          printed to be committed to the Committee on Consumer Protection

        AN ACT to amend the general business law, in relation to requiring elec-
          tric vehicle charging stations to be installed at gasoline stations in
          an amount equal to or greater than the number of  new  gas  dispensing
          nozzles being installed at such gasoline station

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1.   The general business law  is  amended  by  adding  a  new
     2  section 396-xx to read as follows:
     3    §  396-xx.  Gasoline  stations;  electric  vehicle  charging  stations
     4  required. 1. Definitions. As used in this section:
     5    (a) "dealer" shall mean any person owning or operating a  premises  or
     6  facility  with one or more gas dispensing nozzles for the retail sale of
     7  motor fuels for use in motor vehicles.
     8    (b) "electric vehicle charging station"  shall  mean  a  station  that
     9  delivers  electricity from a source outside an electric vehicle into one
    10  or more electric vehicles. An  electric  vehicle  charging  station  may
    11  include several charge points simultaneously connecting several electric
    12  vehicles  to  the station and any related equipment needed to facilitate
    13  charging plug-in electric vehicles.    Each  electric  vehicle  charging
    14  station shall have the ability to deliver charge at a minimum rate of at
    15  least  6kW  per station and be non-proprietary chargers that are able to
    16  be used by electric vehicles from at least three different auto manufac-
    17  turers.
    18    2. Any dealer installing new gas dispensing  nozzles  for  the  retail
    19  sale  of  motor  fuels  for use in motor vehicles shall install electric
    20  vehicle charging stations at such gasoline station in an amount equal to
    21  or greater than the number of new gas dispensing nozzles being installed
    22  at such gasoline station.

     1    3. No building permit shall be issued to a dealer if the documentation
     2  submitted for such building permit does not reflect the installation  of
     3  electric vehicle charging stations in an amount equal to or greater than
     4  the  number  of new gas dispensing nozzles being installed at such gaso-
     5  line station.
     6    § 2. This act shall take effect immediately.
