STATE OF NEW YORK ________________________________________________________________________ 6932 2019-2020 Regular Sessions IN SENATE January 6, 2019 ___________ Introduced by Sen. KAVANAGH -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the alcoholic beverage control law, in relation to required information to be included on certain notices The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (a) of subdivision 9 of section 100 of the alco- 2 holic beverage control law, as added by a chapter of the laws of 2019, 3 amending the alcoholic beverage control law relating to procedures asso- 4 ciated with issuing licenses to sell liquor for consumption, as proposed 5 in legislative bills numbers S. 2359 and A. 4520, is amended to read as 6 follows: 7 (a) Within ten days after filing a new application or an application 8 for renewal to sell liquor under section sixty-four, sixty-four-a, 9 sixty-four-b, sixty-four-c or sixty-four-d of this chapter, a notice 10 thereof shall be posted by the applicant in a conspicuous place at the 11 entrance to the establishment or proposed establishment where it can be 12 easily read by passers-by. Said notice shall be in a form prescribed by 13 the authority, provided however that said notice shall be either printed 14 or highlighted in a pink ink of a neon, luminous or fluorescent variety. 15 The notice shall specify the application date, the type of license, [the16identification number] any identifying number assigned by the authority, 17 if available at the time of posting such notice, and how to contact the 18 state liquor authority to give a response to the application. The 19 applicant shall make reasonable efforts to insure such notice shall 20 remain posted throughout the pendency of such application. Addi- 21 tionally, within ten days of the applicant's receipt of a written 22 request from the authority, the applicant shall re-post such notice. 23 The authority may adopt such rules as it may deem necessary to carry out 24 the purpose of this paragraph. This act shall take effect on the same date and in the same 2 manner as a chapter of the laws of 2019, amending the alcoholic beverage 3 control law relating to procedures associated with issuing licenses to 4 sell liquor for consumption, as proposed in legislative bills numbers S. 5 2359 and A. 4520, takes effect.
