaker of the 23 assembly, as early as practicable, but no later than January thirtieth 24 of each year, an annual agency climate expenditure report. Such report 25 shall contain a comprehensive estimate and summary of spending, to 26 achieve the state climate goals for each individual agency and for the EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD15153-03-2S. 8725 2 1 state as a whole, broken down for each individual climate goal includ- 2 ing: 3 (a) a breakdown of funds allocated in the prior fiscal year; 4 (b) amounts of funds actually spent in the prior fiscal year; 5 (c) funds needed for the upcoming fiscal year; and 6 (d) an analysis of how the use of such funds under paragraphs (a) 7 through (c) of this subdivision have met or are projected to meet 8 requirements for benefiting disadvantaged communities under section 9 75-0111 of this article, and under the criteria established pursuant to 10 such section. 11 3. Achievement of state climate goals. Upon a determination by the 12 council that any specific state climate goal has been met, such state 13 climate goal shall no longer be required to be included in future annual 14 agency climate expenditure reports submitted pursuant to subdivision two 15 of this section. 16 § 2. This act shall take effect immediately.
