LAVALLE -- (at request of the Department of Health) -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to requiring health care practitioners to provide and the state education department to collect information about the practice of their professions and in relation to providing practitioners with information on enrolling in the New York state donate life registry for organ, eye and tissue donations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 6541 of the education law is amended by adding a 2 new subdivision 4 to read as follows: 3 4. In conjunction with and as a condition of each triennial registra- 4 tion, each physician assistant shall provide to the department, and the 5 department shall collect, such information and documentation required by 6 the department, in consultation with the department of health, as is 7 necessary to enable the department of health to evaluate access to need- 8 ed services in this state, including, but not limited to, the location 9 and type of setting wherein the physician assistant practices and other 10 information the department, in consultation with the department of 11 health, deems relevant. The department of health, in consultation with 12 the department, shall make such data available in aggregate, de-identi- 13 fied form on a publicly accessible website. Additionally, in conjunction 14 with each triennial registration, the department, in consultation with 15 the department of health, shall provide information on registering in 16 the donate life registry for organ and tissue donation, including the 17 website address for such registry. 18 § 2. Section 6548 of the education law is amended by adding a new 19 subdivision 4 to read as follows: 20 4. In conjunction with and as a condition of each triennial registra- 21 tion, each specialist assistant shall provide to the department, and the 22 department shall collect, such information and documentation required by 23 the department, in consultation with the department of health, as is 24 necessary to enable the department of health to evaluate access to need- EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. Subdivisions 7 and 8 of section 6554 of the education law, subdi- 12 vision 7 as added by chapter 987 of the laws of 1971 and subdivision 8 13 as amended by chapter 62 of the laws of 1989, are amended and a new 14 subdivision 9 is added to read as follows: 15 (7) Character: be of good moral character as determined by the depart- 16 ment; [and] 17 (8) Fees: pay a fee of one hundred seventy-five dollars to the depart- 18 ment for admission to a department conducted examination and for an 19 initial license, a fee of eighty-five dollars for each reexamination, a 20 fee of one hundred fifteen dollars for an initial license for persons 21 not requiring admission to a department conducted examination, and a fee 22 of one hundred fifty-five dollars for each triennial registration peri- 23 od[.]; and 24 (9) Information and documentation: in conjunction with and as a condi- 25 tion of each triennial registration, provide to the department, and the 26 department shall collect, such information and documentation required by 27 the department, in consultation with the department of health, as is 28 necessary to enable the department of health to evaluate access to need- 29 ed services in this state, including, but not limited to, the location 30 and type of setting wherein the chiropractor practices and other infor- 31 mation the department, in consultation with the department of health, 32 deems relevant. The department of health, in consultation with the 33 department, shall make such data available in aggregate, de-identified 34 form on a publicly accessible website. Additionally, in conjunction with 35 each triennial registration, the department, in consultation with the 36 department of health, shall provide information on registering in the 37 donate life registry for organ and tissue donation, including the 38 website address for such registry. 39 § 4. Subdivisions 7 and 8 of section 6604 of the education law, subdi- 40 vision 7 as added by chapter 987 of the laws of 1971 and subdivision 8 41 as amended by chapter 62 of the laws of 1989, are amended and a new 42 subdivision 9 is added to read as follows: 43 (7) Character: be of good moral character as determined by the depart- 44 ment; [and] 45 (8) Fees: pay a fee of two hundred twenty dollars to the department 46 for admission to a department conducted examination and for an initial 47 license, a fee of one hundred fifteen dollars for each reexamination, a 48 fee of one hundred thirty-five dollars for an initial license for 49 persons not requiring admission to a department conducted examination, 50 and a fee of two hundred ten dollars for each triennial registration 51 period[.]; and 52 (9) Information and documentation: in conjunction with and as a condi- 53 tion of each triennial registration, provide to the department, and the 54 department shall collect, such information and documentation required by 55 the department, in consultation with the department of health, as is 56 necessary to enable the department of health to evaluate access to need-S. 8204 3 1 ed services in this state, including, but not limited to, the location 2 and type of setting wherein the dentist practices and other information 3 the department, in consultation with the department of health, deems 4 relevant. The department of health, in consultation with the department, 5 shall make such data available in aggregate, de-identified form on a 6 publicly accessible website. Additionally, in conjunction with each 7 triennial registration, the department, in consultation with the depart- 8 ment of health, shall provide information on registering in the donate 9 life registry for organ and tissue donation, including the website 10 address for such registry. 11 § 5. Subdivisions 4 and 5 of section 6608-b of the education law, 12 subdivision 4 as amended by chapter 300 of the laws of 2006 and subdivi- 13 sion 5 as amended by chapter 565 of the laws of 1995, are amended and a 14 new subdivision 6 is added to read as follows: 15 (4) Education and experience: (A) have received a high school diploma, 16 or its equivalent, and (B) have successfully completed, in accordance 17 with the commissioner's regulations, (i) an approved one-year course of 18 study in dental assisting in a degree-granting institution or a board of 19 cooperative educational services program which includes at least two 20 hundred hours of clinical experience, or an equivalent approved course 21 of study in dental assisting in a non-degree granting institution which 22 shall not be a professional association or professional organization or 23 (ii) an alternate course of study in dental assisting acceptable to the 24 department which shall be provided by a degree-granting institution or a 25 board of cooperative educational services program which includes at 26 least one thousand hours of relevant work experience; [and] 27 (5) Examination: pass an examination given by an organization which 28 administers examinations for certifying dental assistants and which is 29 acceptable to the department[.]; and 30 (6) Information and documentation: in conjunction with and as a condi- 31 tion of each triennial registration, provide to the department, and the 32 department shall collect, such information and documentation required by 33 the department, in consultation with the department of health, as is 34 necessary to enable the department of health to evaluate access to need- 35 ed services in this state, including, but not limited to, the location 36 and type of setting wherein the certified dental assistant practices and 37 other information the department, in consultation with the department of 38 health, deems relevant. The department of health, in consultation with 39 the department, shall make such data available in aggregate, de-identi- 40 fied form on a publicly accessible website. Additionally, in conjunc- 41 tion with each triennial registration, the department, in consultation 42 with the department of health, shall provide information on registering 43 in the donate life registry for organ and tissue donation, including the 44 website address for such registry. 