STATE OF NEW YORK ________________________________________________________________________ 7308 IN SENATE January 17, 2020 ___________ Introduced by Sen. SANDERS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the labor law, in relation to adding components sold with instructions to combine such components to create combustion or detonation to the definition of "explosives"; and to repeal certain provisions of such law relating thereto The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 465 of the labor law, as added by a chapter of the 2 laws of 2019 amending the labor law relating to licenses to purchase, 3 use, or store certain compounds, as proposed in legislative bills 4 numbers S.1456 and A.4452, is REPEALED. 5 § 2. Subdivision 1 of section 451 of the labor law, as amended by 6 section 2 of part CC of chapter 57 of the laws of 2009, is amended to 7 read as follows: 8 1. "Explosives" means gunpowder, powders used for blasting, high 9 explosives, blasting materials, detonating fuses, detonators, pyrotech- 10 nics and other detonating agents, fireworks and dangerous fireworks as 11 defined in section 270.00 of the penal law, smokeless powder and any 12 chemical compound or any mechanical mixture containing any oxidizing and 13 combustible units, or other ingredients in such proportions, quantities, 14 or packing that ignition by fire, friction, concussion, percussion or 15 detonation of any part thereof may cause and is intended to cause an 16 explosion, but shall not include gasoline, kerosene, naphtha, turpen- 17 tine, benzine, acetone, ethyl ether, benzol or quantities of black 18 powder not exceeding five pounds for use in firing of antique firearms 19 or artifacts or replicas thereof. Fixed ammunition and primers for small 20 arms, pyrotechnic devices which are designed for and being used for 21 legitimate wildlife management or controls, safety fuses and matches 22 shall not be deemed to be explosives when, as provided by regulation, 23 the individual units contain any of the above-mentioned articles or 24 substances in such limited quantity, of such nature and so packed that 25 it is impossible to produce an explosion of such units to the injury of 26 life, limb or property. This act shall take effect on the same date and in the same 5 manner as a chapter of the laws of 2019, amending the labor law relating 6 to licenses to purchase, use, or store certain compounds, as proposed in 7 legislative bills numbers S.1456 and A.4452, takes effect.
