       Introduced  by  Sen.  BOYLE  -- read twice and ordered printed, and when
         printed to be committed to the Committee on Rules
       AN ACT to amend the education law, in relation to the cost effectiveness
         of tangible equipment
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Paragraph d of subdivision 4 of section 1950 of the educa-
    2  tion law is amended by adding a new subparagraph 6 to read as follows:
    3    (6) COST EFFECTIVENESS  OF  TANGIBLE  EQUIPMENT.  NOTWITHSTANDING  ANY
    4  OTHER  PROVISION  OF THIS SECTION TO THE CONTRARY, EXPENDITURES INCURRED
    5  BY COMPONENT SCHOOL DISTRICTS IN COMPLIANCE WITH THE  GENERAL  MUNICIPAL
    6  LAW,  PURSUANT TO PURCHASE AND/OR INSTALLATION CONTRACTS ENTERED INTO ON
    7  OR AFTER JANUARY FIFTEENTH, TWO THOUSAND, FOR  EQUIPMENT  INCLUDING  BUT
    8  NOT  LIMITED TO FURNITURE, BULLETIN BOARDS, TANGIBLE INSTRUCTIONAL MATE-
    9  RIALS AND CLASSROOM AIDS, SHALL BE AN ACCEPTABLE EXPENSE FOR  BOCES  AID
   10  IF THE COMPONENT SCHOOL DISTRICT DEMONSTRATES THE PURCHASE WOULD BE MORE
   11  COST-EFFECTIVE THAN WOULD OTHERWISE BE POSSIBLE IF SUCH SERVICES WERE TO
   12  BE PURCHASED WITHOUT THE CONSIDERATION OF BOCES AID.
   13    S  2.  The commissioner shall promulgate rules, regulations and stand-
   14  ards to implement the provisions of this act.
   15    S 3. This act shall take effect immediately.