45 § 6. Subdivisions 7 and 8 of section 6609 of the education law, subdi- 46 vision 7 as added by chapter 987 of the laws of 1971 and subdivision 8 47 as amended by chapter 62 of the laws of 1989, are amended and a new 48 subdivision 9 is added to read as follows: 49 (7) Character: be of good moral character as determined by the depart- 50 ment; [and] 51 (8) Fees: pay a fee of one hundred fifteen dollars to the department 52 for admission to a department conducted examination and for an initial 53 license, a fee of fifty dollars for each reexamination, a fee of seventy 54 dollars for an initial license for persons not requiring admission to a 55 department conducted examination, and a fee of fifty dollars for each 56 triennial registration period[.]; andS. 8204 4 1 (9) Information and documentation: in conjunction with and as a condi- 2 tion of each triennial registration, provide to the department, and the 3 department shall collect, such information and documentation required by 4 the department, in consultation with the department of health, as is 5 necessary to enable the department of health to evaluate access to need- 6 ed services in this state, including, but not limited to, the location 7 and type of setting wherein the dental hygienist practices and other 8 information the department, in consultation with the department of 9 health, deems relevant. The department of health, in consultation with 10 the department, shall make such data available in aggregate, de-identi- 11 fied form on a publicly accessible website. Additionally, in conjunc- 12 tion with each triennial registration, the department, in consultation 13 with the department of health, shall provide information on registering 14 in the donate life registry for organ and tissue donation, including the 15 website address for such registry. 16 § 7. Subdivision 6 of section 6632 of the education law, as added by 17 chapter 409 of the laws of 2013, is amended and a new subdivision 7 is 18 added to read as follows: 19 6. [Fee] fee: pay a fee determined by the department for an initial 20 license and for each triennial registration period[.]; and 21 7. information and documentation: in conjunction with and as a condi- 22 tion of each triennial registration, provide to the department, and the 23 department shall collect, such information and documentation required by 24 the department, in consultation with the department of health, as is 25 necessary to enable the department of health to evaluate access to need- 26 ed services in this state, including, but not limited to, the location 27 and type of setting wherein the licensed perfusionist practices and 28 other information the department, in consultation with the department of 29 health, deems relevant. The department of health, in consultation with 30 the department, shall make such data available in aggregate, de-identi- 31 fied form on a publicly accessible website. Additionally, in conjunction 32 with each triennial registration, the department, in consultation with 33 the department of health, shall provide information on registering in 34 the donate life registry for organ and tissue donation, including the 35 website address for such registry. 36 § 8. Subdivisions f and g of section 6734 of the education law, subdi- 37 vision f as added by chapter 618 of the laws of 1980 and subdivision g 38 as amended by chapter 62 of the laws of 1989, are amended and a new 39 subdivision h is added to read as follows: 40 f. Character: be of good moral character as determined by the depart- 41 ment; [and] 42 g. Fees: pay a fee of one hundred seventy-five dollars to the depart- 43 ment for admission to a department conducted examination and for an 44 initial license; a fee of eighty-five dollars for each reexamination; a 45 fee of one hundred fifteen dollars for an initial license for persons 46 not requiring admission to a department conducted examination; and a fee 47 of one hundred fifty-five dollars for each triennial registration peri- 48 od[.]; and 49 h. Information and documentation: in conjunction with and as a condi- 50 tion of each triennial registration, provide to the department, and the 51 department shall collect, such information and documentation required by 52 the department, in consultation with the department of health, as is 53 necessary to enable the department of health to evaluate access to need- 54 ed services in this state, including, but not limited to, the location 55 and type of setting wherein the physical therapist practices and other 56 information the department, in consultation with the department ofS. 8204 5 1 health, deems relevant. The department of health, in consultation with 2 the department, shall make such data available in aggregate, de-identi- 3 fied form on a publicly accessible website. Additionally, in conjunction 4 with each triennial registration, the department, in consultation with 5 the department of health, shall provide information on registering in 6 the donate life registry for organ and tissue donation, including the 7 website address for such registry. 8 § 9. Subdivision g of section 6740 of the education law, as amended by 9 chapter 62 of the laws of 1989, is amended and a new subdivision h is 10 added to read as follows: 11 g. Fees: pay a fee for an initial certificate of forty-five dollars, 12 and for the biennial registration period ending December thirty-first, 13 nineteen hundred eighty-two a fee of twenty dollars and a fee of fifty 14 dollars for each triennial registration period[.]; and 15 h. Information and documentation: in conjunction with and as a condi- 16 tion of each triennial registration, provide to the department, and the 17 department shall collect, such information and documentation required by 18 the department, in consultation with the department of health, as is 19 necessary to enable the department of health to evaluate access to need- 20 ed services in this state, including, but not limited to, the location 21 and type of setting wherein the physical therapist assistant practices 22 and other information the department, in consultation with the depart- 23 ment of health, deems relevant. The department of health, in consulta- 24 tion with the department, shall make such data available in aggregate, 25 de-identified form on a publicly accessible website. Additionally, in 26 conjunction with each triennial registration, the department, in consul- 27 tation with the department of health, shall provide information on 28 registering in the donate life registry for organ and tissue donation, 29 including the website address for such registry. 