Subsection (i) of section 3216 of the insurance law is 2 amended by adding a new paragraph 39 to read as follows: 3 (39) (A) Every policy which provides medical, major medical, or simi- 4 lar comprehensive-type coverage shall provide coverage for follow-up 5 screening or diagnostic services for lung cancer when recommended by a 6 health care provider acting within the provider's scope of practice 7 pursuant to title eight of the education law. 8 (B) Notwithstanding any other provision of law, any policy that 9 provides coverage required by this paragraph shall not impose patient 10 cost sharing for follow-up screening or diagnostic services for lung 11 cancer. 12 § 2. Subsection (l) of section 3221 of the insurance law is amended by 13 adding a new paragraph 22 to read as follows: 14 (22) (A) Every policy which provides medical, major medical, or simi- 15 lar comprehensive-type coverage shall provide coverage for follow-up 16 screening or diagnostic services for lung cancer when recommended by a 17 health care provider acting within the provider's scope of practice 18 pursuant to title eight of the education law. 19 (B) Notwithstanding any other provision of law, any policy that 20 provides coverage required by this paragraph shall not impose patient EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. Section 4303 of the insurance law is amended by adding a new 4 subsection (vv) to read as follows: 5 (vv) (1) Every policy which provides medical, major medical, or simi- 6 lar comprehensive-type coverage shall provide coverage for follow-up 7 screening or diagnostic services for lung cancer when recommended by a 8 health care provider acting within the provider's scope of practice 9 pursuant to title eight of the education law. 10 (2) Notwithstanding any other provision of law, any policy that 11 provides coverage required by this subsection shall not impose patient 12 cost sharing for follow-up screening or diagnostic services for lung 13 cancer. 14 § 4. Subdivision 2 of section 365-a of the social services law is 15 amended by adding a new paragraph (nn) to read as follows: 16 (nn) (i) follow-up screening or diagnostic services for lung cancer 17 when recommended by a health care provider acting within the provider's 18 scope of practice pursuant to title eight of the education law. 19 (ii) notwithstanding any other provision of law, coverage required by 20 this paragraph shall not impose patient cost sharing for follow-up 21 screening or diagnostic services for lung cancer. 22 § 5. This act shall take effect January 1, 2026 and shall apply to all 23 policies and contracts issued, renewed, modified, altered or amended on 24 or after such date.
