KAVANAGH -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT to amend the public housing law, in relation to establishing a public housing construction and preservation fund for the city of New York The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Article 13 of the public housing law is amended by adding a 2 new title 1-A to read as follows: 3 TITLE 1-A 4 NEW YORK CITY PUBLIC HOUSING CONSTRUCTION AND PRESERVATION 5 FUND 6 Section 402-f. Definitions. 7 402-g. New York city public housing construction and preserva- 8 tion fund. 9 402-h. Powers and duties of the fund. 10 § 402-f. Definitions. As used in this title, the following terms shall 11 have the following meanings, unless the context clearly requires other- 12 wise: 13 1. "Fund" shall mean the New York city public housing construction and 14 preservation fund. 15 2. "Board" shall mean the board of trustees of the New York city 16 public housing construction and preservation fund. 17 3. "Project" shall have the same meaning as set forth in subdivision 18 fourteen of section three of this chapter. 19 § 402-g. New York city public housing construction and preservation 20 fund. 1. There is hereby established a public benefit corporation to be 21 known as the "New York city public housing construction and preservation 22 fund". 23 2. The fund shall be governed by, and its powers shall be exercised 24 by, a board of trustees. No member of the board of directors of the New 25 York city housing authority shall be one of the appointed members of the EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD14599-01-9S. 7755 2 1 board, nor shall an officer or employee of the city or state be one of 2 the appointed members of the board. 3 3. Appointed members may engage in private employment, or in a profes- 4 sion or business, unless otherwise prohibited by law, rule or regu- 5 lation. 6 4. Trustees shall receive no compensation for their services but shall 7 be reimbursed for the actual and necessary expenses incurred by them in 8 the performance of their official duties as trustees of the fund. 9 5. The board shall appoint as president of the fund an individual who 10 has extensive executive-level construction experience. The president, 11 who shall not be a member of the board, shall be the chief executive 12 officer of the fund and shall be responsible for the discharge of the 13 executive and administrative functions and powers of the fund. The pres- 14 ident shall serve at the pleasure of the board. 15 § 402-h. Powers and duties of the fund. Notwithstanding any other 16 provision of law to the contrary, the fund shall have the power and duty 17 to: 18 1. appoint officers and employees and fix their compensation; 19 2. design, construct, reconstruct, improve, rehabilitate, maintain, 20 furnish, repair, equip and otherwise provide for projects for the New 21 York city housing authority pursuant to agreements with the New York 22 city housing authority; 23 3. acquire real and personal property, or any interest therein, by any 24 method, necessary or convenient for the exercise of its functions, 25 powers and duties; 26 4. make and execute contracts and all other instruments necessary or 27 convenient for the exercise of its functions, powers and duties; and 28 5. engage the services of private consultants on a contract basis for 29 rendering professional and technical assistance and advice. 30 § 2. This act shall take effect on the one hundred eightieth day after 31 it shall have become a law.
