          printed to be committed to the Committee on Rules

        AN ACT to amend the election law, in  relation  to  write-in  votes  for
          candidates and to repeal certain provisions of such law relating ther-
          eto

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 2 of section  8-308  of  the  election  law  is
     2  REPEALED and a new subdivision 2 is added to read as follows:
     3    2.  Any  write-in vote for a candidate whether or not such candidate's
     4  name is on the ballot for that contest shall be counted for such  candi-
     5  date  unless  such  write-in  vote  creates  an  invalid overvote in the
     6  contest.
     7    § 2. This act shall take effect immediately.
