        Introduced  by  Sen.  THOMAS -- read twice and ordered printed, and when
          printed to be committed to the Committee on Consumer Protection

        AN ACT to amend the general business law, in relation to prohibiting the
          sale of sodium nitrate

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. The general business law is amended by adding a new section
     2  398-g to read as follows:
     3    §  398-g.  Sale  of  sodium nitrate prohibited.   1. No person, corpo-
     4  ration, partnership, limited liability company, firm or any other  busi-
     5  ness  entity  shall  sell,  offer  for sale, ship or cause to be shipped
     6  sodium nitrate to any person in this state.
     7    2. Any person, corporation, partnership,  limited  liability  company,
     8  firm  or  any other business entity that violates the provisions of this
     9  section shall be subject to a civil penalty of not more than  one  thou-
    10  sand  dollars  for an initial offense provided this section shall not be
    11  construed to limit any other criminal or civil  liability  such  person,
    12  corporation, partnership, limited liability company, firm or other busi-
    13  ness entity may be subject to under law.
    14    §  2.  This  act shall take effect on the thirtieth day after it shall
    15  have become a law.