30 § 10. Paragraphs 7 and 8 of subdivision 1 of section 6805 of the 31 education law, paragraph 7 as added by chapter 987 of the laws of 1971 32 and paragraph 8 as amended by chapter 62 of the laws of 1989, are 33 amended and a new paragraph 9 is added to read as follows: 34 (7) Character: be of good moral character as determined by the depart- 35 ment; [and] 36 (8) Fees: pay a fee of one hundred seventy-five dollars to the depart- 37 ment for admission to a department conducted examination and for an 38 initial license, a fee of eighty-five dollars for each re-examination, a 39 fee of one hundred fifteen dollars for an initial license for persons 40 not requiring admission to a department conducted examination, and a fee 41 of one hundred fifty-five dollars for each triennial registration peri- 42 od[.]; and 43 (9) Information and documentation: in conjunction with and as a condi- 44 tion of each triennial registration, provide to the department, and the 45 department shall collect, such information and documentation required by 46 the department, in consultation with the department of health, as is 47 necessary to enable the department of health to evaluate access to need- 48 ed services in this state, including, but not limited to, the location 49 and type of setting wherein the pharmacist practices and other informa- 50 tion the department, in consultation with the department of health, 51 deems relevant. The department of health, in consultation with the 52 department, shall make such data available in aggregate, de-identified 53 form on a publicly accessible website. Additionally, in conjunction 54 with each triennial registration, the department, in consultation with 55 the department of health, shall provide information on registering inS. 8204 6 1 the donate life registry for organ and tissue donation, including the 2 website address for such registry. 3 § 11. Subdivisions 7 and 8 of section 6905 of the education law, 4 subdivision 7 as amended by chapter 994 of the laws of 1971 and such 5 section as renumbered by chapter 50 of the laws of 1972, and subdivision 6 8 as amended by chapter 62 of the laws of 1989, are amended and a new 7 subdivision 9 is added to read as follows: 8 (7) Character: be of good moral character as determined by the depart- 9 ment; [and] 10 (8) Fees: pay a fee of one hundred fifteen dollars to the department 11 for admission to a department conducted examination and for an initial 12 license, a fee of forty-five dollars for each reexamination, a fee of 13 seventy dollars for an initial license for persons not requiring admis- 14 sion to a department conducted examination, and a fee of fifty dollars 15 for each triennial registration period[.]; and 16 (9) Information and documentation: in conjunction with and as a condi- 17 tion of each triennial registration, provide to the department, and the 18 department shall collect, such information and documentation required by 19 the department, in consultation with the department of health, as is 20 necessary to enable the department of health to evaluate access to need- 21 ed services in this state, including, but not limited to, the location 22 and type of setting wherein the registered professional nurse practices, 23 whether the registered professional nurse is certified to practice as a 24 clinical nurse specialist under section sixty-nine hundred eleven of 25 this article, and other information the department, in consultation with 26 the department of health, deems relevant. The department of health, in 27 consultation with the department, shall make such data available in 28 aggregate, de-identified form on a publicly accessible website. Addi- 29 tionally, in conjunction with each triennial registration, the depart- 30 ment, in consultation with the department of health, shall provide 31 information on registering in the donate life registry for organ and 32 tissue donation, including the website address for such registry. 33 § 12. Subdivisions 7 and 8 of section 6906 of the education law, 34 subdivision 7 as amended by chapter 330 of the laws of 1981 and subdivi- 35 sion 8 as amended by chapter 62 of the laws of 1989, are amended and a 36 new subdivision 8-a is added to read as follows: 37 (7) Character: be of good moral character as determined by the depart- 38 ment; [and] 39 (8) Fees: pay a fee of one hundred fifteen dollars to the department 40 for admission to a department conducted examination and for an initial 41 license, a fee of forty-five dollars for each reexamination, a fee of 42 seventy dollars for an initial license for persons not requiring admis- 43 sion to a department conducted examination, and a fee of fifty dollars 44 for each triennial registration period[.]; and 45 (8-a) Information and documentation: In conjunction with and as a 46 condition of each triennial registration, provide to the department, and 47 the department shall collect, such information and documentation 48 required by the department, in consultation with the department of 49 health, as is necessary to enable the department of health to evaluate 50 access to needed services in this state, including, but not limited to, 51 the location and type of setting wherein the licensed practical nurse 52 practices and other information the department, in consultation with the 53 department of health, deems relevant. The department of health, in 54 consultation with the department, shall make such data available in 55 aggregate, de-identified form on a publicly accessible website. Addi- 56 tionally, in conjunction with each triennial registration, the depart-S. 8204 7 1 ment, in consultation with the department of health, shall provide 2 information on registering in the donate life registry for organ and 3 tissue donation, including the website address for such registry. 4 § 13. Section 6955 of the education law is amended by adding a new 5 subdivision 8 to read as follows: 6 8. Information and documentation: in conjunction with and as a condi- 7 tion of each triennial registration, provide to the department, and the 8 department shall collect, such information and documentation required by 9 the department, in consultation with the department of health, as is 10 necessary to enable the department of health to evaluate access to need- 11 ed services in this state, including, but not limited to, the location 12 and type of setting wherein the midwife practices and other information 13 the department, in consultation with the department of health, deems 14 relevant. The department of health, in consultation with the depart- 15 ment, shall make such data available in aggregate, de-identified form on 16 a publicly accessible website. Additionally, in conjunction with each 17 triennial registration, the department, in consultation with the depart- 18 ment of health, shall provide information on registering in the donate 19 life registry for organ and tissue donation, including the website 20 address for such registry. 21 § 14. Section 7004 of the education law is amended by adding a new 22 subdivision 10 to read as follows: 23 (10) Information and documentation: in conjunction with and as a 24 condition of each triennial registration, provide to the department, and 25 the department shall collect, such information and documentation 26 required by the department, in consultation with the department of 27 health, as is necessary to enable the department of health to evaluate 28 access to needed services in this state, including, but not limited to, 29 the location and type of setting wherein the podiatrist practices, 30 whether the podiatrist has been issued a privilege to perform podiatric 31 standard ankle surgery pursuant to section seven thousand nine of this 32 article, and other information the department, in consultation with the 33 department of health, deems relevant. The department of health, in 34 consultation with the department, shall make such data available in 35 aggregate, de-identified form on a publicly accessible website. Addi- 36 tionally, in conjunction with each triennial registration, the depart- 37 ment, in consultation with the department of health, shall provide 38 information on registering in the donate life registry for organ and 39 tissue donation, including the website address for such registry. 