       AN  ACT  to  amend  the  mental  hygiene  law, in relation to the opioid
         addiction treatment and hospital diversion demonstration program;  and
         providing for the repeal of such provisions upon expiration thereof
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1.  The mental hygiene law is amended by adding a new  section
    2  19.18 to read as follows:
    3  S 19.18 OPIOID  ADDICTION TREATMENT AND HOSPITAL DIVERSION DEMONSTRATION
    4            PROGRAM.
    5    1. THE COMMISSIONER, IN CONSULTATION WITH THE  DEPARTMENT  OF  HEALTH,
    6  SHALL  ESTABLISH  A  HEROIN  AND OPIOID ADDICTION TREATMENT AND HOSPITAL
    7  DIVERSION DEMONSTRATION PROGRAM. THIS PROGRAM SHALL PROVIDE A NEW  MODEL
    8  OF  DETOXIFICATION  AND  TRANSITIONAL  SERVICES  FOR INDIVIDUALS SEEKING
    9  TREATMENT FOR HEROIN AND  OPIOID  ADDICTION  THAT  UTILIZES  SHORT-TERM,
   10  RESIDENTIAL  AND PEER-SUPPORTED SERVICES FOR OPIOID AND HEROIN ADDICTION
   11  WITH A GOAL OF  REDUCING  RELIANCE  ON  EMERGENCY  ROOM  SERVICES  WHILE
   12  PROVIDING  APPROPRIATE  SUPPORTS  TO  PATIENTS AND FAMILIES. SUCH DEMON-
   13  STRATION PROGRAM SHALL UTILIZE  EXISTING  BEDS  IN  MEDICALLY  MONITORED
   14  DETOXIFICATION  PROGRAMS,  TO  THE  EXTENT  THAT  BEDS  ARE LOCATED, AND
   15  SERVICES ARE MODIFIED, APPROPRIATELY, TO  SERVE  THOSE  WITH  HEROIN  OR
   16  OPIOID  ADDICTIONS;  AND  SHALL  PERMIT  PARTICIPATION  BY ALL PROGRAMS,
   17  SERVICES, AND FACILITIES THAT ARE CERTIFIED OR LICENSED PURSUANT TO THIS
   18  ARTICLE.  INDIVIDUALS WHO RECEIVE DETOXIFICATION  SERVICES  PURSUANT  TO
   19  THIS  DEMONSTRATION  PROGRAM  SHALL,  UPON  COMPLETION,  BE  REFERRED TO
   20  SERVICES THAT ARE APPROPRIATE TO FACILITATE THEIR RECOVERY  FROM  HEROIN
   21  AND  OPIOID  ADDICTION.  THE COMMISSIONER SHALL ESTABLISH DEMONSTRATIONS
   22  THROUGHOUT THE STATE.

    1    2. NOT LATER THAN TWO YEARS AFTER THE EFFECTIVE DATE OF THIS  SECTION,
    2  THE  COMMISSIONER SHALL PROVIDE THE GOVERNOR, THE TEMPORARY PRESIDENT OF
    3  THE SENATE, THE  SPEAKER OF THE ASSEMBLY, THE CHAIR OF THE SENATE STAND-
    4  ING COMMITTEE ON HEALTH AND THE CHAIR OF THE ASSEMBLY  HEALTH  COMMITTEE
    5  WITH A WRITTEN EVALUATION OF THE DEMONSTRATION PROGRAM.  SUCH EVALUATION
    6  SHALL ADDRESS THE OVERALL EFFECTIVENESS OF THIS DEMONSTRATION PROGRAM AS
    7  IT RELATES TO PATIENTS, THE SURROUNDING COMMUNITY, HEALTH CARE PROVIDERS
    8  AND  HEALTH  CARE  PAYORS,  AND  SHALL  INCLUDE,  BUT NOT BE LIMITED TO:
    9  LOCATIONS AND  UTILIZATION  RATES  OF  THE  DEMONSTRATION  PROGRAM;  THE
   10  AMOUNTS  OF  GRANTS  AWARDED PURSUANT TO THIS SECTION, AND THE PROGRAMS,
   11  SERVICES, AND FACILITIES THAT RECEIVED SUCH GRANTS; THE EFFECTIVENESS OF
   12  THE DEMONSTRATION PROGRAM IN PROVIDING ACCESS TO SERVICES; THE IMPACT OF
   13  THESE SERVICES; THE ASSOCIATED COST SAVINGS; AND WHETHER CONTINUATION OR
   14  EXPANSION OF THIS DEMONSTRATION PROGRAM OR  SIMILAR  MODELS  ARE  RECOM-
   15  MENDED.
   16    3. THE OPIOID ADDICTION TREATMENT AND HOSPITAL DIVERSION DEMONSTRATION
   17  PROGRAM   SHALL  PROVIDE  GRANTS,  WITHIN  APPROPRIATIONS  THEREFOR,  TO
   18  PROGRAMS, SERVICES, AND FACILITIES THAT ARE CERTIFIED OR LICENSED PURSU-
   19  ANT TO THIS ARTICLE. GRANTS MAY BE AWARDED BY THE  OFFICE  TO  PROGRAMS,
   20  SERVICES,  AND  FACILITIES  FOR  THE  PURPOSE OF ESTABLISHING THE DEMON-
   21  STRATION PROGRAM PURSUANT TO SUBDIVISION ONE OF THIS SECTION.
   22    S 2. This act shall take effect immediately and shall  expire  and  be
   23  deemed repealed three years after such effective date.
