        AN  ACT  to  amend  the executive law, in relation to expanding opportu-
          nities for veteran-owned business enterprises; and providing  for  the
          repeal of such provisions upon expiration thereof
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The executive law is amended by adding a new  article  17-C
     2  to read as follows:
     3                                ARTICLE 17-C
     4                          PARTICIPATION BY VETERANS
     5                       WITH RESPECT TO STATE CONTRACTS
     6  Section 369-m. Definitions.
     7          369-n. Division of veterans' business development.
     8          369-o. Opportunities for certified veteran-owned business enter-
     9                   prises.
    10          369-p. Severability.
    11    §  369-m.  Definitions.  As  used in this article, the following terms
    12  shall have the following meanings:
    13    1. "Certified veteran-owned business enterprise" shall mean a business
    14  enterprise,  including  a  sole  proprietorship,  partnership,   limited
    15  liability company or corporation that is:
    16    (a) at least fifty-one percent owned by one or more veterans;
    17    (b)  an  enterprise  in which such veteran ownership is real, substan-
    18  tial, and continuing;
    19    (c) an enterprise in which such veteran ownership  has  and  exercises
    20  the authority to control independently the day-to-day business decisions
    21  of the enterprise;
    22    (d) an enterprise authorized to do business in this state and is inde-
    23  pendently-owned and operated;
    24    (e)  an  enterprise  that  is a small business which has a significant
    25  business presence in the state, not dominant in its field  and  employs,
    26  based  on its industry, a certain number of persons as determined by the