40 § 15. Subdivisions 7 and 8 of section 7104 of the education law, 41 subdivision 7 as added by chapter 987 of the laws of 1971 and subdivi- 42 sion 8 as amended by chapter 517 of the laws of 1995, are amended and a 43 new subdivision 9 is added to read as follows: 44 (7) Character: be of good moral character as determined by the depart- 45 ment; [and] 46 (8) Fees: pay a fee of two hundred twenty dollars to the department 47 for admission to a department conducted examination and for an initial 48 license, a fee of one hundred fifteen dollars for each reexamination, a 49 fee of one hundred thirty-five dollars for an initial license for 50 persons not requiring admission to a department conducted examination, 51 and a fee of two hundred ten dollars for each triennial registration 52 period, and for additional authorization for the purpose of utilizing 53 diagnostic pharmaceutical agents, a fee of sixty dollars[.]; and 54 (9) Information and documentation: in conjunction with and as a condi- 55 tion of each triennial registration, provide to the department, and the 56 department shall collect, such information and documentation required byS. 8204 8 1 the department, in consultation with the department of health, as is 2 necessary to enable the department of health to evaluate access to need- 3 ed services in this state, including, but not limited to, the location 4 and type of setting wherein the optometrist practices and other informa- 5 tion the department, in consultation with the department of health, 6 deems relevant. The department of health, in consultation with the 7 department, shall make such data available in aggregate, de-identified 8 form on a publicly accessible website. Additionally, in conjunction 9 with each triennial registration, the department, in consultation with 10 the department of health, shall provide information on registering in 11 the donate life registry for organ and tissue donation, including the 12 website address for such registry. 13 § 16. Paragraphs 7 and 8 of subdivision a of section 7124 of the 14 education law, paragraph 7 as amended by chapter 475 of the laws of 1973 15 and paragraph 8 as amended by chapter 62 of the laws of 1989, are 16 amended and a new paragraph 9 is added to read as follows: 17 (7) Character: be of good moral character as determined by the depart- 18 ment; [and] 19 (8) Fees: pay a fee of one hundred fifteen dollars to the department 20 for admission to a department conducted examination and for an initial 21 license, a fee of forty-five dollars for each reexamination, a fee of 22 fifty dollars for an initial license for persons not requiring admission 23 to a department conducted examination, and a fee of fifty dollars for 24 each triennial registration period[.]; and 25 (9) Information and documentation: in conjunction with and as a condi- 26 tion of each triennial registration, provide to the department, and the 27 department shall collect, such information and documentation required by 28 the department, in consultation with the department of health, as is 29 necessary to enable the department of health to evaluate access to need- 30 ed services in this state, including, but not limited to, the location 31 and type of setting wherein the ophthalmic dispenser practices, whether 32 the ophthalmic dispenser is permitted to fit contact lenses, and other 33 information the department, in consultation with the department of 34 health, deems relevant. The department of health, in consultation with 35 the department, shall make such data available in aggregate, de-identi- 36 fied form on a publicly accessible website. Additionally, in conjunc- 37 tion with each triennial registration, the department, in consultation 38 with the department of health, shall provide information on registering 39 in the donate life registry for organ and tissue donation, including the 40 website address for such registry. 41 § 17. Subdivisions 7 and 8 of section 7603 of the education law, 42 subdivision 7 as added by chapter 987 of the laws of 1971 and subdivi- 43 sion 8 as amended by chapter 62 of the laws of 1989, are amended and a 44 new subdivision 9 is added to read as follows: 45 (7) Character: be of good moral character as determined by the depart- 46 ment; [and] 47 (8) Fees: pay a fee of one hundred seventy dollars to the department 48 for admission to a department conducted examination and for an initial 49 license, a fee of eighty-five dollars for each reexamination, a fee of 50 one hundred fifteen dollars for an initial license for persons not 51 requiring admission to a department conducted examination, and a fee of 52 one hundred fifty-five dollars for each triennial registration 53 period[.]; and 54 (9) Information and documentation: in conjunction with and as a condi- 55 tion of each triennial registration, provide to the department, and the 56 department shall collect, such information and documentation required byS. 8204 9 1 the department, in consultation with the department of health and the 2 office of mental health, as is necessary to enable the department of 3 health and the office of mental health to evaluate access to needed 4 services in this state, including, but not limited to, the location and 5 type of setting wherein the psychologist practices and other information 6 the department, in consultation with the department of health and the 7 office of mental health, deems relevant. The department of health, in 8 consultation with the department and the office of mental health, shall 9 make such data available in aggregate, de-identified form on a publicly 10 accessible website. Additionally, in conjunction with each triennial 11 registration, the department, in consultation with the department of 12 health, shall provide information on registering in the donate life 13 registry for organ and tissue donation, including the website address 14 for such registry. 15 § 18. Paragraphs (f) and (g) of subdivision 1 of section 7704 of the 16 education law, paragraph (f) as added by chapter 420 of the laws of 2002 17 and paragraph (g) as amended by section 2 of part J of chapter 57 of the 18 laws of 2005, are amended and a new paragraph (h) is added to read as 19 follows: 20 (f) Character: be of good moral character as determined by the depart- 21 ment; [and] 22 (g) Fees: pay a fee of one hundred fifteen dollars to the department 23 for an initial license, and a fee of one hundred fifty-five dollars for 24 each triennial registration period. An additional surcharge in the 25 amount of five dollars shall be paid with each triennial registration 26 fee and shall be used for the marketing and evaluation of the regents 27 licensed social worker loan forgiveness program established by section 28 six hundred five of this chapter[.]; and 29 (h) Information and documentation: in conjunction with and as a condi- 30 tion of each triennial registration, provide to the department, and the 31 department shall collect, such information and documentation required by 32 the department, in consultation with the department of health, the 33 office of mental health, the office of alcoholism and substance abuse 34 services and any other state agency as appropriate, as is necessary to 35 enable the department of health, the office of mental health, the office 36 of alcoholism and substance abuse services and any other state agency as 37 appropriate to evaluate access to needed services in this state, includ- 38 ing, but not limited, to the location and type of setting wherein the 39 licensed master social worker practices and other information the 40 department, in consultation with the department of health, the office of 41 mental health, the office of alcoholism and substance abuse services and 42 any other state agency as appropriate, deems relevant. The department of 43 health, in consultation with the department, the office of mental 44 health, the office of alcoholism and substance abuse services and any 45 other state agency as appropriate, shall make such data available in 46 aggregate, de-identified form on a publicly accessible website. Addi- 47 tionally, in conjunction with each triennial registration, the depart- 48 ment, in consultation with the department of health, shall provide 49 information on registering in the donate life registry for organ and 50 tissue donation, including the website address for such registry. 