        Introduced  by  Sen. REICHLIN-MELNICK -- read twice and ordered printed,
          and when printed to be committed to the Committee on Rules

        AN ACT to amend the public health law, in  relation  to  giving  schools
          improved access to the statewide immunization database for the immuni-
          zation records of certain children; and to amend a chapter of the laws
          of  2021  amending  the  public  health law relating to giving schools
          improved access to the statewide immunization database, as proposed in
          legislative bills numbers A. 5062 and S.  4962,  in  relation  to  the
          effectiveness thereof

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subparagraph (i) of  paragraph  (d)  of  subdivision  8  of
     2  section  2168  of  the public health law, as amended by a chapter of the
     3  laws of 2021, amending the public health law relating to giving  schools
     4  improved  access  to the statewide immunization database, as proposed in
     5  legislative bills numbers A. 5062 and S. 4962, is  amended  to  read  as
     6  follows:
     7    (i)  schools  for  the  purpose  of  verifying immunization status for
     8  eligibility for admission, for the purpose of confirming a  student  has
     9  been  screened  for  lead  when  enrolling  in child care, pre-school or
    10  kindergarten, and for the provision of appropriate educational materials
    11  developed by the department pursuant to section thirteen hundred  seven-
    12  ty-a  of  this  chapter  on the dangers of lead exposure, and the health
    13  risks associated with elevated blood lead levels to the parents or legal
    14  guardians of the student with an elevated blood lead level, as such term
    15  is defined in subdivision six of section  thirteen  hundred  seventy  of
    16  this  chapter,  as well as information on programs that may be available
    17  to the student and the parents  or  legal  guardians  of  the  student[,
    18  provided  that,  for  every school that has applied for and been granted
    19  access to identifiable registrant information pursuant to this  subdivi-
    20  sion].  For each school that has the technical ability to batch download
    21  sets of immunization records, the department shall make  available  [the
    22  capability  to batch download] such sets of immunization records of only
    23  those children [under their administrative responsibility] submitted  by

     1  the  school for which the school has obtained a certificate of immuniza-
     2  tion or for which the school has responsibility to verify the  immuniza-
     3  tion  status  for  school  attendance  purposes under section twenty-one
     4  hundred  sixty-four  of  this  article. Schools shall properly safeguard
     5  such information for use only as authorized by this section;
     6    § 2. Section 2 of a chapter of the laws of 2021, amending  the  public
     7  health  law  relating to giving schools improved access to the statewide
     8  immunization database, as proposed in legislative bills numbers A.  5062
     9  and S. 4962, is amended to read as follows:
    10    § 2. This act shall take effect [immediately] July 1, 2022.
    11    §  3.  This  act shall take effect immediately; provided, however that
    12  section one of this act shall take effect on the same date  and  in  the
    13  same manner as a chapter of the laws of 2021, amending the public health
    14  law  relating to giving schools improved access to the statewide immuni-
    15  zation database, as proposed in legislative bills numbers A. 5062 and S.
    16  4962, takes effect.
