MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to the calculation of tuition rates for institutions for the instruction of the deaf and the blind The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 4211 of the education law, as added by chapter 740 2 of the laws of 1981, is amended to read as follows: 3 § 4211. Tuition. 1. The term "tuition" as used in this article and in 4 the provisions of chapter ten hundred sixty of the laws of nineteen 5 hundred seventy-four shall mean the per pupil cost of all instructional 6 services, supplies, equipment and the operation of instructional facili- 7 ties as determined by the commissioner. Approved tuition shall be 8 computed from expenditures for which no revenue has been received from 9 the following sources: 10 a. receipts from the federal government; 11 b. any cash receipts, except gifts, bequests, donations and earned 12 interest dedicated by the directors of the institution in accordance 13 with the regulations of the commissioner; and 14 c. any refund made or any apportionment or payment received from the 15 state for experimental or special programs as approved by the commis- 16 sioner. 17 2. The tuition established by the commissioner for institutions for 18 the instruction of the deaf and of the blind as defined in section 19 forty-two hundred one of this chapter for the two thousand sixteen--two 20 thousand seventeen tuition rate year and all years thereafter shall 21 equal the product of the tuition rate for the base year and the personal 22 income growth index as defined by paragraph bb of subdivision one of 23 section thirty-six hundred two of this chapter. 24 § 2.