51 § 19. Paragraphs (f) and (g) of subdivision 2 of section 7704 of the 52 education law, paragraph (f) as added by chapter 420 of the laws of 2002 53 and paragraph (g) as amended by chapter 230 of the laws of 2004, are 54 amended and a new paragraph (h) is added to read as follows: 55 (f) Character: be of good moral character as determined by the depart- 56 ment; [and]S. 8204 10 1 (g) Fees: pay a fee of one hundred fifteen dollars to the department 2 for an initial license and a fee of one hundred fifty-five dollars for 3 each triennial registration period[.]; and 4 (h) Information and documentation: in conjunction with and as a condi- 5 tion of each triennial registration, provide to the department, and the 6 department shall collect, such information and documentation required by 7 the department, in consultation with the department of health, the 8 office of mental health, the office of alcoholism and substance abuse 9 services and any other state agency as appropriate, as is necessary to 10 enable the department of health, the office of mental health, the office 11 of alcoholism and substance abuse services and any other state agency as 12 appropriate to evaluate access to needed services in this state, includ- 13 ing, but not limited to, the location and type of setting wherein the 14 licensed clinical social worker practices and other information the 15 department, in consultation with the department of health, the office of 16 mental health, the office of alcoholism and substance abuse services and 17 any other state agency as appropriate, deems relevant. The department of 18 health, in consultation with the department, the office of mental 19 health, the office of alcoholism and substance abuse services and any 20 other state agency as appropriate, shall make such data available in 21 aggregate, de-identified form on a publicly accessible website. Addi- 22 tionally, in conjunction with each triennial registration, the depart- 23 ment, in consultation with the department of health, shall provide 24 information on registering in the donate life registry for organ and 25 tissue donation, including the website address for such registry. 26 § 20. Subdivisions 6 and 7 of section 7804 of the education law, as 27 amended by chapter 230 of the laws of 1997, are amended and a new subdi- 28 vision 8 is added to read as follows: 29 (6) Character: be of good moral character as determined by the depart- 30 ment; [and] 31 (7) Fees: pay a fee of one hundred fifteen dollars to the department 32 for admission to a department conducted examination and for an initial 33 license, a fee of forty-five dollars for each reexamination, a fee of 34 fifty dollars for an initial license for persons not requiring admission 35 to a department conducted examination, and a fee of fifty dollars for 36 each triennial registration period[.]; and 37 (8) Information and documentation: in conjunction with and as a condi- 38 tion of each triennial registration, provide to the department, and the 39 department shall collect, such information and documentation required by 40 the department, in consultation with the department of health, as is 41 necessary to evaluate access to needed services in this state, includ- 42 ing, but not limited to, the location and type of setting wherein the 43 massage therapist practices and other information the department, in 44 consultation with the department of health, deems relevant. The depart- 45 ment of health, in consultation with the department, shall make such 46 data available in aggregate, de-identified form on a publicly accessible 47 website. Additionally, in conjunction with each triennial registration, 48 the department, in consultation with the department of health, shall 49 provide information on registering in the donate life registry for organ 50 and tissue donation, including the website address for such registry. 51 § 21. Section 7904 of the education law is amended by adding a new 52 subdivision 9 to read as follows: 53 (9) In conjunction with and as a condition of each triennial registra- 54 tion, the occupational therapist shall provide to the department, and 55 the department shall collect, such information and documentation 56 required by the department, in consultation with the department ofS. 8204 11 1 health, as is necessary to enable the department of health to evaluate 2 access to needed services in this state, including, but not limited to, 3 the location and type of setting wherein the occupational therapist 4 practices and other information the department, in consultation with the 5 department of health, deems relevant. The department of health, in 6 consultation with the department, shall make such data available in 7 aggregate, de-identified form on a publicly accessible website. Addi- 8 tionally, in conjunction with each triennial registration, the depart- 9 ment, in consultation with the department of health, shall provide 10 information on registering in the donate life registry for organ and 11 tissue donation, including the website address for such registry. 12 § 22. Subdivisions (f) and (g) of section 7904-a of the education law, 13 as added by chapter 470 of the laws of 2015, are amended and a new 14 subdivision (h) is added to read as follows: 15 (f) pay a fee for an initial license and a fee for each triennial 16 registration period that shall be one-half of the fee for initial 17 license and for each triennial registration period established for occu- 18 pational therapists; [and] 19 (g) except as otherwise provided by subdivision two of section seven- 20 ty-nine hundred seven of this article, pass an examination acceptable to 21 the department[.]; and 22 (h) in conjunction with and as a condition of each triennial registra- 23 tion, provide to the department, and the department shall collect, such 24 information and documentation required by the department, in consulta- 25 tion with the department of health, as is necessary to enable the 26 department of health to evaluate access to needed services in this 27 state, including, but not limited to, the location and type of setting 28 wherein the occupational therapy assistant practices and other informa- 29 tion the department, in consultation with the department of health, 30 deems relevant. The department of health, in consultation with the 31 department, shall make such data available in aggregate, de-identified 32 form on a publicly accessible website. Additionally, in conjunction with 33 each triennial registration, the department, in consultation with the 34 department of health, shall provide information on registering in the 35 donate life registry for organ and tissue donation, including the 36 website address for such registry. 