         printed to be committed to the Committee on Mental Health and Develop-
         mental Disabilities
       AN ACT to amend the mental hygiene law,  in  relation  to  enacting  the
         "skills  for  direct support professional jobs for the developmentally
         disabled act"
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. This act shall be known and may be cited as the "skills for
    2  direct support professional jobs for the developmentally disabled act".
    3    S  2.  The mental hygiene law is amended by adding a new section 13.41
    4  to read as follows:
    5  S 13.41 REPORT ON WORKFORCE NEEDS AND CREDENTIAL PRODUCTION.
    6    1. TO THE EXTENT PRACTICABLE WITHIN AVAILABLE RESOURCES AND SUBJECT TO
    7  THE AVAILABILITY OF DATA CURRENTLY COLLECTED BY AND  ACCESSIBLE  TO  THE
    8  OFFICE,  THE  OFFICE,  IN CONSULTATION WITH THE DEPARTMENT OF LABOR, THE
    9  DEPARTMENT OF EDUCATION, AND ANY OTHER ENTITY THE OFFICE DEEMS APPROPRI-
   10  ATE, SHALL PRODUCE A REPORT REGARDING STATE WORKFORCE  NEED  PROJECTIONS
   11  AND CREDENTIAL PRODUCTION. THE REPORT SHALL:
   12    (A) INDICATE THE STATE'S ANTICIPATED WORKFORCE NEEDS AND THE NUMBER OF
   13  DEGREES,  CERTIFICATES,  AND  OTHER  CREDENTIALS THAT PUBLIC AND PRIVATE
   14  INSTITUTIONS OF HIGHER EDUCATION, PRIVATE  OCCUPATIONAL  SCHOOLS,  LOCAL
   15  COMMUNITY COLLEGES, AND AREA VOCATIONAL SCHOOLS EXPECT TO ISSUE;
   16    (B)  TO  THE  EXTENT  PROVIDED  BY SOURCES EXTERNAL TO THE DEPARTMENT,
   17  INDICATE THE STATE'S ANTICIPATED NUMBER OF  DEGREES,  CERTIFICATES,  AND
   18  OTHER  CREDENTIALS  THAT HIGH SCHOOL VOCATIONAL PROGRAMS, APPRENTICESHIP
   19  PROGRAMS, AND OTHER PUBLIC OR PRIVATE WORKFORCE TRAINING PROGRAMS EXPECT
   20  TO ISSUE;
   21    (C) IDENTIFY ANY WORKFORCE NEEDS, INCLUDING  AREAS  OF  SPECIALIZATION
   22  WITHIN  A  PARTICULAR  VOCATION,  THAT  MAY NOT BE MET BY THE EDUCATION,
   23  TRAINING, AND APPRENTICESHIP PROGRAMS;
   24    (D) IDENTIFY INSTITUTIONS, PUBLIC OR PRIVATE, THAT MAY MEET  PROJECTED
   25  WORKFORCE NEEDS; AND
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1    (E)  PROMULGATE  RECOMMENDATIONS  FOR  A  MASTER  PLAN FOR A COURSE OF
    2  STUDYING OFFERING.
    3    2.  THE OFFICE, BY JANUARY FIRST, TWO THOUSAND THIRTEEN, SHALL PROVIDE
    4  A COPY OF THE REPORT TO THE MENTAL HEALTH AND DEVELOPMENTAL DISABILITIES
    5  COMMITTEE OF THE SENATE AND ASSEMBLY OR ANY SUCCESSOR COMMITTEE, AND  TO
    6  THE GOVERNOR.
    7    3.  THE DEPARTMENT SHALL SEND THE REPORT TO EVERY PUBLIC POSTSECONDARY
    8  GOVERNING BOARD IN THE STATE AND  SHALL  WORK  WITH  THE  DEPARTMENT  OF
    9  EDUCATION  TO PROVIDE THE REPORT TO THE STATE'S PUBLIC SCHOOL DISTRICTS,
   10  NEW YORK CHARTER SCHOOLS AND NEW YORK PRIVATE  ELEMENTARY,  MIDDLE,  AND
   11  HIGH SCHOOLS.
   12    S 3. This act shall take effect immediately.
