HINCHEY -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee -- recommitted to the Committee on Consumer Protection in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the general business law, in relation to requiring elec- tric vehicle charging stations to be installed at certain gasoline stations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The general business law is amended by adding a new 2 section 396-xx to read as follows: 3 § 396-xx. Gasoline station; dealer; electric vehicle charging station 4 required. 1. Definitions. As used in this section: 5 (a) "gasoline station" shall mean a premises or facility greater than 6 fifteen hundred square feet with operational gas dispensing motor fuel 7 pumps that dispense motor fuel available for general public retail sale. 8 (b) "dealer" shall mean any person owning or operating a premises or 9 facility with one or more operational gas dispensing motor fuel pumps 10 that dispense motor fuel available for general public retail sale. 11 (c) "electric vehicle charging station" shall mean a level two dual 12 charging station that delivers electricity from a source outside an 13 electric vehicle and can charge two electric vehicles simultaneously on 14 one circuit. An electric vehicle charging station may include several 15 charge points simultaneously connecting several electric vehicles to the 16 station and any related equipment needed to facilitate charging plug-in 17 electric vehicles. Each electric vehicle charging station shall have 18 the ability to deliver a charge load of no less than 6kW per station and 19 each electric vehicle charging station shall have non-proprietary char- EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. Any dealer installing new operational gas dispensing motor fuel 4 pumps for the retail sale of motor fuels for use in motor vehicles shall 5 also install at least one electric vehicle charging station at such 6 gasoline station. 7 3. No building permit shall be issued to a dealer if the documentation 8 submitted for such building permit does not reflect the installation of 9 at least one electric vehicle charging station at such gasoline station. 10 § 2. This act shall take effect immediately.