37 § 23. Subdivision 5 of section 8004 of the education law, as added by 38 chapter 635 of the laws of 1991, is amended and a new subdivision 6 is 39 added to read as follows: 40 5. Be at least eighteen years of age[.]; and 41 6. In conjunction with and as a condition of each triennial registra- 42 tion, the certified dietitian or certified nutritionist shall provide to 43 the department, and the department shall collect, such information and 44 documentation required by the department, in consultation with the 45 department of health, as is necessary to enable the department of health 46 to evaluate access to needed services in this state, including, but not 47 limited to, the location and type of setting wherein the certified 48 dietitian or certified nutritionist practices and other information the 49 department, in consultation with the department of health, deems rele- 50 vant. The department of health, in consultation with the department, 51 shall make such data available in aggregate, de-identified form on a 52 publicly accessible website. Additionally, in conjunction with each 53 triennial registration, the department, in consultation with the depart- 54 ment of health, shall provide information on registering in the donate 55 life registry for organ and tissue donation, including the website 56 address for such registry.S. 8204 12 1 § 24. Subdivisions 6 and 7 of section 8206 of the education law, 2 subdivision 6 as amended by chapter 43 of the laws of 1983 and subdivi- 3 sion 7 as amended by chapter 62 of the laws of 1989, are amended and a 4 new subdivision 8 is added to read as follows: 5 (6) Character: be of good moral character as determined by the depart- 6 ment; [and] 7 (7) Fees: pay a fee of one hundred forty dollars to the department for 8 admission to a department conducted examination and for an initial 9 license, a fee of seventy dollars for each reexamination, a fee of one 10 hundred fifteen dollars for an initial license for persons not requiring 11 admission to a department conducted examination, and a fee of one 12 hundred fifty-five dollars for each triennial registration period[.]; 13 and 14 (8) Information and documentation: in conjunction with and as a condi- 15 tion of each triennial registration, provide to the department, and the 16 department shall collect, such information and documentation required by 17 the department, in consultation with the department of health, as is 18 necessary to enable the department of health to evaluate access to need- 19 ed services in this state, including, but not limited to, the location 20 and type of setting wherein the speech-language pathologist or audiolo- 21 gist practices and other information the department, in consultation 22 with the department of health, deems relevant. The department of health, 23 in consultation with the department, shall make such data available in 24 aggregate, de-identified form on a publicly accessible website. Addi- 25 tionally, in conjunction with each triennial registration, the depart- 26 ment, in consultation with the department of health, shall provide 27 information on registering in the donate life registry for organ and 28 tissue donation, including the website address for such registry. 29 § 25. Subdivision 8 of section 8214 of the education law, as added by 30 chapter 772 of the laws of 1990, is amended and a new subdivision 9 is 31 added to read as follows: 32 (8) Registration: if a license is granted, register triennially with 33 the department, including present home and business address and such 34 other pertinent information as the department requires[.]; and 35 (9) Information and documentation: in conjunction with and as a condi- 36 tion of each triennial registration, provide to the department, and the 37 department shall collect, such information and documentation required by 38 the department, in consultation with the department of health, as is 39 necessary to enable the department of health to evaluate access to need- 40 ed services in this state, including, but not limited to, the location 41 and type of setting wherein the acupuncturist practices and other infor- 42 mation the department, in consultation with the department of health, 43 deems relevant. The department of health, in consultation with the 44 department, shall make such data available in aggregate, de-identified 45 form on a publicly accessible website. Additionally, in conjunction with 46 each triennial registration, the department, in consultation with the 47 department of health, shall provide information on registering in the 48 donate life registry for organ and tissue donation, including the 49 website address for such registry. 50 § 26. Subdivisions 5 and 6 of section 8355 of the education law, as 51 added by section 798 of the laws of 1992, are amended and a new subdivi- 52 sion 7 is added to read as follows: 53 5. Age: be at least twenty-one years of age; [and] 54 6. Fees: pay a fee for an initial certificate of one hundred dollars 55 to the department; and a fee of fifty dollars for each triennial regis- 56 tration period[.]; andS. 8204 13 1 7. Information and documentation: in conjunction with and as a condi- 2 tion of each triennial registration, provide to the department, and the 3 department shall collect, such information and documentation required by 4 the department, in consultation with the department of health, as is 5 necessary to enable the department of health to evaluate access to need- 6 ed services in this state including, but not limited to, the location 7 and type of setting wherein the certified athletic trainer practices and 8 other information the department, in consultation with the department of 9 health, deems relevant. The department of health, in consultation with 10 the department, shall make such data available in aggregate, de-identi- 11 fied form on a publicly accessible website. Additionally, in conjunc- 12 tion with each triennial registration, the department, in consultation 13 with the department of health, shall provide information on registering 14 in the donate life registry for organ and tissue donation, including the 15 website address for such registry. 16 § 27. Paragraphs (f) and (g) of subdivision 3 of section 8402 of the 17 education law, paragraph (f) as added by chapter 676 of the laws of 2002 18 and paragraph (g) as amended by chapter 210 of the laws of 2004, are 19 amended and a new paragraph (h) is added to read as follows: 20 (f) Character: Be of good moral character as determined by the depart- 21 ment; [and] 22 (g) Fees: Pay a fee of one hundred seventy-five dollars for an initial 23 license and a fee of one hundred seventy dollars for each triennial 24 registration period[.]; and 25 (h) Information and documentation: in conjunction with and as a condi- 26 tion of each triennial registration, provide to the department, and the 27 department shall collect, such information and documentation required by 28 the department, in consultation with the department of health, as is 29 necessary to enable the department of health and the office of mental 30 health to evaluate access to needed services in this state, including, 31 but not limited to, the location and type of setting wherein the 32 licensed mental health counselor practices and other information the 33 department, in consultation with the department of health and the office 34 of mental health, deems relevant. The department of health, in consulta- 35 tion with the department and the office of mental health, shall make 36 such data available in aggregate, de-identified form on a publicly 37 accessible website. Additionally, in conjunction with each triennial 38 registration, the department, in consultation with the department of 39 health, shall provide information on registering in the donate life 40 registry for organ and tissue donation, including the website address 41 for such registry. 