STATE OF NEW YORK ________________________________________________________________________ 7280 IN SENATE January 5, 2018 ___________ Introduced by Sen. MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the education law and the public health law, in relation to a sepsis awareness, prevention and education program The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 6505-b of the education law, as amended by a chap- 2 ter of the laws of 2017 amending the education law and the public health 3 law relating to a sepsis awareness, prevention and education program, as 4 proposed in legislative bills numbers S. 4971-A and A. 6053-A, is 5 amended to read as follows: 6 § 6505-b. Course work or training in infection control practices. 7 Every dentist, registered nurse, licensed practical nurse, podiatrist, 8 optometrist and dental hygienist practicing in the state shall, on or 9 before July first, nineteen hundred ninety-four and every four years 10 thereafter, complete course work or training appropriate to the profes- 11 sional's practice approved by the department regarding infection 12 control, which shall include sepsis, and barrier precautions, including 13 engineering and work practice controls, in accordance with regulatory 14 standards promulgated by the department, in consultation with the 15 department of health, which shall be consistent, as far as appropriate, 16 with such standards adopted by the department of health pursuant to 17 section two hundred thirty-nine of the public health law to prevent the 18 transmission of HIV, HBV, HCV and infections that could lead to sepsis 19 in the course of professional practice. Each such professional shall 20 document to the department at the time of registration commencing with 21 the first registration after July first, nineteen hundred ninety-four 22 that the professional has completed course work or training in accord- 23 ance with this section, provided, however that a professional subject to 24 the provisions of paragraph (f) of subdivision one of section twenty- 25 eight hundred five-k of the public health law shall not be required to 26 so document. The department shall provide an exemption from this 27 requirement to anyone who requests such an exemption and who (i) clearly 28 demonstrates to the department's satisfaction that there would be no EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD10229-05-7S. 7280 2 1 need for him or her to complete such course work or training because of 2 the nature of his or her practice or (ii) that he or she has completed 3 course work or training deemed by the department to be equivalent to the 4 course work or training approved by the department pursuant to this 5 section. The department shall consult with organizations representative 6 of professions, institutions and those with expertise in infection 7 control and HIV, HBV, HCV and infections that could lead to sepsis with 8 respect to the regulatory standards promulgated pursuant to this 9 section. 10 § 2. Subdivision (a) of section 239 of the public health law, as 11 amended by a chapter of the laws of 2017 amending the education law and 12 the public health law relating to a sepsis awareness, prevention and 13 education program, as proposed in legislative bills numbers S. 4971-A 14 and A. 6053-A, is amended to read as follows: 15 (a) Every physician, physician assistant and specialist assistant 16 practicing in the state shall, on or before July first, nineteen hundred 17 ninety-four and every four years thereafter, complete course work or 18 training, appropriate to the professional's practice, approved by the 19 department regarding infection control, which shall include sepsis, and 20 barrier precautions, including engineering and work practice controls, 21 in accordance with regulatory standards promulgated by the department in 22 consultation with the department of education, to prevent the trans- 23 mission of HIV, HBV, HCV and infections that could lead to sepsis in the 24 course of professional practice. Such coursework or training must also 25 be completed by every medical student, medical resident and physician 26 assistant student in the state as part of the orientation programs 27 conducted by medical schools, medical residency programs and physician 28 assistant programs. 29 § 3. This act shall take effect on the same date and in the same 30 manner as a chapter of the laws of 2017, amending the education law and 31 the public health law relating to a sepsis awareness, prevention and 32 education program as proposed in legislative bills numbers S. 4971-A and 33 A. 6053-A, takes effect.
