        Introduced  by  Sen. SANDERS -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation
        AN ACT to amend the vehicle and traffic law and the  education  law,  in
          relation   to  updating  the  driver's  manual  provided  to  accepted
          learner's permit applicants and driver education courses
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  Subdivision  3  of section 502 of the vehicle and traffic
     2  law, as amended by chapter 97 of the laws of 2016, is amended to read as
     3  follows:
     4    3. Application for learner's permit. An application  for  a  learner's
     5  permit  shall  be included in the application for a license. A learner's
     6  permit shall be issued in such form as the commissioner shall  determine
     7  but shall not be issued unless the applicant has successfully passed the
     8  vision test required by this section and the test set forth in paragraph
     9  (a) of subdivision four of this section with respect to laws relating to
    10  traffic and ability to read and comprehend traffic signs and symbols and
    11  has  satisfactorily  completed any course required pursuant to paragraph
    12  (a) of subdivision four of this section. Upon acceptance of an  applica-
    13  tion for a learner's permit the commissioner shall provide the applicant
    14  with  a  driver's  manual  which includes but is not limited to the laws
    15  relating to traffic, the laws relating to and physiological  effects  of
    16  driving  while  ability  impaired and driving while intoxicated, the law
    17  for exercising due care to avoid colliding with  a  parked,  stopped  or
    18  standing vehicle pursuant to section eleven hundred forty-four-a of this
    19  chapter, explanations of traffic signs and symbols, a description of law
    20  enforcement  procedures  during traffic stops and the actions a motorist
    21  shall take during such stop including appropriate interactions with such
    22  officers and such other matters as the commissioner may prescribe.
    23    § 2. Subdivision 1 of section 806-a of the education law,  as  amended
    24  by chapter 644 of the laws of 2002, is amended to read as follows:
    25    1.  Notwithstanding  any  other provision of law, all school districts
    26  providing instruction in driver education shall include in such instruc-
    27  tion: (a) a driver safety component with an emphasis on the  effects  of

     1  alcohol  and  drug  use, (b) instruction in motorcycle safety awareness,
     2  and (c) a description of law enforcement procedures during traffic stops
     3  and the actions a motorist shall take during such stop including  appro-
     4  priate  interactions with such officers. The commissioner, upon approval
     5  by the commissioner of motor vehicles, shall establish a curriculum  for
     6  the  alcohol and drug education component which shall include but not be
     7  limited to: instruction describing the hazards of driving while impaired
     8  or  intoxicated;  the  penalties  for  alcohol  related  motor   vehicle
     9  violations  including sanctions set forth in the penal law that apply to
    10  homicides and assaults arising out of the operation of a  motor  vehicle
    11  while intoxicated and those sanctions set forth in the vehicle and traf-
    12  fic  law relating to driving while intoxicated; and the medical, biolog-
    13  ical and physiological effects of the consumption of alcohol  and  their
    14  impact on the operation of a motor vehicle.
    15    §  3.  This  act shall take effect on the ninetieth day after it shall
    16  have become a law.