42 § 28. Paragraphs (f) and (g) of subdivision 3 of section 8403 of the 43 education law, paragraph (f) as added by chapter 676 of the laws of 2002 44 and paragraph (g) as amended by chapter 210 of the laws of 2004, are 45 amended and a new paragraph (h) is added to read as follows: 46 (f) Character: Be of good moral character as determined by the depart- 47 ment; [and] 48 (g) Fees: Pay a fee of one hundred seventy-five dollars for an initial 49 license and a fee of one hundred seventy dollars for each triennial 50 registration period[.]; and 51 (h) Information and documentation: in conjunction with and as a condi- 52 tion of each triennial registration, provide to the department, and the 53 department shall collect, such information and documentation required by 54 the department, in consultation with the department of health and the 55 office of mental health, as is necessary to enable the department of 56 health and the office of mental health to evaluate access to neededS. 8204 14 1 services in this state, including, but not limited to, the location and 2 type of setting wherein the licensed marriage and family therapist prac- 3 tices and other information the department, in consultation with the 4 department of health and the office of mental health, deems relevant. 5 The department of health, in consultation with the department and the 6 office of mental health, shall make such data available in aggregate, 7 de-identified form on a publicly accessible website. Additionally, in 8 conjunction with each triennial registration, the department, in consul- 9 tation with the department of health, shall provide information on 10 registering in the donate life registry for organ and tissue donation, 11 including the website address for such registry. 12 § 29. Paragraphs (f) and (g) of subdivision 3 of section 8404 of the 13 education law, paragraph (f) as added by chapter 676 of the laws of 2002 14 and paragraph (g) as amended by chapter 210 of the laws of 2004, are 15 amended and a new paragraph (h) is added to read as follows: 16 (f) Character: Be of good moral character as determined by the depart- 17 ment; [and] 18 (g) Fees: Pay a fee of one hundred seventy-five dollars for an initial 19 license and a fee of one hundred seventy dollars for each triennial 20 registration period[.]; and 21 (h) Information and documentation: in conjunction with and as a condi- 22 tion of each triennial registration, provide to the department, and the 23 department shall collect, such information and documentation required by 24 the department, in consultation with the department of health and the 25 office of mental health, as is necessary to enable the department of 26 health and the office of metal health to evaluate access to needed 27 services in this state, including, but not limited to, the location and 28 type of setting wherein the creative arts therapist practices and other 29 information the department, in consultation with the department of 30 health and the office of mental health, deems relevant. The department 31 of health, in consultation with the department and the office of mental 32 health, shall make such data available in aggregate, de-identified form 33 on a publicly accessible website. Additionally, in conjunction with each 34 triennial registration, the department, in consultation with the depart- 35 ment of health, shall provide information on registering in the donate 36 life registry for organ and tissue donation, including the website 37 address for such registry. 38 § 30. Paragraphs (f) and (g) of subdivision 3 of section 8405 of the 39 education law, paragraph (f) as added by chapter 676 of the laws of 2002 40 and paragraph (g) as amended by chapter 210 of the laws of 2004, are 41 amended and a new paragraph (h) is added to read as follows: 42 (f) Character: Be of good moral character as determined by the depart- 43 ment; [and] 44 (g) Fees: Pay a fee of one hundred seventy-five dollars for an initial 45 license and a fee of one hundred seventy dollars for each triennial 46 registration period[.]; and 47 (h) Information and documentation: in conjunction with and as a condi- 48 tion of each triennial registration, provide to the department, and the 49 department shall collect, such information and documentation required by 50 the department, in consultation with the department of health and the 51 office of mental health, as is necessary to enable the department of 52 health and the office of mental health to evaluate access to needed 53 services in this state, including, but not limited to, the location and 54 type of setting wherein the licensed psychoanalyst practices and other 55 information the department, in consultation with the department of 56 health and the office of mental health, deems relevant. Additionally, in conjunction with each 4 triennial registration, the department, in consultation with the depart- 5 ment of health, shall provide information on registering in the donate 6 life registry for organ and tissue donation, including the website 7 address for such registry. 8 § 31. Subdivisions 6 and 7 of section 8504 of the education law, as 9 added by chapter 817 of the laws of 1992, are amended and a new subdivi- 10 sion 8 is added to read as follows: 11 6. Character: be of good moral character as determined by the depart- 12 ment; [and] 13 7. Fees: pay a fee of one hundred seventy-five dollars to the depart- 14 ment for admission to a department conducted examination and for an 15 initial license; a fee of eighty-five dollars for each re-examination; a 16 fee of one hundred fifteen dollars for an initial license for persons 17 not requiring admission to a department conducted examination and a fee 18 of one hundred fifty-five dollars for each triennial registration period 19 commencing on and after June first, nineteen hundred ninety-three[.]; 20 and 21 8. Additionally, in conjunction 32 with each triennial registration, the department, in consultation with 33 the department of health, shall provide information on registering in 34 the donate life registry for organ and tissue donation, including the 35 website address for such registry. 