STATE OF NEW YORK ________________________________________________________________________ 7642--A IN SENATE January 5, 2022 ___________ Introduced by Sens. STEC, OBERACKER, ORTT, TEDISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the general municipal law, in relation to the establish- ment of special districts for general ambulance services within the Adirondack park The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraphs (d), (e) and (f) of subdivision 1 of section 2 122-b of the general municipal law, as amended by chapter 303 of the 3 laws of 1980, are amended and a new closing paragraph is added to read 4 as follows: 5 (d) Establish a special district for the financing and operation of 6 general ambulance services as set forth by this section, whereby any 7 county, city, town or village, either wholly or partially within the 8 Adirondack park, acting individually, or jointly with any other county, 9 city, town and/or village, either wholly or partially within the Adiron- 10 dack park, through its governing body or bodies, following applicable 11 procedures as are required for the establishment of fire districts in 12 article eleven of the town law or following applicable procedures as are 13 required for the establishment of joint fire districts in article 14 eleven-A of the town law, with such special district being authorized by 15 this section to be established in all or any part of any such partic- 16 ipating county or counties, town or towns, city or cities and/or village 17 or villages; 18 (e) Employ any combination of the methods authorized in paragraph (a), 19 (b) [or], (c) or (d) of this subdivision; 20 [(e)] (f) No contract shall be entered into pursuant to the provisions 21 of this section for the services of an emergency rescue and first aid 22 squad of a fire department or fire company which is subject to the 23 provisions of section two hundred nine-b of [the general municipal law] 24 this chapter; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD13989-04-2S. 7642--A 2 1 [(f)] (g) Consider prehospital emergency treatment as that care 2 provided by certified emergency medical technicians or certified 3 advanced emergency medical technicians certified pursuant to the 4 provisions of article thirty of the public health law. 5 Any county, city, town or village which establishes or participates in 6 a joint district pursuant to paragraph (d) of this subdivision shall 7 dissolve and abolish any preexisting local district serving the same 8 jurisdiction. 9 § 2. Paragraph (e) of subdivision 1 of section 122-b of the general 10 municipal law, as amended by section 2 of part KK of chapter 55 of the 11 laws of 2022, is amended to read as follows: 12 [(e)] (f) A contract may be entered into pursuant to the provisions of 13 this section for the services of an emergency rescue and first aid squad 14 of a fire department or fire company which is subject to the provisions 15 of section two hundred nine-b of this chapter; 16 § 3. Paragraph (e) of subdivision 1 of section 122-b of the general 17 municipal law, as amended by chapter 303 of the laws of 1980, is amended 18 to read as follows: 19 [(e)] (f) No contract shall be entered into pursuant to the provisions 20 of this section for the services of an emergency rescue and first aid 21 squad of a fire department or fire company which is subject to the 22 provisions of section two hundred nine-b of [the general municipal law] 23 this chapter; 24 § 4. This act shall take effect immediately, provided, however, that 25 section two of this act shall take effect on the same date and in the 26 same manner as section 2 of part KK of chapter 55 of the laws of 2022 27 takes effect; and provided further that the amendments to paragraph (e) 28 of subdivision 1 of section 122-b of the general municipal law made by 29 section two of this act shall be subject to the expiration and reversion 30 of such paragraph pursuant to section 4 of part KK of chapter 55 of the 31 laws of 2022, when upon such date the provisions of section three of 32 this act shall take effect.
