STATE OF NEW YORK ________________________________________________________________________ 7682 IN SENATE February 6, 2020 ___________ Introduced by Sen. SALAZAR -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to establish a temporary state commission to evaluate the manipu- lation of new technologies to commit domestic violence; and providing for the repeal of such provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. There is hereby established a temporary commission, to be 2 known as the "commission to evaluate the manipulation of new technolo- 3 gies to commit domestic violence", hereinafter "the commission", for the 4 purpose of studying how new technologies are being used by individuals, 5 including but not limited to, stalkers and domestic violence perpetra- 6 tors, to abuse, harass and victimize their targets. 7 § 2. The commission shall consist of nine members to be appointed as 8 follows: 9 (a) five members to be appointed by the governor; 10 (b) one member to be appointed by the temporary president of the 11 senate; 12 (c) one member to be appointed by the speaker of the assembly; 13 (d) one member to be appointed by the minority leader of the senate; 14 and 15 (e) one member to be appointed by the minority leader of the assembly. 16 § 3. (a) The commission shall study how new technologies are being 17 used by individuals to stalk, harass, abuse and continue to victimize 18 their targets by studying issues including but not limited to: 19 (i) what current technologies are being used by individuals against 20 their targets; 21 (ii) how individuals are using such technologies to victimize their 22 targets; 23 (iii) comparative state policies that have aided in creating a regula- 24 tory structure for such technologies and whether such measures would be 25 similarly effective in this state; and 26 (iv) the potential impact on the technology industry of any regulatory 27 measures proposed by this study. LBD14197-02-0S. 7682 2 1 (b) The commission shall prepare and publish a report of its findings 2 and recommendations on how state law needs to be updated to protect 3 possible victims and current victims of stalking and domestic violence 4 from the threat of such new technologies. 5 § 4. The members of the commission shall receive no compensation for 6 their services, but shall be allowed their actual and necessary expenses 7 incurred in the performance of their duties pursuant to this act. 8 § 5. In conducting such study, the commission may conduct any hearings 9 or take any written testimony as it deems necessary and may consult with 10 any state or local office, agency, or department and request information 11 from any such entity that is relevant and material to the completion of 12 this study and report. 13 § 6. The commission shall submit a report detailing the findings of 14 the study to the governor, the speaker of the assembly, the temporary 15 president of the senate, the minority leader of the senate and the 16 minority leader of the assembly by September 1, 2021. 17 § 7. This act shall take effect immediately and shall expire December 18 31, 2021 when upon such date the provisions of this act shall be deemed 19 repealed.