36 § 32. Subdivisions 6 and 7 of section 8510 of the education law, as 37 added by chapter 817 of the laws of 1992, are amended and a new subdivi- 38 sion 8 is added to read as follows: 39 6. Character: be of good moral character as determined by the depart- 40 ment; [and] 41 7. Fees: pay a fee of ninety dollars to the department for admission 42 to a department conducted examination and for an initial license; a fee 43 of sixty dollars for each re-examination; a fee of fifty dollars for an 44 initial license for persons not requiring admission to a department 45 conducted examination and a fee of ninety dollars for each triennial 46 registration period commencing on and after June first, nineteen hundred 47 ninety-three[.]; and 48 8. Subdivisions 5 and 6 of section 8606 of the education law, as 54 added by chapter 755 of the laws of 2004, are amended and a new subdivi- 55 sion 7 is added to read as follows:S. 8204 17 1 5. Subdivisions 5 and 6 of section 8606-a of the education law, as 22 added by chapter 204 of the laws of 2008, are amended and a new subdivi- 23 sion 7 is added to read as follows: 24 5. Character: be of good moral character as determined by the depart- 25 ment; [and] 26 6. Fees: pay a fee of one hundred twenty-five dollars for an initial 27 certification and a fee of one hundred twenty dollars for each triennial 28 registration period[.]; and 29 7. Information and documentation: in conjunction with and as a condi- 30 tion of each triennial registration, provide to the department, and the 31 department shall collect, such information and documentation required by 32 the department, in consultation with the department of health, as is 33 necessary to enable the department of health to evaluate access to need- 34 ed services in this state, including, but not limited to, the location 35 and type of setting wherein the histological technician practices and 36 other information the department, in consultation with the department of 37 health, deems relevant. Additionally, in conjunction 40 with each triennial registration, the department, in consultation with 41 the department of health, shall provide information on registering in 42 the donate life registry for organ and tissue donation, including the 43 website address for such registry. 44 § 37. Subdivision 6 of section 8705 of the education law, as added by 45 chapter 495 of the laws of 2001, is amended and a new subdivision 7 is 46 added to read as follows: 47 6. Fee: pay a fee of three hundred dollars to the department for 48 admission to a department conducted examination for licensure, a fee of 49 one hundred fifty dollars for licensure with special competency in the 50 first specialty and twenty-five dollars for each additional specialty, 51 and a fee of three hundred dollars for each biennial registration peri- 52 od[.]; and 53 7. Information and documentation: in conjunction with and as a condi- 54 tion of each triennial registration, provide to the department, and the 55 department shall collect, such information and documentation required by 56 the department, in consultation with the department of health, as isS. 8204 18 1 necessary to enable the department of health to evaluate access to need- 2 ed services in this state, including, but not limited to, the location 3 and type of setting wherein the professional medical physicist practices 4 and other information the department, in consultation with the depart- 5 ment of health, deems relevant. The department of health, in consulta- 6 tion with the department, shall make such data available in aggregate, 7 de-identified form on a publicly accessible website. Additionally, in 8 conjunction with each triennial registration, the department, in consul- 9 tation with the department of health, shall provide information on 10 registering in the donate life registry for organ and tissue donation, 11 including the website address for such registry. 12 § 38. Paragraphs (f) and (g) of subdivision 1 of section 8804 of the 13 education law, as added by chapter 554 of the laws of 2013, are amended 14 and a new paragraph (h) is added to read as follows: 15 (f) Character: be of good moral character as determined by the depart- 16 ment and submit an attestation of moral character; [and] 17 (g) Fee: pay a fee of one hundred fifty dollars for an initial license 18 and a fee of seventy-five dollars for each triennial registration peri- 19 od[.]; and 20 (h) Information and documentation: in conjunction with and as a condi- 21 tion of each triennial registration, provide to the department, and the 22 department shall collect, such information and documentation required by 23 the department, in consultation with the department of health, as is 24 necessary to enable the department of health to evaluate access to need- 25 ed services in this state, including, but not limited to, the location 26 and type of setting wherein the certified behavioral analyst assistant 27 practices and other information the department, in consultation with the 28 department of health, deems relevant. The department of health, in 29 consultation with the department, shall make such data available in 30 aggregate, de-identified form on a publicly accessible website. Addi- 31 tionally, in conjunction with each triennial registration, the depart- 32 ment, in consultation with the department of health, shall provide 33 information on registering in the donate life registry for organ and 34 tissue donation, including the website address for such registry. 35 § 39. Paragraphs (f) and (g) of subdivision 2 of section 8804 of the 36 education law, as added by chapter 554 of the laws of 2013, are amended 37 and a new paragraph (h) is added to read as follows: 38 (f) Character: be of good moral character as determined by the depart- 39 ment and submit an attestation of moral character; [and] 40 (g) Fee: pay a fee of two hundred dollars for an initial license and a 41 fee of one hundred dollars for each triennial registration period[.]; 42 and 43 (h) Information and documentation: in conjunction with and as a condi- 44 tion of each triennial registration, provide to the department, and the 45 department shall collect, such information and documentation required by 46 the department, in consultation with the department of health, as is 47 necessary to enable the department of health to evaluate access to need- 48 ed services in this state, including, but not limited to, the location 49 and type of setting wherein the licensed behavior analyst practices and 50 other information the department, in consultation with the department of 51 health, deems relevant. The department of health, in consultation with 52 the department, shall make such data available in aggregate, de-identi- 53 fied form on a publicly accessible website. Additionally, in conjunction 54 with each triennial registration, the department, in consultation with 55 the department of health, shall provide information on registering inS. 8204 19 1 the donate life registry for organ and tissue donation, including the 2 website address for such registry. 3 § 40. Section 8852 of the education law is amended by adding a new 4 subdivision 7 to read as follows: 5 7. Information and documentation: in conjunction with and as a condi- 6 tion of each triennial registration, the department shall collect and a 7 pathologist assistant shall provide such information and documentation 8 required by the department, in consultation with the department of 9 health, as is necessary to enable the department of health to evaluate 10 access to needed services in this state, including, but not limited to, 11 the location and type of setting wherein the pathologists' assistant 12 practices and other information the department, in consultation with the 13 department of health, deems relevant. The department of health, in 14 consultation with the department, shall make such data available in 15 aggregate, de-identified form on a publicly accessible website. Addi- 16 tionally, in conjunction with each triennial registration, the depart- 17 ment, in consultation with the department of health, shall provide 18 information on registering in the donate life registry for organ and 19 tissue donation, including the website address for such registry. 20 § 41. This act shall take effect on the one hundred eightieth day 21 after it shall have become a law; provided, however, that section forty 22 of this act shall take effect on the same date and in the same manner as 23 section one of chapter 497 of the laws of 2016, takes effect.
